Wayne County Lip Sync Challenge 2017 CONTEST, REGISTRATION, AUDITION RULES AND RELEASE PRIZE One participant will be chosen to be the winner of Wayne County Lip Sync Challenge at the Wayne County Fairgrounds on June 24, 2017 and will win the grand prize, value to be announced. Prize may be cash or check. WQLK/WHON & sponsors have the right to choose. Other participants, contestants and runners up will not receive compensation unless an outside sponsor decides to reward other winner positions. Any winner of $600 or more will need to complete a W-9 form before the prize will be released. The paperwork and documents may come from WQLK/WHON or the Sponsor(s). Any Grand Prize winner of $600 or more may not participate in another Grand Prize contest of $600 or more on KICKS 96 or 101.7 The POINT for 1 year. Any Grand Prize winner of $600 or more however, may participate in any contest on KICKS 96 and 101.7 The Point of $599 or less after 30 days of winning. All prizes can be stated/added/taken away at any point in time if the finalized decision is made by WQLK/KICKS 96, WHON/101.7 The Point. TO BE ELIGIBLE TO WIN: Winning any prize requires that the potential winner of the prize is, and remains, in compliance with these Official Rules as solely determined by WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s). Wayne County Lip Sync Challenge is open only to residents of the United States who must be at least eighteen (18) years of age or older as of Wednesday, June 7, 2017. Persons in any of the following categories are NOT eligible to participate or win prizes in Wayne County Lip Sync Challenge: (a) any person who on or after June 7, 2017 was or is a Fricker s restaurant franchise owner or employee, any person who on or after June 7, 2017 was or is an, owner or employee to any sponsor(s) to the event, a Brewer Broadcasting owner or employee, (b) persons who are immediate family members (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son) of, or who reside in the same household as, any person in any of the preceding categories. Any participant who attempts to become more than one finalist by using different names, addresses, email addresses or mobile phone numbers, or uses any device or artifice to circumvent these official rules will be disqualified and any prizes awarded will be forfeited and any such person may be prevented from playing the game and/or winning prizes. 2. All previous grand prize winners of our former contest Wayne County Idol, as conducted by WQLK/KICKS 96, are ineligible to participate. 3. WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) reserve the right to remove from the competition any person it determines, in its sole discretion, is sufficiently connected with the competition or any of the entities described in this paragraph whose participation in the competition could create the appearance of impropriety. THE REGISTRATION PROCESS 1. Online registration is available at www.kicks96.com and www.1017thepoint.com. The KICKS 96/101.7The Point & Fricker s Wayne County Lip Sync Challenge competition will begin on June 7, 2017 at Fricker s Restaurant, on Route 27 and I-70 in Richmond, IN at 6 pm. A second evening of auditions will be held on Wednesday, June 14, 2017 at said location. You must be 18 years of age or older at time of try-outs. Pre-registration DOES NOT guarantee a try-out, it does however give you priority over those who sign up the night of the try-out. It is strongly recommended that contestants register in advance online at www.kicks96.com or at www.1017thepoint.com. You may also register in person the evening of the auditions (both June 7 & June 14, 2017) however, no guarantees will be granted to any auditioning competitor that you will be able to audition for the competition whether registering online or in person. All contestants will be chosen on a first come, first serve basis or chosen at random by the Wayne County Lip Sync Challenge registering staff. All decisions made are final. You should therefore register as early as possible either online or in person at Frickers the evening of the competition. WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) reserve the right to change any or all contest rules and dates/times of auditions without prior notice. 2. Locations, dates and times: Two open audition dates have been determined; a. Wednesday, June 7, 2017 at Fricker's in Richmond, IN b. Wednesday, June 14, 2017 at Fricker s in Richmond, IN Starting time is tentatively scheduled for 6:00 pm both June 7, 2017 and June 14, 2017. Finalists given permission by the official judges of Wayne County Lip Sync Challenge to advance to the next round of competition from these two audition days will be invited to participate in the Semi-Final competition held at the Wayne County Fairgrounds in Richmond, IN on June 21, 2017.

Competitors chosen by the judges of the Wayne County Lip Sync Challenge semi-final competition will be invited to participate in the Battle rounds and grand finale competition at the Wayne County Fairgrounds in Richmond, IN on June 24, 2017. Only one (1) Competitor will be chosen by the judges of the Wayne County Lip Sync Challenge final competition and be deemed grand prize winner. If there is a tie, then the judges or staff of WQLK/WHON will randomly choose a song from a list of ten songs randomly picked by judges and each competitor will have :90 to perform (no props or costume). The judges will have the final decision as to who will be the Grand Prize winner following the tie-breaker. REQUIRED AT TIME OF REGISTRATION You must bring valid ID to the auditions that show proof of your age. WAYNE COUNTY LIP SYNC CHALLENGE SCHEDULE Day 1 - Wednesday, June 7, 2017 Auditions 6p-8p Day 2 - Wednesday, June 14, 2017 Open Audition 6p-8p Day 3 - Saturday, June 21, 2017 Semi Final Competition 6p-8p Day 4 - Wednesday, June 24, 2017 Battle Rounds 5p-8p Grand Finale (immediately following the Battle Rounds) Contestants should be prepared to stay until the end of each event. Each event may run longer than the stated end time. THE AUDITION PROCESS (NO COSTUMES OR PROPS) It is anticipated that auditions will start no later than 6:15pm on said audition day. WQLK/KICKS 96 & WHON/101.7 The Point have the right to begin auditions at any time deemed appropriate due to unforeseen circumstances or events out of their control. WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) cannot guarantee that you will be granted an audition at any time. Each participant is required to sign a release form prior to performing in the Wayne County Lip Sync Challenge competition. Auditions (Tryouts) start and end when WQLK/KICKS 96, WHON/101.7 The Point state. WQLK/KICKS 96, WHON/101.7 The Point can disqualify any participants or refuse their participation. Auditions (tryout) entries and sign up may take place at 5:30pm EST unless stated otherwise by WQLK/WHON. WQLK/WHON will take their last competitor no later than 8pm EST during the nights of auditions so scoring can take place. What to Bring to the Auditions 1. Identification: You must bring valid ID (Driver s License or State issued ID) to either audition (June 7, 2017 or June 14, 2017) that shows proof of age. 2. No one under 18 years of age is eligible to participate. What to Wear Please do not wear any clothing or bring any items that have designer names, corporate or sports team names or logos, copyrighted images, celebrity names or images (living or dead), cartoon character images or inappropriate messages or words at any time during the span of the completion. WQLK/KICKS 96/WHON 101.7 The Point reserves the right to require you to remove such clothing, turn it inside out or put on additional clothing to cover it before competing in Wayne County Lip Sync Challenge. Any refusal to accommodate such requests will result in contestant s immediate removal from the competition. WQLK/KICKS 96 and WHON/101.7 The Point reserve the right to require you to cover up any tattoos that contain corporate or sports names or logos, copyrighted images, celebrity names or images (living or dead), cartoon character images or inappropriate message or words before competing in Wayne County Lip Sync Challenge. Any refusal to accommodate such requests will result in contestant s immediate removal from the competition.

What to Perform at the Auditions During the Wayne County Lip Sync Challenge auditions, all contestants will have their chance to perform their approved chosen song. All contestants will be expected to lip sync at least ninety seconds of a song of your choice (it is recommended that you be prepared to perform more). Contestants are expected to Lip Sync until the judges inform you to stop singing. All rules and procedures are subject to change at the judge s sole and absolute discretion. Competitors will be judged on Lip Syncing, Creativity, Stage Presence and Entertainment Value Paperwork In order to participate in the auditions, you will be required to fill out, sign and agree to all of the terms and conditions set forth by the Wayne County Lip Sync Challenge rules herein. ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. IF YOU FAIL TO COMPLETE, IN PART OR IN WHOLE, GIVE ANY FALSE INFORMATION, OR FAIL TO REVEAL ANY PERTINENT INFORMATION, YOU MAY BE DISQUALIFIED FROM THE AUDITION PROCESS. Disqualifications WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) reserve the right to disqualify and/or exclude, in our sole and absolute discretion, any individual from any of the auditions for any reason or for no reason at all, including without limitation, violation of any portion of these rules, or tampering with the entry process or the audition process. We also reserve the right to change the rules and procedures at any time. Being chosen to audition and/or compete at any level in the process does NOT ensure that you will be selected to continue to the next stage. SEMI-FINALS NIGHT SATURDAY, JUNE 21ST AT THE WAYNE COUNTY FAIRGROUNDS (NO COSTUMES OR PROPS) All participants who are passed on to the Semi-Final Round are asked to check-in by 5:30pm with KICKS 96 & 101.7 The Point staff. The Semi-Final competition will begin at approximately 6:00pm. All music must be emailed to lipsync@kicks96.com on or before Friday, June 20th at 12:00 noon. If you do not have your music submitted by this time, you will not be able to compete. Each of the 32 contestants who advanced from the auditions will be chosen at random draw to compete that evening against one another by performing approximately :90 (or until the judges ask the competitor to stop) of song chosen by participant. Judges will score each contestant. Competitors will be judged on Lip Syncing, Creativity, Stage Presence and Entertainment Value.The contestants with the highest combined score from the judges will advance to the Battle rounds of competition that will be held on June 24, 2017 at the Wayne county fairgrounds. All 16 contestants that move on from the Semi-Finals must have 2 songs ready for the Battle Round and Grand Finale portion of the competition and submitted no later than Friday, June 23 by 12 noon. If you do not have your music submitted by this time, you not be allowed to advance. th rd BATTLE ROUND EVENT SATURDAY, JUNE 24 AT THE WAYNE COUNTY FAIRGROUNDS (COSTUMES AND/OR PROPS ALLOWED) All participants who are passed on to the Grand Finale Round are asked to check-in by 4:30pm with KICKS 96 & 101.7 The Point staff. Grand Finale competition will begin at approximately 5:00pm. All music must be emailed to lipsync@kicks96.com on or before Friday, June 23 at 12:00 noon. If you do not have your music submitted by this time, you not be allowed to advance. The final 16 contestants will be chosen at random draw to compete in the Battle Rounds against one other contestant by performing approximately :90 (or until the judges ask the competitor to stop) of a song chosen by participant. Appropriate costumes and/or props are allowed for this round of the competition with a set up time of no more than :60 seconds. Judges will score each contestant. The contestant with the highest combined score from the judges will advance to the Grand Finale Event following the Battle rounds. Each contestant from both the 1 and 2 rounds of competition will be judged on Lip Syncing, Creativity, Stage Presence and Entertainment Value. If a contestant does not show up on Battle Round night by the time their name is drawn and asked to perform, in either the 1 or 2 round of competition, they will automatically forfeit their spot in the contest and the opposing contestant will move on to the Finals. 8 contestants will advance to the Grand Finale event. TH rd st st nd nd GRAND FINALE EVENT SATURDAY, JUNE 24 AT THE WAYNE COUNTY FAIRGROUNDS (COSTUMES AND/OR PROPS ALLOWED) All participants who are passed on to the Grand Finale Round are asked to check-in with KICKS 96 & 101.7 The Point staff when they arrive at the fair grounds. Grand Finale competition will begin shortly after the Battle Rounds. All music must be emailed to lipsync@kicks96.com on or before Friday, June 23 at 12:00 noon. If you do not have your music submitted by this time, you not be allowed to advance. Each of the 8 contestants who advanced from the Battle rounds will be chosen at random draw to perform a full song and given the option to use props and/or costumes if they choose with no more than :60 seconds to set them up. If a contestant does not show up on Finals night they will automatically forfeit their spot. Each contestant will be judged on Lip Syncing, Creativity, Stage Presence and Entertainment Value. The contestant with the highest score will be awarded the Grand Prize. If there is a tie, the judges will make the final decision on the contestant that wins the Grand Prize and how it will be determined. TH rd GENERAL CONDITIONS By participating, entrants agree to be bound by these rules and the decisions of KICKS 96, 101.7 THE POINT, FRICKER S & SPONSOR(S) and the panel of judges, which shall be final and binding. Your presence at the auditions, and the presence of your friends, family members, and anyone else accompanying you, constitutes your and their consent and agreement to the recording and use of your and their performance, appearance, name, voice, singing voice, likeness and any musical or sound effects produced by you and/or them for use in connection with any radio or television program, motion picture, wireless/mobile device, or the Internet for all purposes (including advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary

and subsidiary rights), as the same may be edited, in all media now known or hereafter created, throughout the universe, in perpetuity for no compensation, unless otherwise required by law. GENERAL RELEASE AND CONDITIONS OF PARTICIPATION. Participants assume all risk of loss, damage, destruction, delay and misdirection of Prize Claim Materials and are advised to obtain insurance where appropriate. Game Entities (individually and collectively WQLK/KICKS 96 and each of their respective parent companies, subsidiaries, affiliates, local advertising cooperatives, advertising/promotion agencies, and all of their respective directors, officers, employees, representatives, and agents are not responsible for: (a) incomplete, illegible, misdirected, late, lost, damaged, stolen, or postage-due submissions of Prize Claim Documents or Materials; (b) any technical malfunctions, failures, or difficulties, printing errors, color discrepancies, clerical, typographical or other error in any game cards, game images or printed copy or artwork, any prize offering announcement or any Prize Claim Documents; or (c) any errors of any kind, whether human, mechanical, clerical, electronic, digital or technical in nature, or unauthorized human intervention; (d) any incorrect or inaccurate information, whether caused by Official Website users, tampering, hacking, or by any equipment or programming associated with, or utilized in, the Game; or (e) the incorrect or inaccurate capture of information, or the failure to capture or loss of any information. Proof of mailing Prize Claim Materials of any kind or nature does not constitute proof of delivery. Prize Claim Materials submitted become the sole property of WQLK/KICKS 96 and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Game each Participant hereby releases and agrees to hold the Game Entities harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury, (whether due to negligence or otherwise) due in whole or in part, directly or indirectly, to participation in the Game or any Game-related and/or travel-related activity, or participation in any prize-related activities, or the receipt, use or misuse of any prize. Participants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to claim said prize and any liability and publicity which might arise from claiming or seeking to claim said prize. By submitting potential winning Prize Claim Materials, except where such condition is legally prohibited, each verified winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of his or her name, voice and likeness, along with his or her address (city and state) and any statements made by or attributed to such winner in any and all media, now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe for advertising, commercial and promotional purposes in connection with the Game and other promotions without further compensation, and releases the Game Entities from any liability with respect thereto. IF YOU AND/OR YOUR FRIENDS, FAMILY MEMBERS, OR ANYONE ELSE ACCOMPANYING YOU TO THE AUDITION, DO NOT WISH TO BE PHOTOGRAPHED, OR DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT ATTEND THE AUDITIONS AND DO NOT ENTER THE VENUE WHERE THE AUDITIONS ARE TAKING PLACE. Your and/or their attendance at the audition event will be conclusively deemed to be a waiver of any and all claims for invasion of privacy, defamation, etc. All federal, state and local laws apply. Brewer Broadcasting, Fricker s and Sponsor(s), advertising agencies or any person or entity connected with the production, administration or judging of the auditions or the program, or any of their respective parent companies, affiliates, subsidiaries, successors and assigns, and the respective officers, directors, employees, agents, contractors, partners, shareholders, attorneys, representatives and members of each of the foregoing entities are not responsible for and shall not be liable for: i) any failure of transportation, bad directions, or the inability, for any reason, of any person to appear at an audition site or to audition or appear before the judging panels; ii) any injuries, losses or damages of any kind caused by traveling to or from the audition venues, being present at the audition venues, participating in the auditioning process or being selected to or disqualified from continuing in the auditioning process and/or the show; or iii) any printing, typographical or technological errors in any materials associated with the auditioning process. NO WEAPONS OR NON-PRESCRIPTION CONTROLLED SUBSTANCES WILL BE PERMITTED AT ANY AUDITION OR DURING THE COMPETITION. Contestant Advancement Notification All contestants will be notified by the official judges upon completion of the show whether or not they will advance to the next round of competition. If WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) chooses, a potential winner may be required to submit to, and by participating in the competition, agrees to fully cooperate in, a confidential background check to confirm eligibility and to help ensure that the use of any such person in advertising or publicity for the game will not bring the sponsor into public disrepute, contempt, scandal or ridicule, or reflect unfavorably on the contest or the sponsor as determined by the sponsor in its sole discretion. Force Majeure WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) reserve the right, without prior notice and at any time, to terminate the Wayne County Lip Sync Challenge competition, in whole or in part, or modify competition in any way, should it deem the competition is corrupted or that fraud or technical problems, failures or malfunctions have destroyed or severely undermined the proper play, integrity, and/or feasibility of the competition. In the event WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) is prevented from continuing with the competition as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made health epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, provincial or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor s control (each a Force Majeure event or occurrence), then subject to any governmental approval which may be required, WQLK/KICKS 96, WHON/101.7 The Point, Fricker s and Sponsor(s) shall have the right to modify, suspend, extend or terminate the competition. Only the type and quantity of prizes described in these Official Rules will be awarded upon the completion of the contest.

Instruments Instruments used as a prop during the final night of the performances will be allowed, however, at no time during the competition are they allowed to be used to play music in any audible form. Props and Costumes Props and costumes will be allowed only on the final day of the competition (June 24, 2017). Props and Costumes must be appropriate for a family environment. Props that need to be set up on the stage must be able to be carried on and off the stage by the competitor. Competitors will have 60 seconds to set up their props prior to the start of their performance. WQLK/KICKS 96, WHON/101.7 THE POINT, Fricker s and Sponsor(s) have the right to deny, props or any attire that does not fit these circumstances. Any refusal to accommodate such requests will result in contestant s immediate removal from the competition. th Judges Judges are subject to change or have a replacement due to emergency or conflicts any time during this event. WQLK/KICKS 96, WHON/101.7 The Point have final say on any decision made whether it be stated in the rules above. WQLK/KICKS 96, WHON/101.7 The Point can make changes at any point in time. All prizes can be stated/added/taken away at any point in time if the finalized decision is made by WQLK/KICKS 96, WHON/101.7 The Point. WQLK/KICKS 96, WHON/101.7 The Point or Sponsor(s) are not responsible for any lost, stolen or damaged items at any time of Lip Sync Challenge events including music. WQLK/WHON is not held accountable for any technology or equipment issues during anytime of Idol events including, but not limited to, the inability to play the contestants chosen song(s).

I understand it is my responsibility to obtain and provide to KICKS 96/101.7 THE POINT my own music in mp3 format to lipsync@kicks96.com by noon on Friday, June 23rd. If I fail to do so, I understand that I will be forfeiting my place. WQLK/KICKS 96 and WHON/101.7 The Point are not responsible for audio files that do not play during the competition or are deemed corrupt. If submitted files do not play or are deemed corrupt I understand that I will be forfeiting my place in the competition. I also give KICKS 96, 101.7 THE POINT, Fricker s, Sponsor(s) and any other broadcast/public/commercial station my express written permission to use my name, likeness, photograph and/or recorded voice to promote this contest, future contests in any current or future promotion either in print, online or on-air. I agree to hold harmless WQLK, WHON, Fricker s and Sponsor(s) for any delays, breakdowns, cancellations, tardiness or any other reason that I may be unable to participate. I will provide my own transportation to the events. I also understand that I have read and understand all other rules and regulations associated with this contest and agree to abide by them or be disqualified from the Wayne County Lip Sync Challenge competition.
