2 ***Radio Broadcast Contract*** This broadcast agreement covers the period of. 1. Smooth Media Productions is an independent contractor buying airtime from Tidal Broadcast. By leasing airtime from this radio station and their affiliates. We ask support for broadcast costs A Promotions Package is providing. 2. Artist / Label must provide Program Producer a radio edit (clean version) song on compact disc or mp3 3. Artists do not select the date & time of interview, Artist / Label can select the date of material to air. 4. In no instance may any SMP Program Producer edited material for broadcast or for distribution by any reason. 5. Artist / Label may not re-broadcast program without the acknowledgement of Smooth Media Productions. The Artist / Label agree this broadcast does not constitute a sale of rights but is only a license to broadcast Artist / Label martial only. 6. The Artist / Label cannot use broadcast to directly sale or will not excerpt or make any other such use of "except for promotion thereof. 7. At any time SMP can rebroadcast your track on other station that are affiliate without your acknowledgement at no cost to you. 8. SMP is not licensed by ASCAP, BMI, SESAC, and Soundexchange. 9. Any responses we get from live listener call-ins or and all inquiries will be forwarded to the Artist / Label representative. 10. Artist / Label have the right to terminate this agreement with 72 hours of signing contract. NO REFUND if Artist / Label terminate contract. 11. Artist / Label will be notify immediately if broadcast has changes or discontinue therefore a REFUND can be made if SMP and Artist / Label can not reach an agreement. Hurry these rates are introductory-they won't last long!! This is unheard of in conventional radio, because they are governed by certain laws and major labels. However, the FCC DOES NOT govern internet radio; therefore this practice is totally legal in this arena.

3 BROADCAST TRACK RELEASE FORM I (We), Artist Name(s) and/or Copyright Owner(s) Grant permission to SMOOTH MEDIA PRODUCTIONS Broadcaster Name I agree to broadcast my material through Smooth Media Productions, the following songs over the Internet, on the air, via cable, or satellite, without payment to me (us) the Client, Soundexchange, BMI, SESAC, ASCAP, or any other performing rights organization of any royalties or other fees: List song(s) or the title(s) of entire recording(s): Name of Album Title Track and # This permission includes the right of the Program Producer to produce the ephemeral copies (these copies made for the specific purpose of air /internet broadcast) necessary to produce the broadcast. The above songs may not be made available to the public for download or other digital copying by any individual or entity to whom I have not granted written permission; and the material listed above will not be given, sold or otherwise licensed for pay by program without my express written permission. This means the songs listed above will not be used for any other purpose than broadcasting, and promotion of that broadcast. This agreement allows the broadcast of this material, while eliminating any external licensing requirements of RIAA, Soundexchange, BMI, SESAC, ASCAP, or any other performance rights organizations.
