Then, obamacare insurance premiums are set to soar. Who will voters blame? Behind the headlines, a 1970s lawsuit to advance women in the workplace is now an Amazon TV series and our own Eleanor Holmes-Norton was the lawyer for the good girl revolt plaintiffs.

2 Bonnie erbe: Hello, I'm Bonnie Erbe. Welcome to "to the contrary," a discussion of news and social trends from diverse perspectives. Up first, it's almost over. Just barely more than a week before what some would call the most hotly contested presidential race in recent history takes place, most polls showing former secretary of state Hillary Clinton on her way to the white house. And if that proves true, it is the women's vote that will open the door for her. Celinda Lake: Our latest polls show that Hillary is going to win, the question is the margin. Don't pay very much attention, frankly, to the national polls. Pay more attention to the state-specific polls. And in the state-specific polls she's doing quite well. But what is happening is some Republicans are coming home to trump, away from third-party candidates. But women are still going to elect Hillary Clinton as the President of the United States. Bonnie Erbe: New wikileaks dumps include an alleged memo from a then-staffer for former president Bill Clinton. He reported working contacts to secure high-paid speaking fees for him and donations to the Clinton foundation. Even that did little to change poll numbers in most critical battleground states, but in North Carolina and Florida trump was tied with Clinton, whereas they leaned blue before. In down-ballot races, democrats are predicting they will take back control of the US senate. Pollster Celinda Lake believes the number of women in the senate, now 20, could increase to 24 or even 25: Celinda Lake: We will win the senate because of women. We will win the senate because of the turnout of women. We will win the senate because women voters have supported these candidates, male and female, because we have such outstanding women candidates. Obviously Illinois, where Tammy Duckworth will be in the senate, but we have a ton of races in New Hampshire, Nevada, north Carolina-- all presidential target states with women candidates in them, neck to neck races Bonnie Erbe:. Are women turning out to vote so congress woman Norton, are women turning out to vote for Hillary Clinton or against Donald trump? Del. Elanor Holmes Norton: Bonnie, Hillary's stellar qualifications should be enough but I have to admit that trump's unfitness adds icing to this cake. Donald Trump: Well, I think Donald Trump has been struggling but at the same time he is closing in on the gap and we do look forward to seeing him in the white house. Atima Omara: I think it's both. You've got women who really like her like mieses who are going out to vote for her and women who have been repelled by the recent revelations around trump's sexism. Ashe Schow: I completely agree but I do think that there might be a lot of women who just decide they don't like both candidates and might just sit this one out. Bonnie Erbe: Not vote at all? Ashe Schow: Maybe not vote at all.

3 Bonnie Erbe: Maybe down ballot? Ashe Schow: Hopefully we would like to see that but I think there are A lot of women out there who don't like trump but they can't support Hillary Clinton because they're republican women mostly, you know, they don't like Hillary's policies. So just because they hate trump doesn't mean they can go vote for Hillary's policies. Hating trump doesn't make her policies more, you know, favorable to Republicans. Bonnie Erbe: Except that we are seeing record, with some of the early voting, I just heard that for the Democratic ballots requests in Virginia, which president Obama won, and she's ahead, which should be A contested state but it looks like she is way ahead, six to one requests for Democratic ballots vs. Republican ballots up like three times what it was in Is that women requesting early voting? Del. Eleanor Holmes Norton: To parse it out within different at this point because we are talking about early voting but what democrats have done is to make up what was an enthusiasm gap. Now more women vote than men, and so we've got to assume that the people going out are probably more will than menace well. So that's good news for the democrats. Saba Ahmed: Do you think Tim Kaine is helping Hillary Clinton but at the same time it's just early voting. I think a lot of people aren't going to be turning out. In down ballot votes in Virginia we have a contested race coming up. I think all of them are going to try to defend republican seats. Atima Omara: An ABC tracking poll last week she has doubled her lead with college educated white women, six points in 12, she had even gone up with non-educated college white women who have been supported of him but when the question ask whether your opinion had changed due to the access Hollywood tape, a lot of the allegations coming out gngs him from women accusers, it has hurt him even with that group that has been particular will I loyal to him and it's sort of the play around and races around the country, Maggie who is doing really well... Bonnie Erbe: We'll get to down balloting in a couple of minutes. I want to stay on the presidential for right now but do you think the revelation that the FBI is reopening its investigation of her s is going; could that be the October surprise that the trump campaign has been waiting for? Ashe Schow: I think certainly this is the greatest surprise they could have been hoping for. It's going to hopefully... Bonnie Erbe: Do you think that's as big as, for example, if there were A huge terrorist attack or something? Ashe Schow: I mean that would have to happen. This has actually happened. I think this is the best they could hope for right now given we only have, you know, a week or so until the election. How that is going play out with women, I don't know. I'm not sure how much women cared about the FBI investigation. If you already liked Hillary then it was a sham against her and she deservedly got away with it. If you didn't like Hillary Clinton it was a sham and she got away with it unfairly, so I'm not sure how much that really swayed any women.

4 Bonnie Erbe: Celinda lakes said at this point stuff like the s known is paying attention anymore. It's been going on. The investigation was on. It's off, it's on again. Et cetera. So it's just noise. Atima Omara: Try as I have on many different networks and talked about it fox news and fox business, you know, American network and all the ones I've talked about the , they don't seem to be hitting with folks. Del. Eleanor Holmes Norton: The difference is the FBI. I want to look more closely that makes the FBI think they have to look more closely. That's the added ingredient here. Not just another... Bonnie Erbe: You think that will turn some women off? Del. Eleanor Holmes Norton: I think it's baked in. And I don't think we'll know enough from the FBI to unbake it Saba Ahmed: She isn't going to be charged within a week regardless of the FBI investigation. If she becomes president, I don't think that's going to be happening. But you know, it is the last ditch effort by the trump campaign I think, to probably help with the sample polling numbers in swing states but surprisingly given her track record it's surprising and given Donald trump he is leading by close margins. Bonnie Erbe: ABC poll came out showing nationally, of course, Celinda Lake told us not to pay attention to national numbers but leading by 7 points is not a small number. Atima Omara: You can account for some of what is happening a little bit too some Republicans are like coming home a little bit to Trump so I think that's what is happening with the closing of the gap. But that's kind of his base already. He needs to get out beyond that in a general... Bonnie Erbe: Now let's talk about down ballot races. Celinda said there could be 24 or 25 women in the senate starting in January. What do you think? She also thinks, of course, that the democrats will pick back up the majority party in the senate. Saba Ahmed: Well it will be interesting. We'll get to see in the next couple of weeks, but for a woman... Bonnie Erbe: Do you think Kelly is going to hang on in New Hampshire especially now a new poll showed Hillary Clinton ahead by nine points? Saba Ahmed: It's going to be a tough race for her but I really do hope that women maintain at least 20% plus majority numbers in the senate. We need a lot more. But republican senators are definitely struggling right now. Bonnie Erbe: What about women voters in New Hampshire. When they hear their senator... I was for him before I was against him now I'm for him again, now maybe I'm against him again. Her waffling on this issue, what does that do to women voters?

5 Saba Ahmed: I think trump comments against women have definitely hurt a lot of the republican races. But I think when you see the general election, a lot of people are voting down party line and so I think the people who support her will stand behind her and hopefully she will win through this. Bonnie Erbe: What do you see down ballot? What do you see happening, which Democratic women do you see winning? Atima Omara: Maggie is very popular governor, Kelly has struggled with the trump stuff a lot more than I thought someone of her training and having been a U.S. Senator would. Bonnie Erbe: And Tammy Duckworth we think is going win. Atima Omara: And Mark Kirk even just yesterday stuck his foot in his mouth basically questioning her Americanness by saying, you know, I didn't know your thai family was fighting with George Washington. She is a member of the daughters of the American Revolution. You've got a couple great congressional rations in Virginia, Florida, so, I think you are going to get a lot of A pickup it could be another year of the woman like in E.P.A. 92 and I think primarily because you've got folks like trump, beginning rich, Giuliani just beating the drum on most horrific things you can say when it can ums to gender equality. Bonnie Erbe: That thing with Megan Kelly week... Atima Omara: Hasn't done him any favors. Ashe Schow: I think Republicans had a problem with the senate map this year regardless of trump. I think he ends up hurting them so I think what Republicans need to actually think about, and I've actually written to columns on this saying Republicans could actually lose the house and a month later saying well maybe they are going to take it. Depending on how big Hillary Clinton's win is. If she, I think David Wasserman from the political report looked at it and if she wins 1.5 percentage points more than Obama, she is still winning fewer counties so or congressional l districts so Republicans might maintain a narrow lead in the house Even if she wins and I'm not sure if she'll win by er margin than Obama did in 2012 but it will be interesting. Bonnie Erbe: Your take... You're in the house. Do you think the Republicans are going lose the house? Del. Eleanor Holmes Norton: Overcome the gerrymandering would be a miracle. We have continued to get more Democratic votes in every election but they still keep the house because the districts are so severely y gerrymandered. From the voting to healthcare's impact on the election. The GOP is making Obamacare a major issue, especially in swing states. On November first Americans begin signing up for their health insurance. But they already got an October surprise because rates are published and they show premiums will skyrocket. Midlevel plan are set to rise an average of 25% in the 39 states that use the federal healthcare.gov. Premiums for silver plans that have lower deductibles will rise 116- percent in Arizona, 40-percent in north Carolina

6 and 53-percent in Pennsylvania. Democrats counter that some 20 million Americans have been ab le to get coverage under the affordable care ac t. And children up to 26 years old can be covered by their parents policies among other benefits. Many enrollees do get subsidies but self-employed and small businesses could be hit hard depending on where they live in or if they're in a state where insurance companies have pulled out of the exchanges. Celinda Lake: There has to be a fix to Obamacare. What's interesting is, women owned businesses that they're number one policy that they wanna see from the government is affordable care for their employees. For men its tax breaks. I think people don't blame Hillary Clinton particularly/ and there are a lot of people, particularly a lot of women, who think okay, she has a long history in health care, everyone agrees it needs to be fixed, so let's put her in charge. She might actually be the best one to fix It. Bonnie Erbe: Do you think so? Ashe Schow: I don't think so. I mean when w e found out that the rate hikes were coming she put out a statement saying yes, we can fix somethings and then pointed out trump wants to dismantle which I don 't think was well worded a day when people were finding out their rates were going to go up, to say hey here is A guy that wants to destroy what just did that to you. Del. Eleanor Holmes Norton: I want to see a breakdown of who is getting Obamacare. That's what is missing here. Bonnie Erbe: You mean the 20 million new people. Del. Eleanor Holmes Norton: Who are already on it. Whether they're more democrats than Republicans. I would tend to think they're more democrats because they're younger people, people who didn't have healthcare. People who get it through Medicaid and in that case, their votes are probably baked in anyway. Bonnie Erbe: But as A pocketbook issue... Somebody can relate to my rates are going as the producer of this show told me, I hope she is not going to smack me after this, going from seven something a month to 1100 A month. This is unlike when you talk about, for example, federally subsidized child care where no numbers are thrown out to taxpayers about what that kind of penis is going to cost them so it's like you are either for it or against it but have you no idea what it is going to cost. This is very plainly costing a lot of people a lot of money. Will that turn off voters for Hillary? Del. Eleanor Holmes Norton: A lot of them of course are getting and we still don't know the amount of the subsidy they will get but that's in the equation, too. Remember most people get their healthcare through their employer, therefore these figures, bad as they are for those 20 million do not relate to the vast majority of the American people. So I don't think they're going to be voting since they are the majority or changing their votes since they're the majority especially since Obamacare has helped keep their premiums lower (all talking at once)

7 Bonnie Erbe: But let me just say Obamacare, whether you are on Obamacare or not, your health premiums are either going up or another thing that's happening is your deductibles are skyrocketing meaning your out of pocket costs, which would have been zero or $250 are now 7,000. Del. Eleanor Holmes Norton: You are talking about two different things. It is true that employers are sometimes raising deductibles. That is something you have to take up with your employer as opposed to what is happening with Obamacare which A very small slice of the American public as to whether or not that's going to change how the electorate looks at who it ought to vote for in November. Saba Ahmed: Obamacare has been disastrous for small businesses and employers... Bonnie Erbe: If you have 50 or fewer employers you are not covered by it. Saba Ahmed: Right. But even like small medium businesses, it really does hurt the employers premiums and all that but I think you know, Obamacare should have focused on health reform but it focused on health insurance which destroys the purpose because if you are just focusing on privatizing insurance, that's already available to the vast majority of the people. I think we should focus healthcare. Atima Omara: A couple key things are missing here. One I don't think it itself going to affect the overall vote because several ballots have been sent out. When you ask people on both sides of the aisle what is the its economy and terrorism and healthcare is lower on the list. We are missing a couple of key things. Obamacare insured A bunch of people who had been kept out of the system because of pre-existing people. People who are sick and need it are getting into the system. The penalties are high enough for people who want to opt out. The only way to work is if you get more people into the system and offset the premiums. Second you have the money losing plans that have, basically reduces competition urks so if you have one only insurer in the state they can drive up the costs all they want to. Ashe Schow: Right. So I just love this idea that okay, it's not working. We are not getting as much people so we are going to punish people more to force them. Saba Ahmed: They're not (All talking at once) According to the... Bonnie Erbe: One at a time. Ashe Schow: We are going raise the penalties to for these people into it because that's the only way it will work when you are forcing people that they can't really afford it, they don't really need it and the whole law was based around that whereas if they had taken some of the republican ideas maybe we would have not been in this situation. Atima Omara: We have a lot of the republican ideas which is why we are in this situation. I was simply also going to say we have more people who are in the sick who are in the system. That's making the premiums raise and the costs have been rising and this isn't A surprise. Bonnie Erbe: Let us know what you think. Please follow me on twitter@bonnieerbe. Behind the headlines: A new show about gender equality in the workplace is making waves. Good girls revolt, which

8 streams on Amazon video, is about a group of young female journalists in New York starting in 1969 who work for a major newsweekly. It's a retelling of a real-life claim against newsweek magazine filed with the equal employment opportunity commission in The women worked as "researchers", but were not considered "reporters," even though they did as much as or more work than the men to break and report stories. They did not have bylines nor did they earn as much money. The sixty female employees were represented by then-attorney Eleanor Holmes Norton. Bonnie Erbe: I just want to tell you, you are unbelievable. Your breadth of knowledge, the things you have accomplished in your life and what never cease to amaze me. How significant was this case in terms of women's advancement in the workplace and pay equity? Del. Eleanor Holmes Norton: Well, Bonnie, journalism was at its apex so all the bright young women wanted to be in journalism and you could be A phi beta cappa or A researcher but at that point I know of no major class-action that had been brought. Bonnie Erbe: The first class-action pay equity under title... Del. Eleanor Holmes Norton: Title 7 and I'm not there as chair of the commission, not even thought about and these women, one has to consider this. How much courage did it take to sue your boss at one of the great journalistic enterprises, owns "the Washington post," Catherine Graham as well as news week magazine. What is going to happen to you? You got a prize job. Most women couldn't get A job as A researcher. And now you want to be something more? That's why and the fun part of this is they talk about how we had to engage in consciousness raising but women were engaged in consciousness raising all across the United States at that point just about whether or not they were being discriminated against. When I became chair of the New York City commission on human rights I had to go to women's organizations and saying why aren't you filing complaints. So do understand that these women were on the cusp and we owe them much credit for what has happened to women not only in journalism but in the American workplace. Bonnie Erbe: And you as well for talking them into bringing the suit. You young ones, did you know about the dismays. Del. Eleanor Holmes Norton: I didn't but I'm going to thank Eleanor Holmes Norton for helping someone like me to do this but I also hope with this that people can look back and see this is where we were, look at how far we've come. And maybe get A little bit of perspective about maybe things are not as terrible in your life right now when it could have been this. Del. Eleanor Holmes Norton: Touche. Atima Omara: I was going to say like really impressed like A great mad men show that meets journalism with women actually doing something about it in the workplace instead of being upset about it. It's a great reminder of how far we've come and what more we can be doing to advance women in the workplace.

9 Bonnie Erbe: Do you think this will enlighten a lot of millennials who didn't know about the situation and just take, just to think all along that their rights are guaranteed and this is America and they're going to get equal pay. Saba Ahmed: It makes you appreciate definitely a lot more. And today these days when we hear about Megan Kelly asking for $20 million, it makes, you know, that couldn't have happened maybe 30 or 40 years ago but at least women are advancing in journalism and I'm glad to see women anchors in all different forms. Atima Omara: I think... I do think there are millennial women especially who move more into the workplace that definitely encounter some forms of discrimination whether it be negotiating pay or being still only one of the few women partners in their law firm but you know, it's A definite great retrospect on how far we've come and what more we can do to continue to advance women. Bonnie Erbe: I just want to say in closing congress woman that you, first of all, anybody who hasn't seen the video of you and the actors who plays you who looks so much like you, and you know, Steven Colbert had the two of you on the show together and the two of you boogied in, and anybody who hasn't seen that video on YouTube has to see it. Del. Eleanor Holmes Norton: Me and Colbert boogieing in. Bonnie Erbe: No you and the actress boogied in together and he came later. But I also want to say that you have been A regular panelist on this show for the whole 25 years of the exips of this show and you have added so much to it and I want to claim you in A way because Colbert may claim you or other places may claim you but we really claim you.
