Delegation of the European Union to Bosnia and Herzegovina Sarajevo, April, 2016 CLARIFICATION NO 2 TO TENDER DOSSIER Improve Technical Working Conditions of Court Police, Bosnia and Herzegovina Publication reference: EuropeAid/136617/DH/SUP/BA; EU/BiH/TEN/15/001 GENERAL QUESTIONS FOR ALL LOTS QUESTION no. 1 In tenders is written: All tenders submitted must comply with the requirements in the tender dossier and comprise: Part 1: Technical offer, Part 2: Financial offer and Part 3: Documentation". We are interested if all three parts must be bound together, stamped, sealed and initialled or each part separately bound stamped, initialled and packed? ANSWER no. 1 All three parts can be binded together with the rest of the documentation that will represent your offer. You are required to sign and stamp only certain documents where it is specifically requested in the particular form. You do not have to initial documents. Tenders must be submitted in one original, marked original, and 3 (three) copies signed in the same way as the original and marked copy. QUESTION no. 2 Regarding the tender guarantee, please advise us in what way shall be submitted with the bid and whether it must be in English language? ANSWER no. 2 Please refer to Article 22 of Instruction to Tenderers. The tender guarantee shall be submitted in English language using Tender Guarantee Form which is included in the Tender Dossier, Draft contract and special conditions, Annex V. QUESTION no. 3 Regarding the origin of goods, does the individual items offered may have originated from Bosnia and Herzegovina and some from the EU or other countries of the region? Does form can satisfy Declaration/ Statement of producer? ANSWER no. 3 Individual items can origin from any country eligible according to the IPA regulation mentioned in Article 22 of the Supply Contract Notice. When submitting tenders, tenderers must state expressly (in free-format) that all the goods meet the requirements concerning origin and must state the countries of origin. If necessary, the tenderer may be asked to provide additional information in this regard. The certificates of origin must be submitted at the latest during implementation of the contract. Certificate of origin must be issued by the competent authorities of the goods' or supplier's country of origin (usually the Chamber of Commerce) and comply with the international agreements to which that country is a signatory. 1

QUESTION no. 4 Regarding the Technical Specifications for Lot 2, whether bidders must fill in columns Specifications Offered and Notes, remarks, ref to documentation? ANSWER no. 4 Yes. Column 4 is to be filled in by the tenderer and must detail what is offered (for example the words compliant or yes are not sufficient), and Column 5 allows the tenderer to make comments on its proposed supply and to make eventual references to the documentation. This is applicable for all Lots. QUESTION no. 5 Do bidders need to submit with offer samples or certificate for the offered equipment from Lot 2? ANSWER no. 5 Samples are not requested. When submitting bid for Lot 2 (and any other lots), the bidder shall submit a certificate of quality for those items where it is specifically requested in Annex II+III. 2

QUESTIONS FOR LOT 1 Item no. 1.1 QUESTION no. 1 In relation to the requirement for radio CD or MP3 CD with 4 speakers (factory installed), please confirm, that is acceptable to be offered next generation car sound system - SWING system with USB port and SD card. ANSWER no. 1 QUESTION no. 2 In relation to the requirement for Installation of UHF radio station including: Frequency range 136-174 MHz, please confirm that is required radio station in frequency range 136-174MHz, which is VHF. ANSWER no. 2 QUESTION no. 3 Installation of lighting and acoustic signals including. Please confirm that will be accepted also a fixed roof mounting. Magnetic mounted system in certain weather conditions, could be easily damaged. ANSWER no. 3 Fixed roof mounting is not acceptable. QUESTION no. 4 The technical specifications calls for magnetic lighting and acoustic signals. Kindly confirm if magnetic type lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. Please understand that above configuration reflects the current EC standards. ANSWER no. 4 Magnetic type lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. Item no. 1.2 QUESTION no. 5 In the technical specification is only stated intercom for listening and to communicating with a person in cage. There is no information what type of cage and where it should be placed whether behind the first and second row of seats, or behind the second row of seats. ANSWER no. 5 Cage means the compartment for transport of persons placed behind the second row of seats. Intercom (microphone-speaker) should be placed inside the cage. QUESTION no. 6 Please clarify whether it will be acceptable, cage to be done by dividing wall between passengers and cargo area. 3

ANSWER no. 6 Yes, it is acceptable. Please see Corrigendum no 2 to TD. QUESTION no. 7 To enable tenderers to complete their offer, it is essential to receive as many specifications as possible on the compartment for the transport of detained persons (cage), such as: internal layout, access doors, materials, seating capacity, safety requirements etc. Please understand that it will not be possible to prepare an offer in the absence of these important specifications. ANSWER no. 7 The "cage" is not a part of the delivery and below detailed description is provided just to describe the inner space of the van in order to provide additional information in support to better preparation of the offer of the upgrades (mini surveillance camera, intercom and fan) - A slide (security) door for accessing/closing the cage should be placed just after the double rear doors and before the benches inside the compartment for transport of persons (the cage). The slide door must be made of strong metal with small openings for ventilation on the upper side of the door (maximum dimension of openings 20x20 mm) with a door lock unreachable to a detainee. - The compartment for transport of persons should have two side benches (app. dimensions 900x400mm) with the back rest. Bench with the back rest should be made of firm foam, coated with material easy to clean and have reinforced mounting. Next to the bench there should be a metal ring for attaching the restraints (handcuffs). The edge of the bench on the sliding side of the security slide door should be cut under 45º angle for easier entering. - The top layer of the floor of the compartment for transport of persons should have stainless, non - slip metal sheet with water drain. - All parts and panels of the compartment for transport of persons made of soft breakable materials (plywood and similar) must be replaced with stainless metal sheets. QUESTION no. 8 The technical specifications call for two rows (driver and front passenger, and 3 back seats). The technical specifications also mention a compartment for the transport of detained persons (cage). Kindly confirm if the 3 back seats (second row) must be fitted inside the compartment for transport of detained persons (i.e. inside the cage). Please also confirm if the access to the compartment for the transport of detained persons (cage), must be through the right side sliding door. Please also specify whether an additional (internal) access door, must be envisaged for guaranteeing the necessary security conditions. ANSWER no. 8 The "cage" is not a part of the delivery and below description is provided just to better describe the inner space of the van. The three back seats (second row) must be fitted inside the passengers part of the vehicle since it will be used for transport of police officers. The access to the compartment for the transport of detained persons (cage) must not be thought the side sliding door but through the double back door. The side sliding door is entrance for the second row of seats in the passengers part of the vehicle. There should be no additional internal access door. QUESTION no. 9 4

The technical specifications calls for lighting and acoustic signals mounted on the roof. Kindly confirm if the lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. Please understand that above configuration reflects the current EC standards. ANSWER no. 9 Magnetic type lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. QUESTION no. 10 The technical specifications call for a vehicle Length of minimum 4880 mm. However, please note that vehicles within the required power range have an overall length ranging from 4700 to 5000 mm. We kindly ask for a reasonable tolerance of the overall vehicle's length. ANSWER no. 10 Item 1.3 QUESTION no. 11 It is required double rear doors with no windows - sheet metal, side windows of cargo area closed with sheet metal and in the same time there is a requirement for security reflective film (glass on the side sliding door and double rear door, lateral parts of cargo area. Please clarify whether is acceptable to be offered a vehicle 1+4 seats with secured windows by metal net and security reflective film on rear doors and side windows of the cargo area. ANSWER no. 11 QUESTION no. 12 Would it be acceptable for the cargo area to be with following dimensions: width of 1200 mm (+/-5%), length of 800 mm (+/-5%), height of 1000 mm (+/-5%). Please note, that these are minor deviations, which will boost competitiveness and will encourage the open and transparent procurement of the above mentioned tender procedure. ANSWER no. 12 QUESTION no. 13 Please confirm if rear doors and side windows of cargo area are from metal sheet, security reflective film is not required. ANSWER no. 13 The technical specification has been modified. Please see Corrigendum no 2 to TD. QUESTION no. 14 To enable tenderers to complete their offer, it is essential to receive as many specifications as possible on the compartment for the transport of detained persons (cage), such as: internal layout, access doors, materials, seating capacity, safety requirements etc. Please understand that it will not be possible to prepare an offer in the absence of these important specifications. QUESTION no. 16 As far as the cargo area (volume of the trunk) is concerned, the technical specifications states that the "minimum length of the cargo area/trunk means the length between the partition fixed behind the second row seating and sliding doors built in the cargo area". However: please note that these vehicles cannot have any "sliding doors" behind the cargo area/trunk. Kindly confirm that the "sliding doors" referred to in the technical specifications, must read "double rear door". 6

ANSWER no. 16 QUESTION no. 17 Please also note that these vehicles can be equipped with sliding door on the second row, but not on front passenger's side. ANSWER no. 17 QUESTION no. 18 The technical specifications calls for "Police marks (insignias) on the vehicle in accordance with the Rules on Police Insignias of the Court Police of Republika Srpska available on the web site of the Court Police of Republika Srpska". Kindly confirm the website where tenderers may get the necessary information on the required Police Insignias. As an alternative, kindly provide additional details on this requirement. ANSWER no. 18 Details on police marks (insignias) can be found on the link: http://sudskapolicijars.com/pravilnik_o_oznakama_sudske_policije_rs details begin in Article 7 of the Book of Rules. QUESTION no. 19 The technical specifications calls for lighting and acoustic signals mounted on the roof. Kindly confirm if the lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. Please understand that above configuration reflects the current EC standards. ANSWER no. 19 Magnetic type lighting (mounted on the roof) with acoustic signals (installed in the engine compartment) are acceptable. 7

QUESTIONS FOR LOT 2 QUESTION no. 1 2.6 Bullet-proof vest Should bullet - proof vest be for the under wearing or a vest that should have a pocket for further panel adding? ANSWER no. 1 The bullet-proof vest will not be the under wearing (will not be worn under clothing) and it should have pockets in front and in the back for panel adding that increases protection. QUESTION no. 2 What are the measurement of panels? ANSWER no. 2 8

QUESTIONS FOR LOT 4 QUESTION no. 1 Due to the size of the project, we do not intend to participate to the site visit in Tuzla. However, the requirements emphasized that "for installation purposes, a contractor is obliged to provide power supply cables, connectors, plastic channels, AC adapters, fuse boxes, and all other materials needed for system installation". We therefore kindly ask you to provide all necessary data concerning cable type (CAT5, CAT6, CAT7), cable length, plastic cable channel size and length, etc. All information suitable for proper installation by contractor shall be provided by the Contracting Authority and part of the technical requirements. ANSWER no. 1 Please see Corrigendum no. 1 to TD. QUESTION no. 2 Item 4.4: It is requested a PTZ control joystick. What is the meaning of the "mount kit included"? We kindly ask you to remove this specification from the technical specifications. ANSWER no. 2 QUESTION no. 3 You request 32" LED TVs. There is no manufacturer in eligible countries which will provide a certificate of origin for such quantity and this size. We kindly ask you to derogate the rules of origin for the TVs. ANSWER no. 3 The conducted market research resulted in finding manufacturers of this product in the IPA eligible countries therefore, derogation is not granted. QUESTION no. 4 Item 4.14. We kindly ask you to remove the following specifications: "designed to enable opening of the case, change of optical devices, hard disk drive without use of tools". We do not believe that the end-user intends to change once a day, nor once a year... the HDD, orto open the case. "keyboard should be from the same brand than manufacturer of workstations11. Some eligible manufacturers do not sales in BiH and do not provide BiH layout keyboard. These keyboard can be purchased in BiH separately. "mouse should be from the same brand than manufacturer of workstations". ANSWER no. 4 The technical specification has been modified. Please see Corrigendum no 2 to TD. 9

QUESTIONS FOR LOT 5 QUESTION no. 1 Please refer to remarks point in question no. 4 for Lot 4. In addition, there is no manufacturer of copy machine within the eligible countries. Please derogate this item from rules of origin. ANSWER no. 1 Regarding first part of the question: The technical specification has been modified. Please see Corrigendum no 2 to TD. The conducted market research resulted in finding manufacturers of this product in the IPA eligible countries, therefore, derogation is not granted. QUESTION no. 2 Item 5.2: Copy Machine You are asking for resolution: 1200 x 1200 dpi. Please note that the standard print resolution for A3 B&W is 600 x 600 dpi and the printer resolution for A3 Color is 1200 x 1200 dpi. Since you are asking for B&W photocopier the resolution must be 600 x 600 dpi otherwise we have to offer coloured photocopier to get a print resolution 1200 x 1200 dpi. Please advise. ANSWER no. 2 Resolution of 1200x1200 dpi stated in the technical specification for the Copy Machine refers to Copy Machine print resolution. Scan resolution can be lower (600x600 dpi), as it was not specified in the technical specification. QUESTION no. 3 Monochrome printer should with a finisher, by "tray with a minimum output capacity of 1000 sheets A4" do you mean that the finisher Itself should have a stacking capacity minimum of 1000 sheets or do you mean that the printer should come with a paper feed cabinet with a minimum of 1000 sheets capacity? ANSWER no. 3 Finisher tray output capacity needs to be at least 1000 sheets. Since the specification refers to Copy machine, Finisher must have at least one output tray that can support 1000 output sheets. QUESTION no. 4 The requirements for the printer request to have a "warm up time from stand bye of 12s". However most of the manufacturers specify that the warm-up time is the time required to start printing when both main power and sub-power switches are turned from OFF to ON. In addition the warm-up time depends of environmental conditions and usage. Therefore The warm-up time is just an indicative time as it may vary a lot. In order to open the competition, we kindly request that this requirement is drafted as follow: "warm-up time from turn ON main power switches should not exceed 25s. ANSWER no. 4 Copy machine will be used in a way that it will not be turned off and then back on for every print or copy job.
