ANNEX 10 THE UNITED REPUBLIC OF TANZANIA TANZANIA COMMUNICATIONS REGULATORY AUTHORITY FEES AND APPLICATION GUIDELINES FOR TELECOMMUNICATIONS/RADIOCOMMUNICATIONS EQUIPMENT TYPE APPROVAL

COMMUNICATIONS EQUIPMENT TYPE APPROVAL 1.0 INTRODUCTION In the United Republic of Tanzania there will be several equipment Type Approval procedures established by the TCRA to control radio interference from radio transmitters and certain other electronic products as well as checking compatibility of all Telecommunications/Radio communications equipment with the Public Switched Telephone Networks (PSTNs). It is therefore important for manufactures, importers and vendors to familiarize themselves with the TCRA equipment Type Approval programme. The equipment Approval procedures include: VERIFICATION, REGISTRATION, CERTIFICATION, ACCEPTANCE AND AUTHORIZATION VERIFICATION: is a self-approval process whereby the manufacturer/importer is required to ensure that the measurements necessary to determine compliance with the technical standards are performed. Devices subject to this procedure include TV & FM receivers, non-consumer Industrial and scientific & Medical Equipment. A copy of the measurement report showing compliance with TCRA standards must be retained by the manufacturer and, if requested, submitted to the Authority. REGISTRATION: is a procedure, which requires submittal of an abbreviated application for equipment Type Approval that does not include a measurement report, to the TCRA. However, a measurement report showing compliance of the product with the TCRA technical standards must be retained by the applicant and must be submitted upon request by the Authority. Devices subject to REGISTRAION include AM, FM & TV Broadcasting transmitters, point to point microwave links and certain microwave auxiliary broadcasting transmitters. CERTIFICATION: requires submittal of an application that includes a complete technical description of the product and a measurement report showing compliance with the TCRA technical standards. Devices subject to this procedure include Low power transmitters such as short range cordless telephones and microphone, garage and car door opener controls, radio control toys, security alarm systems, scanning and super regenerative receivers, TV interface devices such as VCRs. Other devices are personal computers and peripherals i.e. Video monitors, modems, etc. ACCEPTANCE: is similar to certification, except that it typically applies to radio transmitter equipment that is used in a licensed radio service. Devices subject to type Acceptance include: Land mobile transmitters such as Cellular transmitters; transmitters used in the maritime and aeronautical safety services; and citizen Band (CB) & other transmitters used in the personal radio services. 2

AUTHORIZATION: Applies to both wired and long range cordless telephones, PABXs, switches, interfaces and data terminal equipment intended to be connected to the public switched telephone network. This authorization procedure is designed to protect against harm to the telephone network. Both Authorization and Certification procedures require that tests be performed on the device to be Type Approved. These tests measure the levels of radio frequency energy that are radiated by the device into the open air or conducted by the device onto the power lines. After these tests are performed, a report must be produced showing the test procedure, the test results and some additional information about the device including design drawings 2.0 PROCEDURES A supplier who applies for equipment type approval shall follow one of the application procedures, namely: (a) Manufacturer s declaration of conformity procedure; or (b) Equipment submission procedure for any type of telecommunications and radio communication equipment. The detailed information is provided in the application Form TACE, ANNEX: 1 2.1 Manufacturer s Declaration of Conformity (MDC) Procedure (a) Under the MDC procedure, suppliers need not submit any sample unit of equipment to the Regulatory Authority for testing or evaluation unless specifically requested to do so. Instead, they need only to submit an MDC form (ANNEX: 2) together with the application form, specification checklist, test reports and/or equipment certification, photographs, technical documents and approval fees. The MDC procedure is based on the submission of a MDC Form and suitable test reports and the overall type approval is essentially a document evaluation process. (b) Suppliers whose equipment falls under the MDC scheme need to have the manufacturers declaration that the equipment conforms with the applicable Authority type approval specifications. The total application package should include the following:- (i) (ii) Duly filled Type Approval application form; Technical documents (consisting of a general description of the equipment, technical data, facilities supported, sales brochures and other documents as specified in the application form); operational manual and type of technology; 3

(iii) Manufacturer s Declaration of/conformity form (ANNEX: 2); (iv) (v) (vi) (vii) Test report and/or equipment certification; Two colour photographs of 4 x6 size, capturing front, rear, side views and the products label of the equipment; Non-refundable type approval fee as specified in the fees schedule; Confirmation that the equipment to be imported in the country shall be new and of the appropriate technology. (b) Applicants who are not able to submit the Manufacturer s declaration of Conformity form or a valid test report or equipment certification will not be accepted for application under the MDC procedure. However, they may submit their applications under the Equipment Submission Procedure; 2.2 Equipment Submission Procedure (ESP) (a) Suppliers/Client wishing to apply for type approval under the equipment submission procedure need to submit an application package which includes the following:- (i) (ii) (iii) (iv) (v) Duly filled appropriate application form; Technical documents (consisting of a general description of the equipment, technical data, facilities supported, sales brochures and other documents as specified in the application form); A sample unit of equipment e.g. Switching, Radio/Transmission, telephone set, cellular telephone set, facsimile machine, switchboards with 10 extensions or less etc. In case of PABX s with more than 10 extension lines, the applicant may be required to confirm date of supplying a sample to be field tried in the customer s premises for a duration determined by the Authority. Neither the Authority nor client will be responsible for costs of equipment that will fail to qualify; Although the Authority will take all precautions for the safe handling and custody of the equipment sample the Authority will not assume liability for any damage or loss of such equipment whilst they are under its custody; The applicant whose equipment has failed the type approval test may apply and submit the model for one re-test within three months from date of notification by Authority at a re-test free as given in the list. Any resubmission after the three-month period 4

will be treated as a new application and the stipulated type approval fee will apply. (vi) (vii) (viii) (ix) (x) (xi) The applicant is required to collect the submitted equipment after testing and within one month from the date of notification of outcome of type approval application by the Authority which will dispose of the equipment in the manner it thinks fit; Manufacturer s Declaration of Conformity Form (optional); Test date/results; Four coloured photographs of 4 x6 size, capturing front, rear, side views and the product label of the equipment; Non-refundable type approval fee as specified in the fees schedule. The Authority shall evaluate the application and inform the applicant accordingly (b) Applications submitted without the necessary and complete documentation, information, sample unit will not be accepted for type approval consideration. (c) All documents submitted shall be in the English Language. Incomplete, inadequate or improper documentation may cause delay or rejection of an application. Applicants are urged to pay special attention to ensure its completeness and accuracy. 3.0 TECHNICAL EVALUATION (a) Technical evaluation of an equipment shall comply with the international and national standards and shall be carried out in the following manner: (i) (ii) document examination; laboratory testing of equipment sample, where applicable. (b) The samples of equipment submitted shall be (i) (ii) (iii) in a good working condition; properly configured for testing and complete with the necessary test adapters; clearly marked with the trade name, model and serial number. 5

( c) If technical details or clarifications are required by the Authority, the applicant shall provide them promptly. ( d) The application shall be rejected or deemed to have been rejected by the Authority if the applicant fails to respond within three months from the date of the Authority s request. ( e) The evaluation will take about one to four weeks (depending on the completeness and accuracy of documents and complexity of the equipment) to complete after the acceptance of the application. Field tested equipment shall take a minimum of six months. (f) (g) (h) After completion of evaluation by the Authority, the applicant will be informed of the outcome of his/her application. The Authority will issue a type approval certificate to the applicant for a specific model of equipment when the Authority is satisfied that the applicant and equipment have complied with the stipulated requirements. The Type approval Certificate is valid for five (5) years from the date of issue by Authority; Each telecommunication terminal or network equipment and radiocommunication equipment complying with technical conditions shall display type approval label to be provided by the Authority. All terminals granted with the type approval by the Authority shall be connected to the public networks without inspection by telecommunications network operators and the network operators shall have no right to refuse the connections. 4.0 OTHER CONDITIONS (a) (b) With continuous development and improvement in network services and standards, specifications may be changed without prior notice. Applicants are advised to check from the Authority Website or from the Authority s offices for the latest standards and specifications, published by the Authority from time to time. Type approval shall in no case be construed as a guarantee by the Authority for the proper functioning, performance or quality of the equipment. Suppliers shall ensure that the approved equipment inter work properly with other public telecommunication networks; (c ) The Authority shall not be liable for any interference caused to any other equipment, injury, loss of life and/or damages to property whatsoever as the direct/indirect result of the use of any approved equipment. The approval granted by the Authority does not of itself confer immunity from legal obligations; 6

(d) (e) (f) (g) (h) In cases of doubt relating to the interpretation of type approval specification, the method of carrying out the tests and the validity of the statements made by the manufacturers of the equipment, the decision of the Authority shall be final. International, regional and National Standards will apply in the process of type approval; The approved equipment shall be installed by technician or engineers recognized by Engineers Registration Board. Alternatively, the installation shall be approved by qualified registered technician/engineer; Measurements and tests for the compliance shall be done in the Authority s premises or at a place designated by the Authority; The Authority shall publish the list and the same shall be available to the public. 5.0 TECHNICAL SPECIFICATIONS To be compiled and published. 6.0 FEES (a) (b) The applicable type approval fees are shown in the fees schedule (APPENDIX:1). The fees are based on per model basis; A fee for the type approval of equipment is payable by the supplier at the time of submitting the application. This fee is non-refundable; (c ) The Authority may determine, from time to time, the type approval fees for equipment covered and not covered in the list; (d) (e) The Authority may classify equipment into one or more of the types given in the list for the purpose of determining the fees that is/are applicable; Every application of an equipment model for type approval is subject to a separate fee payment unless determined otherwise by the Authority. For equipment with multi-interfaces or to be used for multi-purpose, separate fees may be charged for each interface or type of use; 7
