5 DEF INITIONS Willamette Falls Media Center (WFMC) - A 501c3 non-profit digital media literacy center created to provide community members with the tools and training necessary to produce their own programs for the community public access channels. Cable Company The cable company is the service provider for in home viewing of the community channels. Cable casting - Programming and Community Bulletin Board Messages (exclusive of cablecast signals) carried on the cable television system utilizing Class II, III or IV cable channels as defined by Rule 76.5 (aa) (bb) and (cc) of the Federal Communications Commission. Public Access Cable casting - Service provided by WFMC public access channel users on a public access channel. Public Access Channel - A signaling path specifically designated by Cable Company on its cable television system for use by the general public, educational entities or groups, local government or leasee. Public Access User - Any person, group, organization or other entity, which makes proper application for, and is certified, to produce access television programs for cable casting over access channels. Advertising Material - Any cable casting material designed to promote the sale of commercial products, services, or a call to action. Lottery - Any promotion, contest or other presentation which involves directly, or indirectly, the elements of prize, chance or consideration which would be considered a lottery under applicable local, state or federal law. Obscene or indecent material - Any material in a program or presentation, which is defined as obscene or indecent under applicable local, state or federal law. Any material in a program or presentation, which is defined as obscene or indecent under applicable local, state or federal law. No program or presentation shall be produced at WFMC facilities, which involve any obscene or indecent material, or nudity. Indecency provisions of the Cable Communications Policy Act of 1984: Cable Communications Policy Act of (h) [532(h)] Executive Director - The person appointed by the WFMC Board of Directors to traffic, maintain, operate and supervise all Studio Staff, Volunteers, Equipment and Facilities. Staff - Designated person(s), which contribute, by mutual agreement of the Executive Director, to the operation of WFMC. Staff may be either WFMC employees or volunteers. Safe harbor A regionally agreed upon time in the CAN (cable access network) period of time in which rated material will be aired Foreign Programming - A program that is created elsewhere and submitted for telecast by a local resident is a locally sponsored program Jackson St. Oregon City, Or

6 COMMUNITY MEDIA: NON-COMMER CIAL, CONSTITUTIONALLY PR OTECTED SPEECH Non-Commercial Speech Advertising of any nature is not allowed on WFMC managed channels including: Promotion of the sale of any service, facility or production Price information Calls to action or inducement to buy For-profit business and individuals may not promote any service, facility, or product. Contact information is limited to sponsorship; additional commercial website addresses and phone numbers may not be used. A business or individual may not sponsor a program in which it appears. Exception: Government agencies and non-profit organizations may promote their services. (See What is Non-Commercial Television page 18) Constitutionally Protected Speech All speech and expression is constitutionally protected by the First Amendment of the United State Constitution except: Any material that is libelous, slanderous, or other defamation of character; or material that is an unlawful invasion of privacy; Any material that violates state or federal law relating to obscenity; Any material that violates local, state, or federal laws; Any unlawful use of copyrighted material. Non-Profit Organization An organization qualifies as non-profit if it is registered as a non-profit with the Oregon Secretary of State and/or has a current IRS 501c3 status and Letter of Determination. To qualify as local, the organization must operate an office in the eligible service area listed with the Oregon Secretary of State. Funding Access Programs: Sponsorship Producers are encouraged to seek funding for the production of PEG access programs. Any individual, business, or institution that helps defray production costs may be given sponsor credits. In general, sponsorship may provide identification to acknowledge the identity of the underwriter. Place credits at the opening, logical mid-breaks and/or ending of the program with a maximum of two credit sequences per half hour. Individual sponsor credit time may not exceed 15 seconds in length. Total credit time for all sponsors may not exceed 60 seconds per 30 minutes of program time. (See What is Non- Commercial Television page 18) Producers are encouraged to use the following audio and/or video credit format: The (following) (preceding) community program has been made possible in part by a grant from (name, address, phone number, , website information) Sponsor credits must name the donor in mission-statement terminology that is neither commercial nor promotional in language. Sponsor/donor credits may include: A logo or slogan that identifies but does not promote and is sized no larger than 25% of the screen; Location, phone number, address, or website; Value-neutral descriptions of a product line or service with no use of comparative or qualitative descriptions such as efficient, economical, dependable, dedicated, prompt, fair price, reliable and excellent. 7 OWNERSHIP, DISTR IBUTION AN D COPYR IGHT OF PROGR AMS PRODUCED IN PAR T OR IN WHOLE WITH PEG ACCESS EQUIPMEN T MANAGED BY WFMC Programs produced with PEG access equipment and facilities are non-commercial, televised on PEG access channels. Producers using PEG access equipment managed by WFMC are required to sign a license agreement that: 1. Specifies WFMC s implied licensing rights for unlimited playback of the program on PEG access channels managed by WFMC. 2. Producers are fully and solely responsible for their programs, and will sign a program contract in which a producer agrees to indemnify and hold harmless WFMC and all other named parties from claims, demands, damages or other liabilities. The Producer may register and establish a copyright at his or her discretion. Producers may retain full ownership and distribution rights to programs by using equipment not managed by WFMC. 3. Allows Producers to apply for a waiver for additional distribution. Acknowledgement of PEG Equipment/Facilities Use The producer using PEG access equipment to produce a program is required to include a legible credit no less than five seconds in length. The following information is the minimum requirement. This program was produced with PEG access equipment managed by WFMC. Payment for Labor or Production Costs/Charges to Third Parties A Producer may not charge third parties for use of access equipment, facilities or channels, but a producer may be paid by a third party for labor and/or production costs associated with a PEG access program provided that the access producer submits a Third Party Agreement to WFMC prior to receiving any payment for labor and/or production costs. Programs produced with PEG access equipment and/or facilities are intended for cablecast on the PEG access channels and may not be used for commercial purposes, Access equipment, facilities and channels are available at no cost, for use in the production for programs for PEG access channels. Potentially Objectionable Material Programs with potentially objectionable material will be telecast on the Community channels between the hours of 11 pm and 5 am Programs containing extreme violence or degradation and programs that would fit within the categories TV14 and TVMA of the TV Parental Guidelines published by the TV Parental Guidelines Monitoring Board (see or will be preceded by a message advising viewer discretion. (Please see pages 13 and 14.) TV14 includes one or more of the following: intense violence, intense sexual situations, strong coarse language, or intensely suggestive dialogue. TV14 as defined by the TV Parental Guidelines will be televised between the safe harbor hours of 12 am and 5 am. TVMA includes graphic violence, explicit sexual activity, or crude indecent language. TVMA (Mature Audience) as defined by the TV Parental Guidelines will be telecast between the safe harbor hours of 12 am and 5 am. Responsibility and Liability for Program Content At the time a completed program is submitted for scheduling, the Producer must submit a signed WFMC Cablecast Contract, which holds the Program Provider liable for program content. Furthermore, through the Program Contract, the Program Provider agrees in writing to fully indemnify and save harmless WFMC, its staff, Board of Directors, and the Cable Company from any and all claims, demands, damages, or other liabilities, including legal fees and expenses that may arise as a result of cablecasting the program. Program Providers will be required to list their name, initial acceptable for first name, in a program credit, not less than five seconds in length, displayed in a legible font Jackson St. Oregon City, Or

8 Non-Discrimination No person will be denied training, equipment, facilities, or channel time based on race, sex, age, physical disability, religious or political belief or affiliation, or the nature of their programming interest. Communications Regarding Services Right to Refuse Service WFMC staff reserve the right to refuse service to any person whose actions hinder the activities of other producers or the staff, and to ask the person to leave the facility. This denial of service may be appealed in writing to the WFMC Executive Director. Producer Dissatisfaction Producers may communicate any dissatisfaction with WFMC services in writing to the WFMC Executive Director. Community Responsibility: Sharing a Limited Resource PEG access resources are limited. WFMC will train groups and individuals to make efficient, effective use of production equipment and channels. Care for the equipment and respect for the rights and needs of others within a large user group are essential. Community groups and individuals are encouraged to use their own resources. If regular or extremely frequent production is planned, groups are encouraged to purchase their own equipment to facilitate their own production and avoid monopolizing a community resource. WFMC reserves the right to limit use of channel space by any group or individual to meet all community needs. User Fees WFMC may charge reasonable user fees (TBD) to eligible users for use of production facilities, equipment and services. WFMC shall separately negotiate user fees, programming schedules and schedules for use of production facilities with governments who are participants. Production Work on Behalf of, or Programming Submitted by Organizations For production work on behalf of, or programming submitted by an organization, the organization s leadership may be required to file on letterhead a written statement designating a Producer and authorizing the production work and program submission. Use of Resources by WFMC WFMC will reserve priority use of production equipment and channels: to conduct access education, production training and promotion; for WFMC production of educational and government access programs; and for WFMC production of promotional programs. WFMC will provide limited production of educational and government access programming, matching community needs to the amount of staff and resources available Jackson St. Oregon City, Or

9 ESTABLISHMEN T OF WFMC POLICIES AN D PROCEDUR ES These policies and procedures are intended to encourage maximum participation by eligible individuals and groups in a fair and equitable manner and is a continuous evolving document. As the organization grows and develops, amendments may be considered and implemented by the Executive Director at any time. Any changes made will be posted in the facility. WFMC services are available on a first come, non-discriminatory basis to any community member who resides, works, or attends school with the city limits of Oregon City, Milwaukie, Damascus, Wilsonville, or unincorporated Clackamas County. Proof of identity and service area qualification is required; post office boxes are not acceptable. A resident organization may designate a non-resident to be their producer to work on ONLY the organizations projects. All Program Providers must meet the eligibility requirements detailed below. WFMC certified eligible producers are allowed the use of production resources provided that: To become a certified producer, an individual must live in any of our service areas, work for a business or organization in any of our service areas, or be a student at an educational institution located in our service areas The individual is using the equipment for the sole purpose of producing PEG access programs which are fully consistent with the cablecast contract; The individual who operates the equipment has on file all requisite personal and certification information, and must successfully complete a production workshop conducted by WFMC; The producer uses their valid local street address on all contact. Use of a post office box is not acceptable. Proof of address is required; and The producer uses media within specifications established by WFMC. Statement of Non-Discrimination WFMC does not discriminate based on race, color, creed, national origin, gender, sexual preference, age, religious belief, social philosophy, political affiliation, economic status or physical ability. Age Policy If you are under the age of 18, you may have access to WFMC s facility and equipment with parent or legal guardian involvement. Interested minors and a parent or legal guardian must complete the application and must sign that they have reviewed and understand WFMC s Operating Policies and Procedures, and their accountability and expectations. After receiving the required consent, the minor will have the same rights and responsibilities as adult users. Training and Certification Applicants seeking to operate or use access studios or equipment will be required to complete a minimum of three training workshops. The WFMC Studio Specialist will determine if they are qualified and have the ability to operate appropriate equipment. Successful completion of training workshops will be required of all users to complete certification in operation of studio, port-a-pak and editing equipment within an organized training program. Workshops will also provide information on the organizational framework of community access television. Basic workshops are provided free of charge. Certified producers who have not been active for a one-year period may be required to schedule a refresher course with WFMC in order to review equipment and facilities. In the event that substantial changes have been made to the equipment inventory, producers may be required to complete a workshop or proficiency test Jackson St. Oregon City, Or

10 PROCEDURES FOR EQUIPMEN T USE Project Forms Producers are required to complete an access facility request form for any series or individual program prior to reserving equipment. Reservations Producers reserve facilities and equipment, and set appointments for checkouts with WFMC on a firstcome, first-served basis. Reservations may be made in person or by telephone. Reservations for individual programs may be made up to four weeks in advance. Reservations for series programs may be made up to 26 weeks in advance. A producer who is more than 15 minutes late in claiming any reservations forfeits the entire reservation unless an extension is authorized by staff. A producer is limited to the following number of uses per project per specified time period, including advance notice where applicable, unless otherwise authorized in advance by WFMC. Portable Equipment: Four uses per month, 24 hours per use. Editing Equipment: Two four-hour uses per week. Studio Equipment: One four-hour use per week Production Truck: According to guidelines (Pending availability). Additional equipment use is available on a stand-by basis or by completing a special request form in advance, according to guidelines. Portable Equipment Check-out Producers are required to arrive within 10 minutes of the appointed checkout time, present identification upon request, and complete and sign an equipment agreement. WFMC will inform the producer of check-in time. The producer is responsible for determining that the equipment is in working condition and the unit is complete at the time of the checkout. Any malfunctions or surface damage must be noted on the equipment agreement. The producer is fully responsible for the return of all of the equipment in an undamaged condition. Covering WFMC Labels Prohibited Producers may not cover WFMC labels or any information identifying equipment managed by WFMC. Covering WFMC labels is a major violation. Equipment Check-in The producer under the equipment agreement is responsible for the return, by the specified check-in time, all equipment in undamaged, working order. Until an equipment unit is checked-in by WFMC, that unit is unavailable for subsequent checkout. Use of Editing Equipment Producers with editing reservations are required to sign in at the facility and claim their reservation within 15 minutes of the scheduled starting time. Editors must vacate the editing system by the completion of their reserved time unless the following time is unreserved or the next editors have not claimed their reserved time. Editors are required to sign-out at the conclusion of the editing session. All editing reservations must be completed at least 15 minutes prior to closing time. Use of Studio Equipment Producers with studio reservations are required to sign in and claim their reservation within 15 minutes of the scheduled starting time. When finished, producers will be required to return all equipment to the correct location, to remove all set materials and props provided by the 1101 Jackson St. Oregon City, Or

11 producer and to leave the studio and control room in an orderly condition for the next producer. Producers are required to sign out at the completion of their reserved time. All studio use must be completed at least 15 minutes prior to closing time. A parent or legal guardian must be present at all times during a production by a certified minor. WFMC may post additional guidelines. Use of Production Truck Pending availability, WFMC will establish guidelines. Check-Out for Underage Producers Certified producers under 18 years of age must co-sign the equipment or facilities contract/licensing agreement with a parent or legal guardian whom accepts full responsibility for loss or damage of equipment on behalf of the minor. Equipment Failure Equipment failure may happen at any time. Producers are required to: discontinue use and report failure immediately to WFMC; or if failure occurs away from WFMC, to return equipment at the first available opportunity. ATTEMPTED MAINTENANCE MAY RESULT IN SEVERE INJURY, AND WILL RESULT IN LOSS OF PRIVILEGES, PLUS BILLING FOR ALL RELATED EQUIPMENT DAMAGE. Equipment that fails will be replaced when spare equipment is available; otherwise, WFMC will make on the spot repairs when possible. If a reservation is lost due to equipment failure outside the control of the producer, the producer may make a reservation for the next time that unit or comparable equipment is available. WFMC is not responsible for the cost of the production. Cancellations Producers are asked to cancel with early notification, to enable staff to assign the equipment to another producer. The producer is required to notify the staff of any cancellation of reserved equipment no later than 15 minutes after starting time. Failure to cancel more than 10% of the time within a six-month period will be a minor violation. Late Returns Producers unable to check-in equipment at the scheduled check-in time are required to call WFMC prior to the scheduled return time. If the equipment is reserved and an extension cannot be granted, the producer s late return is considered a violation. Production Schedules WFMC may require a written production schedule. For producers using substantial amounts of access equipment and facilities without submitting a resulting program, failure to meet the schedule will result in a minor violation. Copying Programs and Unedited Footage with PEG Equipment WFMC will copy programs scheduled on channel 23 upon request after receiving, if necessary, the consent of the producer. The community member requesting the copy will be required to pay the posted dub fee. Program copies will not be released prior to first program telecast. Abandoned Projects In order to abandon a project, the producer must meet with staff. To maintain eligibility, producers who abandon projects, must erase source footage and are prohibited from using source footage or copies for any other purpose. 12 LIABILITY RESULTIN G FR OM EQUIPMENT AND FACILITY USE Producer Liability A producer signing an equipment agreement or a facility agreement agrees to fully indemnify, save and hold harmless WFMC and the Cable Company against claims, losses, costs and expenses arising out of damages or injuries to persons or property resulting from the use of the equipment. Violations Violations of facility and equipment use will be assessed by the Executive Director and privileges may be revoked as a result. Equipment Damage/Loss and Subsequent Loss of Privileges A producer who suffers equipment damage or loss while under contract is liable to fully compensate WFMC for replacement costs as determined by the Executive Director for all damages or losses that occur while the equipment agreement is in effect. In the event WFMC equipment insurance is all-risk, producers will be required to pursue organizational or personal insurance before submitting claim information to WFMC. The producer will have equipment privileges suspended until full compensation is made, or until an installment payment contract is signed with WFMC. Installment plan guidelines will be established by WFMC staff with a term not to exceed one year in duration. In the event the producer fails to meet the terms of repayment, the producer will be suspended from all equipment privileges and the case will be submitted to the appropriate authorities for resolution, which may include litigation. SERIES FACILITY SCHEDULING Producers with series programs may also apply for series studio and editing time. The applications and series cycle process will conform to the series program processes. Studio time will be approved according to the production requirements of the program. Additional time remains available on a first-come, first-served basis. ADDITIONAL FACILITY USE PR OVISIONS WFMC/PEG access facilities, including the hallways and restroom areas, are available solely for PEG access activities. Office supplies and equipment located at the PEG access facilities are not available for use by producers, certified crew, guests or the general public. While in PEG access facilities, producers may receive brief telephone calls related only to PEG access productions and services. Producers and any persons using PEG access services, equipment or facilities are responsible for the conduct of their guests. Smoking, alcohol, and controlled substances are not permitted in access facilities, including the truck. Food and drink, with the exception of capped, bottled water stored on the floor are not allowed in any area with production equipment. Food and drink are permitted in the kitchen area only. CHANNELS Resources PEG access Channels 23 and 11 are made available to all eligible program providers. Eligibility for Channel Use PEG access channels are available to any service area resident or resident organization that have participating cable service registered with the Oregon Secretary of State, within the Clackamas County 1101 Jackson St. Oregon City, Or

13 limits, on a first-come, first-served basis. PEG access channels are available without charge to service area residents whose local governments participate. Responsibility and Liability for Program Content At the time a completed program is submitted for scheduling, the program provider must submit a signed WFMC cablecast request, which holds the Program Provider liable for program content. Technical Standards and Production Requirements Programs must conform to WFMC technical standards and production requirements, which are: mpeg Mb/s variable bit rate or 3-8Mb/x constant 44.1khz or 48khz 192kb/s or 224kb/s Scheduling Programs Completed programs are submitted at WFMC. Program providers may request specific telecast times, and staff will match channel space with requested times whenever possible, according to posted guidelines. Programs are scheduled a minimum of three weeks ahead of telecast for the purpose of channel listings. Original Programs To qualify as original, a program must have a minimum of 51% new video and 51% new audio. Scheduling Priorities In scheduling programs on WFMC managed channels, first priority is given to locally produced programs. Second priority is given to programs produced elsewhere but sponsored locally. Local programs are defined by the producer s residence, and the program s content. To be locally produced at least 51% of the program video and 51% of the program audio must be produced by a WFMC certified producer or certified representative of an organization that is either in or outside the service area. A program that is created elsewhere and submitted for telecast by a local resident is a locally sponsored program or otherwise known as, a foreign program. Foreign programing will not be played on the CAN channel. Programs created by local producers that have aired at other media centers in the CAN network will not be eligible for playback during WFMC designated CAN times. A local resident or resident organization may sponsor no more than one non-local series. A locally sponsored series program may be sponsored as no more than one series on WFMC-managed channels. Adding local credits or opening and closing tags to a locally sponsored program does not qualify the program as a locally produced program. WFMC reserves the right to preempt programs for live or special event telecasts. Program providers with additional needs may submit a special request form in advance, according to guidelines. Community Billboard is a service provided both to and for the community; therefore, WFMC will ensure that adequate billboard time will be provided on the channels to meet the needs of the community. Satellite programs require a special request. The local sponsor must provide written clearance from the authorized distributor for carriage of the programming on a non-commercial channel on a pre-emptible basis. Series Programs Channel space is available first-come, first-served basis. A program provider may apply for a series time slot after three programs are submitted for telecast in compliance with the provisions outlined in the cablecast request. A series Program Provider who meets the requirements will be granted a time slot for one year, with renewal available on an annual basis Jackson St. Oregon City, Or

14 WFMC may schedule blocks of time for educational and government access, and for promotional programs, separate from the series application procedure, taking into account the requirements of live programming and community needs in general. Losing a Series A producer may lose a series time slot by failing to maintain a current cablecast request; failing to submit programs according to schedule; or committing an abandoned program violation. To reestablish a series, the producer must attain good standing and apply first-come, first-served for a series time slot. Program Delivery Submitting a Program Programs must be delivered to WFMC and must meet the technical standards and be accompanied by a completed cablecast request and digital media submission form signed by the Program Provider. Series program providers are only required to submit one cablecast request for an ongoing series. Single programs submissions require a cablecast request for each program submitted. The Program Provider is responsible for timing the program and providing production-related data. Programs are to be delivered three weeks prior to telecast unless otherwise authorized in advance by the WFMC Program Coordinator. POTENTIALLY OBJECTIONABLE MATER IAL: VIEWER ADVISOR Y AN D AUDIENCE SEN SITIVE SCHEDULING The purpose of this section is to enable parents or guardians to supervise the programming available to children, and to assist viewers of PEG access programming in making informed decisions while providing an opportunity for all lawful forms of expression without censorship and in accord with existing laws. Programs containing extreme violence or degradation and programs that would fit within the categories TV14 and TVMA of the TV Parental Guidelines published by the TV Parental Guidelines Monitoring Board (see or will be televised on the Access Channel preceded by a message advising viewer discretion. TV14: Program providers will warrant that programs containing objectionable material that would cause it to be rated TV14 in accordance with the TV Parental Guidelines of the TV Parental Guidelines Board including one or more of the following: intense violence, intense sexual situations, strong coarse language, or intensely suggestive dialogue are scheduled on the Access channel between the hours of 12 am and 5 am. Program providers will identify the program as TV14 on the program contract and will include a 15 second, easily readable viewer advisory immediately prior to the beginning of the program, stating: Viewer Advisory: The following program, identified as TV14, contains material which some viewers may find objectionable or inappropriate for children. Program Providers must use the viewer advisory provided by WFMC without alteration. TVMA: Program providers will schedule a program that contains any material that would cause it to be rated TVMA in accordance with the TV Parental Guidelines of the TV parental Guidelines Board including: graphic violence, explicit sexual activity, or crude indecent language on the Access channel between the hours of 12:00 am and 5:00 am. Program providers will identify the program as TVMA on the program contract, and will provide a 15 second, easily readable viewer advisory immediately prior to the beginning of the program, stating: Viewer Advisory: The following program, identified as TVMA, is for mature audiences only, may be unsuitable for children under the age of 17 and contains material which some viewers may find objectionable. Program providers must use the viewer advisory provided by WFMC without alteration. Extreme Violence or Degradation: Programs identified as containing extreme violence or degradation is scheduled on the Access channel between the hours of 12 am and 5 am. 15 identify the program as containing EXTREME VIOLENCE OR DEGRADATION on the program contract and will include a 15 second, easily readable viewer advisory immediately prior to the beginning of the program, stating: Viewer Advisory: The following program, identified as containing extreme violence or degradation, contains material which some viewers may find objectionable or inappropriate for children. Program providers must use the viewer advisory provided by WFMC without alteration. A Program Provider who fails to provide such notification and advisory shall be subject to disciplinary action as a major violation of WFMC s Rules. It is a violation of WFMC policy to submit for telecast programming that is obscene or otherwise unlawful. Programs that are obscene may not be submitted for telecast. In addition to any sanctions that may be imposed under federal, state, or local laws, a program provider who submits programming that is determined to be obscene shall be subject to disciplinary action as a major violation of WFMC s Rules. Obscene material as determined by the courts is material which: (a) to the average person, applying contemporary community standards, taken as a whole, appeals to the prurient interest, (b) depicts or describes sexual conduct in a patently offensive way, and (c) taken as a whole, lacks serious literary, artistic, political, or scientific value. Program Copies WFMC has the right to make copies of programs for WFMC use. A producer may prohibit WFMC from making copies for sale. PROMOTION AN D CREDITS Program credits are selected by the Program Provider with the following limitations: Willamette Falls Media Center (WFMC), its staff and Board of Directors, and the Cable Company may not be listed as producer or co-producer of the program, and addresses and telephone numbers of the aforementioned may not be used in the credits or as contacts for the PEG access Program Provider, unless the aforementioned is the program producer or unless grants required such credit listing. The Program Provider may not list private phone numbers or addresses without the prior written consent of the individual. Producer individually and if applicable, on behalf of all members of the organization of which producer is a member hereby releases WFMC studio and its successors and assigns, including without limiting the generality of the foregoing any mistakes, omissions, or interruptions in the cablecast. Producer agrees to comply with the requirements applicable to Public Access Channels set forth in the operating rules of WFMC studio. Producer warrants and represents that the program does not contain: Any solicitation of funds or advertising of material designed to promote the sale of commercial products or services. Any material that is obscene, indecent or an invasion of privacy. Any material concerning lottery information, gift enterprise, or similar scheme. Any material requiring union residual or other payment including but not limited to talent and crew unless those payments have been executed or waived. Any material that is slanderous, libelous, and mad unlawful by any law instituted by a governmental body. Any material that is copyrighted or subject to ownership or royalty rights without necessary releases, or other permission. If any material included in the program is copyrighted or subject to ownership or royalty rights, union residuals, or other payment, producer will obtain all necessary payments to authorize cable casting of any such material. Producer releases WFMC, its directors and officers, agents, and employees form all liability, if the program is damaged, lost, or stolen while in their custody. This liability and indemnification extends to programs and program material producer submits to WFMC for cablecast, whether or not such material is produced in whole or in part by the use of WFMC Studio facilities. All tapes submitted must have at least 10 seconds of black prior to the beginning and at least one minute of WFMC logo at the end of the program. A series must be renewed after 13 weeks and is subject to new playback times upon renewal. The program tape submitted for cablecast becomes part of the WFMC library. The producer relinquishes control of the tape at the time. All personal copies of the program must be made before the program is submitted. After all scheduled plays are complete, WFMC may recycle the program tape without notice (unless otherwise requested and agreed upon). 20 What is Non-Commercial Television? This means: Not showing a product in a store, in its commercial packaging, or using posters that promote sales of a product or service including CD s, tapes, or books. Not discussing where the viewer might find the product Instead of asking an artist at which commercial venue they will be performing use a for more information phone number, website, or address but remember these informational items are to be treated the same as sponsorship credits see below. If your guest unexpectedly announces performance information at a commercial venue, the audio will have to be edited out. Not prominently displaying business names on the TV screen or to identify program location, including store fronts, except if the name is incidental to the background. Incidental means; The name is no larger than 10% of the screen (see diagram) You can t get the shot any other way If you can frame out the name, you must do so. Exceptions: Non-profit organizations and government agencies may promote their services. Exception: Political candidates registered for election may solicit funds to be sent to a campaign For every 30 minutes of program time: Up to 60 seconds of sponsorship credits are permitted, with no more than 15 seconds per sponsor. Sponsor logos may be used, sized no larger than 25% of the screen.
