1 ARICH SYPRASERT, 2 called as a witness herein, being by 3 me first duly sworn, was examined and 4 testified as is hereinafter set forth. 5 -ooo- 6 11:02 A.M. VISALIA, CA 7 EXAMINATION BY MR. KNAPP 8 Q. Good morning. Could you please state your 9 full name for the record? 10 A. My name's Arich Syprasert. 11 Q. As you know, we're here today for your 12 Examination Under Oath pursuant to a claim with Truck 13 Insurance Exchange in relation to a fire loss at a 14 business with a reported date of loss of September 22, 15 2009, which the insurance company assigned claim number 16 1014746149. Do you understand that? 17 A. Yes, sir. 18 Q. The reporter who's sitting to your right has 19 placed you under oath, which obligates you to tell the 20 truth to the best of your ability and carries with it 21 the penalty of perjury. 22 A. Yes, sir. 23 Q. Do you have any questions about your 24 obligation to give truthful and accurate testimony 25 today? 8

1 A. I don't have nothing. 2 Q. Great. Because you're giving testimony under 3 oath, it's important you make sure you understand the 4 questions before responding. 5 A. Yes, sir. 6 Q. So if you feel a question is not clear or need 7 some further explanation, just tell me, I'll be glad to 8 either restate it or rephrase it. 9 A. Sure. 10 Q. Don't take offense. I ask everyone the same 11 question. 12 Are you aware of any conditions today, such as 13 being under the influence of drugs or alcohol, that 14 would not allow you to give truthful or accurate 15 testimony? 16 A. Nothing at all. Only drink water. 17 Q. Good. Water's good for you. 18 Also, you were notified that you could have an 19 attorney here if you wanted to, it had to be your own 20 choice and your own expense, and I see you're not 21 represented today. Do you want to proceed today? 22 A. No, I don't have anyone. 23 Q. Do you want to proceed without an attorney? 24 A. No. 25 Q. You don't want to proceed without an attorney? 9

1 A. Sorry, I don't understand. You want me -- 2 someone to help me? 3 Q. I'm glad you asked. We notified you you could 4 have an attorney here if you want to. 5 A. Yes, sir. 6 Q. And you don't have one. 7 A. No. 8 Q. So you want to go ahead? 9 A. Just go ahead. I don't have one. I'm sorry. 10 Q. That's okay. But if you feel you're not 11 understanding a question, please tell me so we can make 12 sure. 13 A. Uh-hmm. 14 Q. The reporter is taking down everything we say 15 word-for-word. 16 A. Right. 17 Q. It's going to be typed into a transcript form 18 and sent to you so you can review it, make sure it's 19 accurate to the best of your ability, and then you'll be 20 asked to sign the end of that transcript to affirm the 21 information is true and correct. 22 A. Sure. 23 Q. Then you'll be asked to return that signed 24 booklet to my office as a part of the investigation. 25 Okay? 10

1 A. Sure. 2 Q. When you're reviewing the booklet, if you feel 3 you need to, you can make changes to the testimony 4 before signing and returning it. However, your ability 5 to later change the testimony doesn't relieve you of the 6 oath you just took to tell the truth today. Okay? 7 A. Yes, sir. 8 Q. Any questions about the process? 9 A. No, I don't. 10 Q. Perfect. Want to start with a little 11 background information and then we'll talk about the 12 business location and whatever you can tell us about the 13 fire. 14 A. Sure. 15 Q. First of all, have you ever gone by any other 16 names than the one you gave at the beginning of the 17 proceeding? 18 A. No, sir. 19 Q. And what's your date of birth? 20 A. 5/15/57. 21 Q. And do you know your Social Security number? 22 A. Yes, sir. 472-96-6064. 23 Q. Have you used any different Social Security 24 numbers in the past? 25 A. No, I don't. 11

1 Q. And, to your knowledge, has anyone used yours? 2 A. No. 3 Q. Where do you currently live? 4 A. 12730 West Marlin, Marlin Avenue, Visalia, 5 California, 93291. 6 Q. How long have you lived there? 7 A. Oh, this one about approximately about five, 8 six year. 9 Q. And do you rent or own? 10 A. Own. 11 Q. And if we go back just for the last year, who 12 else would have lived with you at that address or used 13 the address with you? 14 A. Not anyone else. Only my family. 15 Q. Which family members? 16 A. My wife. 17 Q. And what's your wife's name? 18 A. Boualiene Syprasert. You want me to spell for 19 you? 20 Q. West Houston. 23 Q. Houston. 24 A. Avenue. Visalia, 93291. 93291. 25 Q. Uh-hmm. And when did you start that business? 15

1 A. 1992. 2 Q. Do you still have the business? 3 A. No. I sold. 4 Q. When did you sell it? 5 A. I think, 2000. 6 Q. About the same time that you started 7 Sy Salathai? 8 A. Yes, sir. 9 Q. Do you remember how much you sold that 10 business for? 11 A. I think, 65,000. Yeah. 12 Q. So since the year 2000, have you had any other 13 jobs or sources of income other than the Sy Salathai 14 restaurant? 15 A. Yes. 16 Q. What else? 17 A. Just from the rental. 18 Q. Rental. And how many rental properties do you 19 have? Just within the last year. 20 A. Just a minute, please. 21 Q. Okay, great. 22 A. Total, approximately 12. Twelve property. 23 Q. And you have a list of them, too? 24 A. Yes, sir. 25 Q. Would it be possible for us to make a 16

1 photocopy of the list? 2 A. Yes, sure. No problem. I can make copy. 3 MR. KNAPP: Why don't we go off record and 4 make a copy of it. 5 (Off the record discussion.) 6 MR. KNAPP: We're back on record. 7 Q. And we have a photocopy of your list. When we 8 talk about documents today, we're going to give them 9 exhibit numbers and attach photocopies to the transcript 10 you'll receive. 11 A. Yes, sir. 12 Q. Hopefully that will help you in your review 13 later on; plus, it will give us a good record of what 14 we're discussing. I'm going to start by marking as 15 Exhibit One my October 22, 2009 letter to you and your 16 wife to let you know about the need for the examination 17 and, starting on the third page, some documents and 18 things that were requested to be here. So that's 19 Exhibit One. 20 (Whereupon, the document 21 was marked as Examination 22 Exhibit One.) 23 MR. KNAPP: Now, the photocopy of your binder 24 for the rental properties, I'll mark as Exhibit Two. 25 (Whereupon, the document 17

1 was marked as Examination 2 Exhibit Two.) 3 MR. KNAPP: And can you look at that list and 4 confirm for me that those are all rental properties that 5 you own? 6 A. Yes, sir. 7 Q. And there are numbers or figures to the right 8 of the properties. What is the first number? Number 9 one, for instance, is $850. What does that stand for? 10 A. Rental per month. 11 Q. That's income you get from that property? 12 A. Yes, sir. 13 Q. Okay. And then after that there's a figure on 14 the first one, which is -- 15 A. Column for one year. I put year in it. This 16 stand for year, this stand for month, "MO," month, "Y," 17 year. I figure out. 18 Q. So that's how much you would receive over the 19 course of a year? 20 A. Yes, sir. 21 Q. Did you have all 12 of these properties for 22 all of 2009? 23 A. Yes, sir. 24 Q. Are any of them being offered for sale or 25 trade? 18

1 A. No, sir. Only that one. Approximately I put 2 one -- one building, divide by -- we have A, B, C. I 3 put a number. 109. 109 have A, C and B, three unit. 4 Q. Okay. So that's a triplex. 5 A. Triplex, yes, sir. 6 Q. Is that -- you're offering that triplex for 7 sale? 8 A. No, no sale. No. For rent. 9 Q. So none of them are being offered for sale? 10 A. No. 11 Q. Do all of the properties have mortgages? 12 A. Some of them. Some just mortgage, some no. 13 Some they pay up. 14 Q. Can you look at them and tell me which ones 15 you have a mortgage? Just by referring to its number? 16 A. Can I put "no" on here or just point it? 17 Q. Oh, yeah. 18 A. This one, 1410, no mortgage. 19 1400, no mortgage. 20 700, no mortgage. 21 Q. Why don't we identify the ones that do have a 22 mortgage. So does number three have a mortgage? 23 A. Yes. 24 Q. Does number four? 25 A. Yes. 19

1 Q. And number five through seven? 2 A. Yes. 3 Q. Number eight? Oop, that's all part of the 4 same thing? 5 A. Same thing. 6 Q. Number nine? 7 A. No. 8 Q. And number ten, does that have a mortgage? 9 A. Yes. 10 Q. Number 11? 11 A. Yes. 12 Q. And number 12? 13 A. Yes. 14 Q. So on the chart that you gave us that we 15 marked as Exhibit Two, we have what would be an annual 16 income figure. For the last year have all of these 17 properties had tenants? 18 A. Some of them. 19 Q. Do you know what the actual income is -- 20 A. Sorry. Sorry. I didn't understand. Sorry. 21 What do you mean? Explain it. 22 Q. What I'm trying to find out is on your list 23 you've got how much you would charge if there's a 24 tenant. Have they all been occupied in the last year? 25 A. Oh, yes. Yes. 20

1 Q. There's no vacancies in them? 2 A. Oh, no. 3 Q. And do you have any idea what your net profit 4 would be on the properties after paying, you know, 5 taxes, insurance, mortgages, things like that? 6 A. Usually I don't make too much money. Even. 7 Just keep the property only. I don't make money 8 probably in the month. 9 Q. So, really, the rental properties are a 10 break-even, but it's a good investment? 11 A. Yes, sir. 12 Q. Any other jobs or sources of income in the 13 last year? 14 A. Only from my self-employed. 15 Q. From -- 16 A. From my self-employed. Self-employed, only 17 the restaurant. 18 Q. Do you have any idea how much you earned from 19 the restaurant this year in 2009? 20 A. 2009. 2009. No, 2009 I sold already. 21 Q. Did you make any money from it this year 22 besides selling it? 23 A. No, I don't make nothing. Only just pay rent. 24 From April come up only. April and May until now. 25 Q. So you own the building that the restaurant's 21

No. I write wrong. Yeah, this is wrong. The 8 other address is wrong. The real address be 12664 9 Avenue 320. 10 Q. How far behind did you fall on that property? 11 A. And you're working on modifications but 11 they've not yet been approved? 12 A. Not yet. 13 Q. So what happened that -- this year to make you 14 fall behind on all the properties? Why did that happen? 15 A. Oh, because I usually collect rent, I help 16 make building, to pay to my new building. 17 Q. So instead of using the rent to pay the 18 mortgages, you put it into the new building? 19 A. Yes. 20 Q. Were there any other financial obligations 21 besides the houses that you and your wife fell behind in 22 in the six months before the fire? 23 A. No. 24 Q. So just mortgages? 25 A. What were you going to do 20 with all those receipts later? 21 A. Well, I have a -- I've got -- if not burned 22 out, I add together how much I spending. And after that 23 I'm going to estimate how much my building cost, total 24 cost on future sale. Maybe couple, five year, ten year 25 I want to sell building, how much you have to sell based 59
