FOREWORD The Zambia Information and Communications Authority (ZICTA) under mandate by the Information and Communication Technologies (ICT) Act No. 15 of 2009 hereby issues these Guidelines on Type Approval of Radio and Telecommunications Terminal Equipment (RTTE), to regulate the approval all RTTE that are used in Zambia; ensure that all RTTE comply with the applicable technical standards in Zambia; and protect the integrity of Networks and general welfare of the citizens of Zambia. 1 INTRODUCTION 1.1 Background These Type Approval Guidelines covering all types of Radio and Telecommunication Terminal Equipment (RTTE) are issued by the Zambia Information and Communications Technology Authority (ZICTA) in line with Type Approval Policy as well as Statutory Instrument (SI) NO. 6 of 2011 (Type Approval Regulations) and SI No. 65 of 2011 (Registration of Electronic Communication Apparatus Regulations) under the ICT Act no. 15 of 2009. 1.2 Scope of Type Approval Guidelines The Type Approval Guidelines cover all types of Radio Equipment and Telecommunications Terminal Equipment. RTTE telecommunications equipment which is imported and that which is manufactured or assembled in Zambia and NOT on the list of approved equipment or on the list of ed equipment or on the list of prohibited equipment which can be accessed on our website page www.zicta.zm. The list of approved, ed and prohibited equipment will regularly be updated on the website. Appendix 1 lists RTTE ed from Type Approval and appendix 2 the list of RTTE prohibited in Zambia. 2 DEFINITIONS in these guidelines, unless the context otherwise requires; Applicant means a person who lodges in an application for type approval including Local and international manufacturers, Authorized Dealers, Licensed Operators, Companies or individuals Deal means Manufacture, Import for sale, demonstrating transmission, letting for hire sale or offering or possessing for sale, any equipment that is capable of being used for providing electronic communication service Dealer means A person who Manufactures, Imports for sale, demonstrates transmits, lets for hire sale or offers or possesses for sale, any equipment that is capable of being used for providing electronic communication service Type Approval means the process by which RTTE is authorized by ZICTA to be used in Zambia, and involves verification of the equipment s compliance with the applicable standards and requirements. Radio Equipment and Telecommunications Terminal Equipment (RTTE): means both the Radio Communications Equipment and the Telecommunications Terminal Equipment (or electronic communications apparatus) Technical Construction File (TCF): means a file describing an apparatus and providing information and explanations as to how the essential requirements applicable to the apparatus are met. 3 TYPE APPROVAL OF RTTE ZICTA Shall approve RTTE on the basis of the make and model. Once RTTE is typeapproved, the same model of equipment can be imported, subject to import permission, by any eligible Dealers without having to apply for another Type Approval. ZICTA has on its website a Type Approval Register containing the models of RTTE that are approved. 4 APPLYING FOR TYPE APPROVAL An Applicant shall follow one of the application processes, namely: a) Type Acceptance Process b) Type Approval process c) Modification 4.1 Type Acceptance Process a) The Type Acceptance process has to be followed in the case that the RTTE has already obtained suitable evidence either from a National Regulatory Authority (NRA) or a Conformity Assessment Body (CAB) that has signed a Mutual Recognition Agreement (MRA) 1 with ZICTA showing that the considered RTTE complies with the relevant standards recognized by ZICTA as provided in Appendix 3( Type Approval Standards). b) An Application for Type Acceptance must be made using the prescribed application Form I (Appendix 4: Type Approval Application Form I) and Form IC (Appendix 5: Type Acceptance Application Form IC) for the Type Acceptance. c) A separate application form IC must be completed, signed and stamped by the applicant for each model of equipment. d) An application for Type Acceptance must be accompanied by the following supporting documentation: i. A duly signed Certificate of Compliance from either a National Regulatory Authority recognized by ZICTA or a Conformity Assessment Body holding a Mutual Recognition Agreement (MRA) with ZICTA. ii. Payment of a non-refundable fee as prescribed by the schedule of fees (Appendix 7: Type Approval Schedule of Fees). Details about the acceptable payment methods and proof of payments are also included. iii. Full name and mailing address of manufacturer of a device and applicant iv. A copy of installation and operating instructions to be furnished to the user v. A detailed technical or operational documentation and vi. Any other additional information that is deemed necessary by ZICTA. 1 ZICTA does not have any Mutual Recognition agreement with any National Regulatory Body. e) A successful outcome of the assessment of the application for Type Approval will not result in issuance of a Type Approval Certificate in the name of the applicant, but rather in the recording of a corresponding entry of the RTTE in the Type Approval Register. A certificate which will be for that specific RTTE will be available in a printable format on ZICTA s website and will reflect details of the original applicant. f) ZICTA reserves the right to reject the application in the case where ZICTA is not satisfied in respect to any aspect of the application. The Applicant may, however, address the noncompliance and submit a new application for Type Approval when appropriate. In case of rejection, the Type Approval Fee will not be reimbursed. 4.2 Type Approval Procedure a) The Type Approval process has to be followed in instances where there is no evidence in the form of a Certificate of Compliance certifying that the RTTE complies with the standards recognized by ZICTA. b) The evidence of compliance of the RTTE under the Type Approval process must be based on, but not limited to, duly signed and dated Test Reports issued by accredited Test Laboratories demonstrating that the RTTE complies with the appropriate technical standards, as described in appendix 3 c) ZICTA will accept test reports from any accredited Test Laboratory included in the list of accredited Testing Laboratories recognized by ZICTA listed in appendix 3. d) An Application for Type Approval must be made using the prescribed application Form I (Appendix 4: Type Approval Application Form I) and Form IB (Appendix 6: Type Approval Application Form IB). e) A separate application form must be completed, signed and stamped by the applicant for each model of equipment. f) An application for the Type Approval must be accompanied by the following supporting documentation: g) A successful outcome of the assessment of the application for Type Approval will not result in issuance of a Type Approval Certificate in the name of the applicant, but rather in the recording of a corresponding entry of the RTTE in the Type Approval Register. The evidence is submitted as a Technical Construction File (TCF) (Appendix 8: Technical Construction File), and must include all supporting documents set out therein. ii. Payment of the non-refundable fee as prescribed by the schedule of fees (Appendix 7: iii. Type Approval Schedule of Fees). Details about the acceptable payment methods and proof of payment are also included. ZICTA reserves the rights to require up to two sample units of the RTTE along with the appropriate test accessories for testing at a laboratory assigned by ZICTA. The applicant will bear all the cost relating to laboratory testing. Type Approval Guidelines July 2015 Page 7

compliance and submit a new application for Type Approval where appropriate. In case of rejection, the Type Approval Fee will not be reimbursed. 4.3 Modification Procedure i) A person may apply for modification of RTTE. Modification will apply to RTTE that is already type approved using the type approval procedure that has undergone modification that changes its electrical characteristics. 5 LABELLING REQUIREMENTS Labelling is the process of affixing a mark and a specified Type Approval number on the Type Approved RTTE which is made or imported into the Zambian market, indicating its compliance with technical standards and requirements for the purpose of improving consumer confidence in electronic communications products and services in Zambia. a) All Type Approved RTTE must have a legible label permanently affixed on the outside of such equipment, bearing: i. The corresponding marking from the country or region where the original Type Approval had been obtained in the event that the RTTE in question has been approved using the Type Acceptance process. ii. The label approved by ZICTA as shown in (7) below of these Guidelines in the event where the RTTE in question has been approved using the Type Approval process. b) Any other marking may be affixed to the RTTE provided that the visibility and legibility of the prescribed marking (per paragraph (a) and (b) above) is not thereby reduced. c) Where it is shown that a label permanently affixed on the outside of the RTTE is not desirable or is not feasible, an alternative method of displaying the required label may be used if approved by ZICTA in writing. The proposed alternative method of labelling and the justification for its use must accompany the applied application for the Type Approval of the concerned RTTE. d) The label may also be affixed on the packaging and/or in the user manual, but it is not mandatory in these places, unless for reasons of size or other design features the RTTE itself cannot be marked, in these cases the applicant must include the label in the user documentation accompanying the RTTE before it is displayed or offered for sale. e) The label must be affixed before the RTTE is made available on the Zambian market. f) The label shall be affixed under the responsibility of the manufacturer, his authorized representative in Zambia, or the party responsible for placing the RTTE on the Zambian market. g) The responsible party shall be guilty of an offence if he or she fails to comply with these requirements. h) ZICTA reserves the right to take appropriate action against the responsible party who has affixed a marking found not to be in conformity with these requirements. Where ZMB/ZICTA/TA/YYYY/MM/SS appears shall be substituted the registration type approval certificate number allocated by ZICTA to the concerned equipment model. a) Application for Type Approval can be delivered to ZICTA in the following ways: i. Using the on-line portal ii. By hand at ZICTA offices in (Stand Number 4909 Corner of Independence & United Nations Avenues Lusaka - Zambia) during normal office hours. The documentation must be contained in a single package/envelope and addressed to (Manager Standards & Type Approvals, Technology & Engineering Department) iii. Sent via normal mail to ZICTA mail box (36871) iv. Sent via e-mail to the following address: (approvals@zicta.zm) b) In case the application is sent electronically, the files must be in non-editable but printable formats, such as PDF or JPG.
