3 It is said that Lord RAMA had worshiped Lord SHIVA at Rameshwaram ( situated in the Indian state of Tamilnadu) for the success of his offensive on RAVANA, King of Lanka, to free his (RAMA) wife SITA, whom he ( RAVANA) had kidnapped and confined in his Capital city. SHIVA got pleased from this worship and gave Boon of success to RAMA, against his (Shiva s) ardent follower RAVANA. Taking clue from this story, I felt that why not the entire civil society should worship Lord SHIVA in the SHRAVAN month of Hindu calendar, which is known as good month to please Lord SHIVA. As ruling class of our country is robbing our progress and prosperity by rampant corruption, so it is duty of civil society to come forward and fight for this cause ( Creation of a strict, effective and independent institution like LOKPAL against corruption.). The SHIV MAHIMNA STROTAM is known as best pray to please the Lord SHIVA and by chanting, listening or reading this STROTA, we will create a SATVIK atmosphere, which will drive out the detractors of our society. So! Just listen these mantras and share it with maximum people as it is said that if this mantra is chanted by a million times, then it became RUDRA YAGNA and that create a pious atmosphere.

4 The story of creation of the SHIV MAHIMNA STROTAM GANDHRVA PUSHPDANTA, use to steal flowers from the garden of King CHANDRASENA at nights, and in the morning, king doesn t use to get the flowers to worship Lord Shiva. He tried a lot, deputed many soldiers to catch the thief but was unsuccessful. Then the king realized that the thief is super natural power, so one day he splashed the holy water, which he used in his worship (CHARANODAK), around the flower bushes and as soon as the PUSHPADANTA S feet touched that holy water, he lost all his powers and caught by the king s man. King had put him in prison. In the prison GANDHARVA PUSHPDANTA had wrote this STROTAM and pleased the Lord SHIVA, who had returned him all his powers and instructed the King s to free him (PUSHPADANTA) from the prison.

6 म हम न प र त, परम वदष यज ञस श त त र द न म प तदवसन न त व य गर अथ व च य सवर वम तप रण म ध ग णन मम प य ष त ऽ हर नरपव द प रकर १ If the praise of Thee by one who is ignorant of the extent of Thy greatness be unbecoming, then the praises of even Brahmā and others are inadequate for Thee. And if all remain un-blamable by praising Thee according to their intellectual powers, then even this attempt on my part to compose a hymn is free from any blemish. 1

7 अत त प थ न तव च म हम व ड मनसय रतद व य व त य य च कतम भध तर प स क य त तव य क त वधग ण क य वषय पद त वव र च न पत त न मन क य न वच २ Thy greatness is beyond the reach of mind and speech. Who will praise That which even the Vedas describe with trepidation by the method of 'not this, not this'? How many qualities does That possess? And can be perceived by whom? Yet to the form taken later, whose mind and speech do not turn? 2

8 मध फ त व च परममम त न मर तवत तव न क व ग प स रग र वर मयपदम मम त व त व ण ग णकथनप ण य न भवत प न म त यथ मन प रमथनब व यर व सत ३ O Brahman! Does the praise of even Brihaspati cause any wonderment to Thee who art the Author of the nectar like sweet Vedas? O Destroyer of Tripura, the thought that by praising Thy glories I shall purify my speech has prompted me to undertake this work. 3

9 तव य य द जगददयरक ष लयक तऽय व त व य त तस ष ग ण भन न स तन ष अभव य न म मन वरद रमण य मरमण वह त व य ब श वदधत इह क जड धय ४ O Giver of boons, in refutation of Thy Divinity which is described by the three Vedas, which creates, preserves and destroys the world, and which is divided into three bodies according to the different qualities, some thick headed persons offer arguments, which are pleasing to the ignorant but in reality hateful. 4

10 क मह क क य स खल कम प य भ वन कम ध र ध त स ज त कम प द न इ त च अतकय य त वय यनवसरद थ हत धय क तक डय क न म खरय त म ह य जगत ५ To fulfill what desire, having what body with what instruments, support, and materials does that Creator indeed create the three worlds? This kind of vain argument with regard to Thee, whose Divine nature is beyond vociferous, is to the delusion of mankind. 5

11 अजन म न ल क कमवयव वत ड प जगत म ध त र क भव व धरन दत य भव त अन श व क य र द भ वनजनन क प रकर यत म द त व त यमरवर स श रत इम ६ O Lord of Gods, can the worlds be without origin though they have parts? Is creation of the worlds possible without a Creator? Who else but God can begin the creation of the worlds? Because they are fools, they raise doubts as regards Thy existence. 6

12 ऽय स ख य य ग पश प तमत व णव म त भन न थ न पर मदमद पथ य म त च र च न व च य दज क टलन न पथज ष न ण म क गम य त वम स पयम मणर व इव ७ There are different paths of realization as enjoined by the three Vedas, Sānkhyā, Yoga and Pāśupata doctrine and Vaishnava śāstras. Persons following different paths straight or crooked according as they consider that this path is best or that one is proper due to the difference in temperaments, reach Thee alone just as rivers enter the ocean. 7

13 मह क ष खड व ग परश र जन भ म फ णन कप ल च त य ववरदत ऽ पकरणम स र त त म दध त त भव द ण हत न ह व त म र म वषयम गत ण मय त ८ O Giver of boons, a great bull, a wooden club, an axe, a tiger skin, ashes, a human skull and the like these are Thy sole possessions, though by the mere casting of eyes Thou gave the gods great treasures which they enjoy. Indeed, the mirage of sense-objects cannot delude one whose delight is in the Self 8

14 व क त सव सकलमपर त वद व मद पर व य व य जग त गद त व य त वषय सम त डप य त म न प रमथन त वर मत इव त व ज म त व न खल नन ध म खरत ९ O Destroyer of Pura some say that the whole universe is eternal, while others say that all is transitory. Yet others maintain that all these are eternal and noneternal having different characteristics. Bewildered, as it were by them I do not feel ashamed to praise Thee. Indeed this garrulity indicates my audacity. 9

15 तव य य दप र व र चहर ररध प रच छ त य त वनलमनल क धवप ष तत भ भरग र ग णद भ य ग रश यत वय त थ त भ य तव कमन व न फल त १० O Girīśa, Brahmā trying above and, Vishnu trying below failed to measure Thee who took the form of a Pillar of Fire. Afterwards when they praised Thee with great devotion and faith, Thou revealed Thyself to them of thy own accord, indicating whether Thy worship can go without bearing result. 10

16 अय द प ऽभ वनमव रव य तकर दश य य ह नभ न रणक डपरवश न शर प ण र चतचरण भ र हबल थर य त व प रहर व फ जर त मदम ११ O Destroyer of Tripura, that the ten-headed Rāvana, after riding the three worlds of any trace of enemies, remained with arms eager for fresh war is due to the fact of his having great devotion to Thee devotion which prompted him to offer his heads as lotuses to Thy feet. 11

17 अम य त वत स व सम धगतस र भ जवन बल त क ल स ड प त वद धवसत वबमयत अलभ य प त ल डप यलसच लत ग शर स त त वय य स द वम प चत म त खल १२ When Rāvana extended the velour of his arms whose strength was obtained by worshipping Thee - to Kailāsa, Thy abode, Thou moved the tip of Thy toe, and he did not get a resting place even in the nether world. Verily, when affluent the wicked becomes deluded. 12

18 यद स ऽ म ण वरद परम च च र प सत मध ब ब ण प रजन वध य भ वन नत च चऽ त म न व रव सत र त वच चरणय नर क य प य न नत य भव त शरस त वय यवन त १३ O Giver of boons, that Bāna, who had the three worlds at his command, put to shade the wealth of Indra is not to be wondered at - he being the worshipper of Thy feet. What prosperity does not result from bowing down the head to Thee? 13

19 अक ण ड ण डक षयच कतद व स रक प वध य य स नय वष स तवत सकल म ष कण ठ तवनक र त न यमह वक र ड प ध य भ वनभयभ गव यस नन १४ O Three eyed one, it is not that the dark stain on the throat of Thee who drank poison as an act of favor to gods and demons at their being panicky at the threatened destruction of the universe all on a sudden, has not beautified Thee. Even deformity is admirable in one who is given to freeing the worlds of fear 14

20 अ स थ र न व कव चद पसद व स रनर नवतर न त नत य जग त ज यन य य व शख स प यन न श त व मतरसर रस ध रणमभ त मर मतर व य त म न ह व शष पथ य प रभव १५ O Lord, the God of love whose arrows do not fail anywhere in the world of gods, demons and men but are always successful became simply an object of memory by looking upon Thee as an ordinary god. For an insult to the self controlled does not conduce to good. 15

21 मह प द ध त द ज त सहस स शयपद पद व ण र म य जप रघर ग णमहगणम म ह द थ य य त य नभ तजट त डततट जग क ष य त व नट स नन व म व वभ त १६ In order to save the world when Thou danced, the earth wondered at the striking of Thy feet, whether it would not come to sudden end; so felt the spatial region along with the planets, oppressed by the movement of Thy ironcube like arms; and the heaven became then miserable - its side being struck by Thy waving matted hair. Ah, Thy very mightiness is the cause of trouble. 16

22 वयद व य प त र गणग णतफ न मर च व ह व र य प षतलघ द शर स त जगद प क र जल धवलय त न क त मत यन न व न न य ध तम हम दव य तव वप १७ The river which pervades the sky and whose foams look all the more beautiful because of stars and planets, seems no more than a drop of water when on Thy head. That again has turned the world into islands surrounded by waters. And by this should be inferred how vast is Thy divine body. 17

23 रथ क ष ण यन त शतध तरग न धन रथ रथ डग चन क रथचरणप ण शर इ त दधक ष त क डय ऽप रत णम डम बर व ध वर ध य ब डन त य नखल परतन ऽ भ धय १८ When Thou wanted to burn the three cities which were but a piece of straw, the earth was Thy chariot, Brahmā Thy charioteer, the great mountain Meru Thy bow, the sun and the moon the wheels of Thy chariot, Vishnu Thy arrow why this paraphernalia? The Lord is not dependent on others - He was playing with things at his command. 18

24 ह र त स ह कमलब लम ध य पदय य दक न त मन नजम दहरन न ऽकमलम गत भकत य क प रण तमस चबवप ष ऽय ण रक ष य ऽप रहर ज ग तर जगत म १९ O Destroyer of Tripura, Hari rooted out his lotus eye to make deficiency when one flower was missing in his offering of a thousand lotuses to Thy feet; this great devotion transformed into a discus is alert in protecting the three worlds. 19

25 बत स ज म वम स फलय ग बत मत क व कमर ध व त फल त प र ष र धनम त अत त व सम आय बत ष फलद न तभ व त बद ध व दटप रकर कमर स जन २० The sacrifice being destroyed Thou ever remainest the connecting link between the sacrificers and the fruit of the sacrifice. When does the destroyed sacrifice bear fruit, if not accompanied by the worship of the Lord? Therefore knowing Thee to be the giver of fruits and putting faith in the Vedas, people become resolute about the performance of sacrificial rites. 20

26 बय दक ष दक ष बत प तरध श तन भ त म ष ण म त वर ज य शरणद सद य स रगण बत ष त व बत फल वध नव यस नन व कत र वध रम भच र य ह मख २१ Thou Giver of refuge, even the sacrifice where Daksha, the Lord of creation expert in sacrifices was the sacrificer, Rishis were priests, gods were supervisors, was destroyed by Thee though Thou art bent upon giving fruits of the sacrifices. Surely the sacrifices cause injury to the sacrifices in the absence of devotion. 21

27 ज न थ न थ सभम भक व द हतर गत र ह त ररम यष म य य वप ष धन प ण य र त दवम प सपऽ क त मम ऽसन त त ड प त यज त न म गव य धरभस २२ O Lord, the fury of Thee who became a hunter with a bow in hand has not as yet left Brahmā though, keenly pierced by Thy arrow and terror stricken, he has fled to the sky. 22

28 वल वण य श स ध तधन षम य त णवत प र प ल द व प रमथन प प य धम प य द ण द व यम नरत द ह धर घटन दव त त व म बत वरद म ग ध य वतय २३ O Destroyer of Tripura, O Giver of boons even on seeing in front the god of love, bow in hand burnt like a straw in a trice by Thee, if Pārvatī proud of Her beauty thinks that Thou art under Her fascination, because She was allowed to occupy half of Thy body on account of austerities, ah, surely the young women are under delusion. 23

29 मश न व ब ड महर पश च सहचर त भ म ल प तग प न कर ट प रकर अम गल य श ल तव भवत न म वम खल तथ ड प मत र ण वरद परम म गलम स २४ O Destroyer of the God of love, O Giver of boons, Thy play is in cremation grounds, Thy companions are the ghosts, Thou besmearest Thy body with the ashes of burnt bodies and human skulls are Thy garlands all Thy conduct indeed is thus full of evil. But Thou conduces to the great good of those who remember Thee. 24

30 मन त य क च स वधमवध य मर त य म ण मदस लल त स गतदश यद ल क य द द इव नमज ज य म तमय द त य त त व बम प य मन त त कल भव न २५ Thou art indeed that unspeakable truth which the Yogis realize through meditation on the Self, on controlling the breath according to the scriptural directions, and realize which they shed tears of thrilling joy and swimming as it were in a pool of nectar, enjoy inner bliss. 25

31 मन त य क च स वधमवध य मर त य म ण मदस लल त स गतदश यद ल क य द द इव नमज ज य म तमय द त य त त व बम प य मन त त कल भव न २५ Thou art indeed that unspeakable truth which the Yogis realize through meditation on the Self, on controlling the breath according to the scriptural directions, and realize which they shed tears of thrilling joy and swimming as it were in a pool of nectar, enjoy inner bliss. 25

32 त वमकर त व स म त वम स पवन त व हतवह त वम प त व व य म त वम धर णर त म त व म त च प र च छन न म व त व यप रणत ब त गर न व त त व वय मह त य व नभव स २६ The wise hold this limiting opinion about Thee - Thou art the Sun, Thou art the Moon, Thou art the Fire, Thou art the Air, Thou art the Water, Thou art the space, thou art the Earth and Thou art the Self. But we do not know that thing which Thou art not. 26

33 ऽय त व भ वनमथ ऽ न प स र नक र वर ण भर भदध णर वक त त र य त ध म ध व न भरवर न ध नमण भ सम त व य त त व शरणद ग ण त य म त पदम २७ O Giver of refuge, with the three letters A, U, M indicating the three Vedas, the three states, the three worlds and the three Gods, the word OM mentions Thee separately. United by the subtle sound the word OM collectively mentions Thee - Thy Absolute Transcendent State. 27

34 भव शव र पश प तरथ म सहमह तथ भ मश न व त यद भध न क मदम अम मन त य क वतर त द व तर प य य म ध म न ण हतनम य ड म भवत २८ O Lord, Bhava, Śarva, Rudra, Paśupati, Ugra, Mahādeva, Bhīma, and Īśāna these eight names are mentioned even in the Vedas. To Thee who art beloved and effulgent I bow down. 28

35 नम न द य यदवद व य च नम नम क ष द य मरहर म ह य च नम नम व षर य ऽनयन य व च नम नम सवर म त त दद म तशव र य चनम २९ O Lover of solitude, my salutations to Thee who are very near as also very far, far away. O Destroyer of the god of love my salutations to Thee who art the minutest as also the largest. O Three eyed One, my salutations to Thee who art the oldest as also the youngest. This is my salutations to thee who art all as also transcending all. 29

36 बहलरजस व त प भव य नम नम बलतमस तत स ह र हर य नम नम जनस खक त स व म ड य नम नम मह स पद न ग ण य शव य नम नम ३० Salutations to Brahmā in whom Rajas preponderates for the creation of the universe, salutation to Rudra in whom Tamas preponderates for the destruction of the same. Salutation to Vishnu in whom Sattva preponderates for giving happiness to the people, Salutation to Śiva who is effulgent and beyond the three attributes. 30

37 क शप रण त च त क ल शव य क व च द क व च तव ग णस म ल ल धन श इ त च कतममन द क त य म भ र ध रद चरणय त व क य-प प पह रम ३१ O Giver of boons, why is my ill-developed mind subject to misery and where is Thy Divinity - eternal and possessing infinite virtues? Though terror stricken because of this, I am forced by my devotion to offer this hymn at Thy feet. 31

38 अ सत ग रसम य त कज जल स ध प ऽ स रतर वरश ख ल खन पऽम वर लख त य द ग ह त व श रद सवर क ल तद प तव ग ण न म श प र नय त ३२ O Lord if the blue mountain be the ink, the ocean the ink-pot, the branch of the heavenly tree be pen, the earth the writing leaf, and by taking these if the Goddess of Learning writes for eternity, even then the limit of Thy virtues will not be reached. 32

39 अस रस रम न न र चर त य न दम ल मर थतग णम हम न नग र ण य र य सकलगणव र प पदन त भध न र चरमलध व त ऽम तच चक र ३३ The best of the Gandharvas, Pushpadanta by name, composed in great devotion this beautiful hymn of the Lord, who is worshipped by demons, gods and the best of sages, whose praises have been sung who has got the moon on His forehead and who is attribute less. 33

40 अहरहरनव ध जर ट त ऽम तत पठ त परमभक त य श च प म न य सभव त शवल क र त ल य तथ डऽ च रतरधन य प ऽव न क तर म ३४ The person who with purified heart and in great devotion always reads this beautiful hymn to Śiva becomes like Śiva after death in the abode of Śiva, and while in this world gets much wealth, long life, many children as also fame. 34

41 मह श न न पर द व म हम न न पर त त अघ र न न पर म ऽ न त त व ग र परम ३५ There is no God better than Śiva, there is no hymn better than the Hymn on The Greatness of Śiva, there is no sacred word better than the name of Śiva, there is nothing better to be known than the real nature of spiritual teacher. 35

42 द क ष द न तप त थ ज ञ न य ग दक बय म हम न तवप ठ य कल न हर न त ष डश म ३६ Getting initiation into the spiritual life, charity, austerity, pilgrimage, knowledge of the scriptures the performance of sacrificial rites - these do not give onesixteenth part of the merit that is got by reciting the Hymn on the Greatness Of Śiva. 36

43 क स मदशनन म सवर गन धवर र ज शश श शधरम ल द व द व य द स सखल नजम हम न एव य र ष त तवन मदमक ष द दव य दव य म हम न ३७ The Lord of Gandharvas, Pushpadanta by name is the servant of the great God who has the crescent moon on His forehead. Fallen from his glory due to the anger of the Lord, he composed this very beautiful Hymn on the Greatness Of Śiva to regain His favor. 37

44 स रवरम नप ज य वगर म क ष कह त पठ त य द मन य ज लन र न यच त ज त शवसम प कन नर त यम न तवन मदमम घ प पदन त ण तम ३८ After worshipping Śiva, who is adored by Gods and who grants heaven and liberation, if one with single minded devotion and folded palms reads the unfailing hymn composed by Pushpadanta, one goes to Śiva, being worshipped by Kinnaras. 38

45 आसम मद त ऽ प ण य ग धवर भ षतम अन पम य मन ह र शवम रवणर नम ३९ This unparalleled, sacred hymn composed by Pushpadanta and describing the glory of God is all very fascinating from start to finish. 39

46 इत य ष व डमय प ज मच छ करप दय अ पर त त न द व श यत म सद शव ४० This hymnal worship is offered to the feet of Śiva. May the ever - propitious Lord of Gods be pleased with me at this. 40

47 तव त व न ज न म क द श ड स मह र य द स ड स मह द व त द श यनम नम ४१ O Lord, I do not know the true nature of Thy being - of what kind Thou art. Of whatever nature Thou mayest be, O Great God to That my salutation again and again. 41

48 एकक ल क ल व ऽक ल य पठ न नर सवर प प व नम र शवल क मह यत ४२ The person who reads this hymn once, twice or thrice is glorified in the abode of Śiva, being freed from all sins. 42

49 प पद तम खप कज नगर त न त ऽ ण क ल बहर ण हर य ण क ठ थत न प ठत न सम हत नस णत भव त भ तप तमर ह श ४३ If a person learns by heart, reads or keeps in the home this hymn, which came out of the lips of Pushpadanta and which destroys sins and is dear to Śiva, Śiva the Lord of creation becomes very pleased. 43

51 Samarpan नम सवर हत थ र यर जगद ध रह तव I स न ग यम ण म त य न म य क त II प प हम प पकम र हम प प त म प पसम भव I ऽ ह म म प वर त न थ सवर प पहर भव II ॐ भ भ र व व नमर द रस म बसद शव य नम, थर न प वर क जनल कप ल र जग य य य आन द ल न य सफलत य नम क रम समपर य म I अनय प जय नमर द रस म बसद शव य यतम न मम I स म सद शव आपर न म त I For the good of world, for the good of every one, I bow completely in your court and with all my strength I pray you. Any sin which I have done, I am doing or any sin which I can do in future, O! Lord of Goddess Paarvati, you forgive all my sins. O Shiva, you are Lord of Narmada and Saamba, I pray you. I pray and salute you with all my strength for the success of JANALOKPAL Bill movement. I pray you O Lord and I dedicate this Prayer in your court for the success of JANALOKPAL Bill movement

52 Chhamma Prarthana मन ऽह न बय ह न भ ह न मह द व I यत प जत मय द व प रप ण तद त म ii यदक छ र पद तम मऽह न म च य व त I तत सव छ म य म द व स दपरम र ii O Lord of Gods Shiva! I does not know the Mantra, neither I know the rituals and I also doesn t have your following. Yet I also am trying to pray you with all my strength and trying to worship you as best a s possible. I also doesn t know the words, and I also deviated from the right path of your worship. I again tell you that I does not know the right Mantra to worship you, so O Lord of Lord, Forgive me if I have maid any mistake in your worship and accept my worship and give me your boon.

53 Why LOKPAL Bill: Corruption is a reality and we have to accept it. Few Bureaucrats world over since ages in any administration, be it feudal or democratic, are corrupt. For Preventing the spread of this problem and turning it in to a menace, We need a strong, speedy, transparent and effective mechanism of trial and punishment against corruption. In USA also, ENRON like Scandals happens, but in-spite of clout of Mr. Kenneth Lay ( Chairman of ENRON), over BUSH administration (he was largest donor to the Bush Election campaign), he ( Kenneth Lay) and his associates. were prosecuted and sentenced to as much as 45 yrs jail and Millions of $ were recovered from their estates as fines, within a year of beginning of trial. Where as trial against RAJU (SATYAM) is still pending and Mr. SWAMI has to wait for more then a year to file a case against RAJA.

54 Corruption effects our society from all spheres. Let look at it s effects on society. On our Economy : The ill gotten money heads to safe havens in international currencies like US$. That means we buy US $, thus transfer our wealth to the US or other countries. India used to be called Golden Bird, but British had looted us systematically and transferred our wealth to EUROPE. After independence, it was expected that this loot will stop and we will be able to use our resources for our development, but unfortunately, corrupt Bureaucrats, hand in glove with politicians replaced the British and our wealth is still heading to West and,making them richer. On our Society: Socially our values are deteriorating because ill gotten money is lavishly spend in social occasion like marriage and luxuries, thus prompting society at a large for corruption and hitting our great moral values.

55 On Our Development: because of this corruption, benefits of social spends doesn t reach in right hands and goes to few hands thus leaving society at large undeveloped thus creating unreal distribution of wealth and hitting our growth. On National Security: Due to corruption, illegal activities such as extortion, illegal mining, illegal transfer of money (HAVALA) etc. spreads and this money goes in the hands of anti social elements thus harm our national security also. Look at the internal security scenario of our country. It is worsening because of rampant spread of corruption. On Environment: Corruption leads to excessive and uncontrolled exploitation of natural resources, which leads to destruction of ecology. Gandhi had said Mother nature have enough for men s requirements but it can t fulfill the greed of even a one greedy.

56 Reason of Opposing the Government Draft : Following are the main reasons of opposition of Government s proposed LOKPAL bill draft. Reason -1- Powers s of LOKPAL: Government Proposal: LOKPAL will not have any power to either initiate action suo motu in any case or even receive complaints of corruption from general public. Only Loksabha & Rajyasabha Speaker can receive and forward complain to LOKPAL. Civil Society Proposal: LOKPAL will have powers to initiate investigations suo moto in any case and also to directly entertain complaints from the public. It will not need reference or permission from anyone to initiate investigation into any case. Reason of Opposing the Government Draft :This not only severely restricts the functioning of LOKPAL, it also provides a tool in the hands of the ruling party to have only those cases referred to LOKPAL which pertain to political opponents (since speaker is always from the ruling party). It will also provide a tool in the hands of the ruling party to protect its own politicians. Its like giving right the Thief that whether he /she should be prosecuted or not

57 Reason -2- Powers of LOKPAL: Government Proposal: LOKPAL has been proposed to be an advisory body. LOKPAL, after enquiry in any case, will forward its report to the competent authority. The competent authorities will have final powers to decide whether to take action on LOKPAL s report or not. For council of Ministers PM and for MPs Speaker of LS & RS termed as competent authority. Civil Society Proposal: LOKPAL is not an advisory body. It will have the powers to initiate prosecution against any one after completion of investigations in any case. It will also have powers to order disciplinary proceedings against any government servant. Reason of Opposing the Government Draft : Will PM and speakers of houses will ever have courage to act against ministers and MP in coalition era? Example of this concern is witnessed just now as Dr. S.Swamy has to ask Supreme court to intervene for the permission to prosecute Raja from PMO, which (PMO) was sitting on his (Dr.Swamy s) request ( to prosecute RAJA) more then a year.

58 Reason -3- Powers of LOKPAL: Government Proposal: The bill is legally unsound. LOKPAL has not been given police powers. Therefore LOKPAL cannot register an FIR.. Civil Society Proposal: LOKPAL would have police powers. It will be able to register FIR, proceed with criminal investigations and launch prosecution Reason of Opposing the Government Draft : Therefore all the enquiries conducted by LOKPAL will tantamount to preliminary enquiries. Even if the report of LOKPAL is accepted, who will file the charge sheet in the court? Who will initiate prosecution? Who will appoint the prosecution lawyer? The entire bill is silent on that. Reason -4- Powers of LOKPAL: Government Proposal: The bill does not say what will be the role of CBI after this bill. Can CBI and LOKPAL investigate the same case or CBI will lose its powers to investigate politicians?

59 Civil Society Proposal: That part of CBI, which deals with cases of corruption, will be merged into LOKPAL so that there is just one effective and independent body to take action against corruption Reason of Opposing the Government Draft :If the latter is true, then this bill is meant to completely insulate politicians from any investigations whatsoever which are possible today through CBI. Reason -5- Powers of LOKPAL: Government Proposal: There is a strong punishment for frivolous complaints. If any complaint is found to be false and frivolous, LOKPAL will have the power to send the complainant to jail through summary trial but if the complaint were found to be true, the LOKPAL will not have the power to send the corrupt politicians to jail! Civil Society Proposal: Deterrence has been provided against frivolous complaints in the form of financial penalties against the complainant, however, Loka-yukta is empowered to prosecute the corrupt and take disciplinary action against them.

60 Reason of Opposing the Government Draft : So the bill appears to be meant to browbeat, threaten and discourage those fighting against corruption. Reason -6- Jurisdiction of LOKPAL: Government Proposal: LOKPAL will have jurisdiction only on MPs, ministers and PM. It will not have jurisdiction over officers. The officers and politicians do not indulge in corruption separately. Civil Society Proposal: LOKPAL would have police powers. It will be able to register FIR, proceed with criminal investigations and launch prosecution Reason of Opposing the Government Draft : In any case of corruption, there is always an involvement of both of them. So according to government s proposal, every case would need to be investigated by both CVC and LOKPAL So now, in each case, CVC will look into the role of bureaucrats while LOKPAL will look into the role of politicians. Obviously the case records will be with one agency and the way government functions it will not share its records with the other agency. It is also possible

61 that in the same case the two agencies arrive at completely opposite conclusions. Therefore it appears to be a sure way of killing any case. Reason -7- Body of LOKPAL: Government Proposal: LOKPAL will consist of three members, all of them being retired judges. Civil Society Proposal: LOKPAL would have ten members and one Chairperson. Out of them four need to have legal background (they need not be judges) Others could be from any background. Reason of Opposing the Government Draft : There is no reason why the choice should be restricted to judiciary. By creating so many post retirement posts for judges, the government will make the retiring judges vulnerable to government influences just before retirement as is already happening in the case of retiring bureaucrats. The retiring judges, in the hope of getting post retirement employment would do the bidding of the government in their last few years

62 Reason -8- Inclusion of PM Government Proposal: LOKPAL will not have powers to investigate any case against PM, which deals with foreign affairs, security and defense. Civil Society Proposal: There is no such bar on LOKPAL s powers Reason of Opposing the Government Draft : This means that corruption in defense deals will be out of any scrutiny whatsoever. It means,it will become impossible to investigate into any Bofors scandal in future. Reason -9- Time frame for Prosecution proceedings : Government Proposal: Whereas a time limit of six months to one year has been prescribed for LOKPAL to enquire, however, subsequently, there is no time limit prescribed for completion of trial Civil Society Proposal: Investigations should be completed within one year. Trial should get over within the next one year.

63 Reason of Opposing the Government Draft : Looking at the present scenario of trials, case will keep on dragging and culprits will roam free. Look at Sukhram and many other cases where the culprits have died during the trial and country had suffered losses. Reason -10- Inclusion of Bureaucracy : Government Proposal: It does not deal with corruption of Bureaucrats. Corrupt bureaucrats continue in their job without any actions against them. Civil Society Proposal: LOKPAL will have power to direct disciplinary action, including dismissal of a corrupt officer from job. Reason of Opposing the Government Draft : We all know that it is Bureaucrats and politicians hand in glove behind all the scams, so it (LOKPAL) will have no credible effect on corruption. Common man of this country is exploited by Bureaucracy only and people have to pay bribes for their rightful rights and bureaucrats either pay bribes or their loyalty to politicians for plump postings and the business of corruption continues. To break this, Bureaucracy also need to be brought under LOKPAL.

64 Reason -11- Inclusion of Judges Government Proposal: It does not talk of investigation of complaints against judges Civil Society Proposal: LOKPAL will have powers to initiate investigations on complaints of corruption against judges. Reason of Opposing the Government Draft : We have seen the case of Justice Dinakaran, in which trial has still not started ands it is also the against the constitution, which equates all the citizen in the court of law. Reason -12- Selection of cases Government Proposal: Speaker would decide which complaints shall be enquired into by LOKPAL Civil Society Proposal: LOKPAL will not be able to dismiss any complaint from public without hearing the complainant Reason of Opposing the Government Draft : Speakers belong to ruling party, so they will rarely initiate any action against the culprits of their own party..

65 Reason -13- Inclusion of Bureaucracy Government Proposal: Our entire governance system suffers from inadequate public grievance reprisal systems, which force people to pay bribes. LOKPAL bill does not address this issue. Civil Society Proposal: LOKPAL will have the powers to orders redressal in a time bound manner. It will have powers to impose financial penalties on guilty officers, which would be paid to complainant as compensation. Reason of Opposing the Government Draft : Common man annually pays bribe, in tune of 21,068 crore ( US$ 4.7 billion) for 11 basic services like education. Judiciary, healthcare, police etc. Only Truckers pay 48,680 crore, appx. (US$5 billion in bribes) in 2010, and this amount is shared between the local politicians, local officials in the form of bribe for the lucrative postings by public servants and we can see that our present system is not adequate to save common man. Un-till unless this issue taken seriously, common people will not feel the difference.

66 Reason -14- Protection to whistleblowers Government Proposal: LOKPAL does not have any powers to provide protection to them whistleblowers. Civil Society Proposal: LOKPAL will have powers to provide protection against physical and professional victimization of whistleblowers Reason of Opposing the Government Draft : Large numbers of people raising their voice against political corruption are being murdered, so in such scenario, how can we expect people will come forward against corruption? Reason -15- Recovery of Ill gotten Money : Government Proposal: Nothing has been provided in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money Civil Society Proposal: Loss caused to the government due to corruption will be recovered from all accused

67 Reason of Opposing the Government Draft : The reason of rampant corruption is fearless of corrupts due to negligible punishment and retaining the ill gotten wealth. So Govt. bill will not make any impact. Reason -16- Length of Punishment : Government Proposal: Under the present law, there is Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years. Civil Society Proposal: Enhanced punishment - The punishment would be minimum 5 years and maximum of life imprisonment. Reason of Opposing the Government Draft : Only recovery of ill gotten wealth and strict punishment keep people away from corruption..

We should not be dishearten with the government stand as Have you ever heard that a thief had allowed prosecution against his/her theft? We should ready ourselves for the 2014 election because then the political class has to come back to the same civil society. We need to go to the masses and make them understand the importance of not only LOKPAL Bill but other reforms also so that when the political class comes to the public for the re-elections, people should ask them for a written commitments on these rightful demands, so that if they fail in delivering those demands, people can go to the court for proceeding for betrayal on written commitments. We have example of CHANAKYA with us from our own history. How come a humble teacher had overthrown a powerful empire, when he felt that the empire is not performing its nationalist duties and is a threat to the security of nation against the external dangers to the country, at the times, when military powers used to be needed for change of regimes.
