1 Your News Information Kit For information and forms to submit your video please go to the Your News website at: What is Your News? Your News is a national video call for news stories about where you live, your family, school and community. We want you to tell us about the interesting places, events or issues in you local area and/or introduce us to the people in your life. News stories can be between thirty seconds and three minutes in length. If your video is selected it will be published on the Behind the News website and may even be shown on the television program, which screens on ABC and on ABC2, the ABC s free-to-air digital channel. This is not a competition. Entry is free and we are accepting videos from anyone. How you tell your story is up to you. What you need to do Exercise your imagination. Shoot and edit your news story and complete the submission forms. Tell us what is exciting or interesting about your life and where you live. What are the strange and unusual places in your community? Who are the characters and people? 4 Terms and Conditions 1. This is not a competition. Videos will be accepted from anyone. Entry is open to all Australian residents. The parent or guardian consent section below must be completed for any entrant under 18 years old. 2. Entry is free. Entrants must be an individual and not a company or organisation (with the exception of schools). Please note, no matter how many people contributed to the making of a video, the person identified in the submission form is the only personl who will credited (with the exception of schools where the school and class [if applicable] will be credited). Individuals may submit more than one video; each video must be accompanied by a separate submission form. 3. To submit your video, entrants must: a. shoot and edit a video (hereinafter called the Entry ): i. which is a minimum of 30 seconds and a maximum of 3 minutes duration (including titles and credits); ii. containing only original music compositions and performances and copyright cleared music; iii. that has editing and all audio post-production complete (including any voice-over or music); iv. delivered on Mini-DV or DV-CAM, SP, SX or Digital Betacam format or as an uncompressed QUICKTIME movie on DVD with the desired aspect ratio of 16:9; b. submit to the ABC a copy of the Submission Form with the video. Other forms such as the Music Cue Sheet, Music Release forms (individual and group) and/or Participant Release form may also be required (see Rules for Submitting) 4. The Submission Form, the Music Cue Sheet, Participant Release form and Music Release forms are available at 5. Entries must be submitted to Your News, Behind the News, GPO Box 9994, Adelaide SA 5001 or delivered to the main reception desk at ABC Adelaide, 85 North East Road, Collinswood, SA, 5081 clearly marked Your News, Behind the News. 6. ABC may, at its absolute discretion, select any eligible Entry to be published on the Behind the News website and may be shown on Behind the News television program. 7. All Entries become the property of the ABC and will not be returned to the entrants. As a condition of entry: a. each entrant makes the following guarantee to the ABC: i. all details provided with the entry are true and accurate; ii. the Entry has not been viewed by the public or made available to the public, either in Australia or internationally prior to entering this competition; iii. the Entry is the entrant s own original creation and that it does not infringe on any right (including copyright and consents by performers) of any person; iv. the entrant has obtained release forms from all participants (using the Participant Release form) and will keep a record of these. Furthermore, any release forms of participants under the age of 18 must be accompanied by a signed parental or guardian consent form. v. the entrant has the right to allow the ABC and the ABC is entitled to exploit the Entry in the manner outlined in these terms and conditions; vi. the entrant has not given any rights to the Entry to anyone prior to entering this competition; and the entrant agrees to indemnify the ABC against any loss or damage resulting from any breach of these guarantees; b. Each entrant gives to the ABC an irrevocable, perpetual, royalty-free, non-exclusive, sub-licensable right and licence: i. to use, copy, distribute, communicate, broadcast, modify, edit, adapt, segment and otherwise exploit the Entry for any purpose in any media (now known or later developed) worldwide without further notice; ii. to produce and distribute ancillary products and services relating to the Entry, including but without limitation, dvds, videos, CDs, books, merchandise and other products and services without notice. The ABC will negotiate a fee in good faith should the ABC receive a revenue stream from any ancillary use of the Entry; and iii. each entrant grants to the ABC the right to use the name and likeness of the entrant for publicity purposes. 8 Submissions are made at the entrant s own expense and the ABC shall not be liable to reimburse any expenses incurred in making an entry. 10. If there is any event which prevents or hinders the ABC s conduct of this project or the ABC s ability to deliver the services related to the project, the ABC may, at its discretion cancel this project and recommence it at another time under the same or different conditions.

The same Musical Work may be used several times throughout the Production and must be shown separately each time and in the same order as it was used. MUST BE FILLED IN Writer(s) Names The Composers and Lyricists of the Musical Work. When there is more than one, separate with forward slashes /. Enter names as surname space initial. Eg. Jones A. MUST BE FILLED IN Publisher(s) Names The Publisher of the Musical Work. When there is more than one, separate with forward slashes /. MUST BE FILLED IN IF THERE IS A PUBLISHER Performer Names The name of the Artist or Band performing this version of the Musical Work. OPTIONAL Record Label The label of the Record from which this Work was copied. I warrant that there are no restrictions that prevent me from undertaking the performance and agreeing to these terms, and that the consent of no other person is required to enable the Video Entrant to make and exploit the Recording. I grant the Video Entrant a non-exclusive royalty free licence to use and sub-license the use of the Works in all media throughout the world in perpetuity in or in association with the video entry (in whole or part thereof). I warrant that I am the Group s authorised representative, that I have the consent of the parent / legal guardian of each Group member under 18 years old and that I have the power and authority to bind the Group. I warrant that there are no restrictions that prevent the Group from undertaking the performance or any restrictions that prevent me from agreeing to these terms, and that the consent of no other person is required to enable the Video Entrant to make and exploit the Recording. I release and indemnify the Video Entrant, his/ her assignees, and licensees from and against any claims arising from any breach of this warranty and the exercise of the rights granted herein. Where the Participant is under 18 years of age, the Parent/Legal Guardian authorises the Video Entrant and the ABC to use and authorise the use of my child s name, likeness, voice and biographical material in connection with any use of the Recording. I warrant that there are no restrictions that prevent me from participating and agreeing to these terms, and that the consent of no other person is required to enable the Video Entrant or the ABC to make and exploit the Recording. I release and indemnify the Video Entrant and the ABC, its assignees, and licensees from and against any claims arising from any breach of this warranty and the exercise of the rights granted herein. Where the Participant is under 18 years of age, the Parent/Legal Guardian warrant that there are no restrictions that prevent my child from participating or any restrictions that prevent me from agreeing to these terms, and that the consent of no other person is required to enable the Video Entrant or the ABC to make and exploit the Recording. I release and indemnify the Video Entrant and the ABC, its assignees, and licensees from and against any claims arising from any breach of this warranty and the exercise of the rights granted herein.
