Annexure I TERMS AND CONDITIONS FOR AWARD OF CONTRACT FOR SUPPLY OF EQUIPMENT TO DIRECTORATE GENERAL FACTORY ADVICE SERVICE AND LABOUR INSTITUTES (DGFASLI) AND ITS FIELD OFFICES Address for Communication: Shri Subhash chandra Director (safety) & I/c EED, Central Labour Institute Occupational Safety and Health Bhavan, N.S. Mankikar Marg, Sion, Mumbai 400 022 1. The Quotations should be a reputed supplier/manufacturer having sufficient experience and expertise in the relevant field and also having sound financial standing. Copies of certificates proving company s registration, tax registration, previous experience, authorized service provider-ship, etc. should be enclosed with the quotation. 2. The selected firm will be required to deliver/install the items/instruments in the Environmental Engineering Division of Central Labour Institute, Mumbai. 3. Order for items will be placed on requirement basis. Bills in respect of items supplied by the selected firm should be sent later. Payment will be released only after it is ensured that the quantity and quality of items supplied are as per the specifications prescribed and wherever applicable after satisfactory installation/functioning of the equipment and also ensuring maintenance after sales / supply. 4. Any item which is found to be defective, or not of the desired quality, etc. shall be returned by this Office and the order placed therefore shall stand cancelled. 5. This Office will have the authority to cancel any order, if the required items are not supplied on time. 6. Government Taxes as applicable from time to time on such supplies, shall be payable by this Office. The bill raised by the firm should have all tax registration numbers printed on the bill. Validity of the tax registration during the currency of contract shall be the sole responsibility of the firm. 7. Taxes as applicable will be deducted from each bill. 8. Details, regarding quality, brand, specification, etc. have been given against the item in the product specifications. Rates should strictly be quoted accordingly. Items where brand has not been indicated rates should be quoted for good quality product. 9. No separate charges shall be paid for delivery of goods. 10. The rates quoted by the selected firm, and approved by this Office shall remain valid throughout the period of contract and requests to increase the rates for any item(s), during the currency of the contract, shall not be considered. 11. It will also be binding upon the selected firm to maintain such qualities, if indicated in the quotations. 12. Selection of a firm for award of contract/supply order will not be made solely on the basis of lowest rates quoted by a supplier. 13. Successful bidder awarded the contract/supply order will have to furnish Performance Security for an amount equivalent to 10% of the estimated value of the contract/supply order in the form of FDR or Bank Guarantee valid for a period of 60
days beyond the date of completion of all contractual obligations of the supplier including warranty obligations. 14. Suppliers /Manufactures may please note that payments will be made within 21 days after the goods are supplied or services rendered. No request for advance payment or payment against delivery will be entertained. The bill in triplicate shall be submitted to the Director (S) & In-charge Environmental Engineering Division of Central Labour Institute, Mumbai, after supplying the equipment. 15. The office will have the right to reject all of the quotations without assigning any reason thereof. 16. All terms and conditions stipulated for award of the contract will be considered for selection of a firm(s). 17. This Office will have the authority to select more than one firm for award of contract. This office further reserves the right to decide whether a firm should be selected for supply of item listed in the quotations. 18. If the selected firm expresses its inability to supply the item(s) or fails to supply the item(s) at the quoted rates, thus failing in fulfilling the stipulated terms and conditions for award of the contract, then the contract surety amount is liable to be forfeited in part or in toto. 19. The quotations should enclose a signed copy of the terms and conditions stipulated for award of the contract, conveying his acceptance of the same. 20. For each Scientific Instrument/Equipment, the offer should be submitted with technical Specifications along with the price in the envelope. Any enquiry after submission of the quotation will not be entertained. 27. For any dispute arising out of quotation related issues the Court of Jurisdiction would be Mumbai. 28. The supplier / manufacture should clearly certify that he has gone through the above terms and conditions and accept the same in toto. 29.
