Contracted license fees are noted in the License Rate & Fee Schedule attached as rider to the completed (signed) License for Use Agreement as provided by the THEATRE. Additional license fee rates may apply to non-public, live/film performance events. Additional fees are defined and assessed as per the completed (signed) License for Use Agreement. IV. ADDITIONAL REQUIRED & OPTIONAL SERVICES FEES: A. STATE OF HAWAI'I GENERAL EXCISE TAX: (REQUIRED) All local (State of Hawaii) Licensed Users must provide a copy of GET Certificate. Licensed User is responsible for all applicable State of Hawai'i General Excise Tax. If a non-local Licensed User does not have a Hawaii General Excise Tax Certificate, the Hawaii Theatre will collect and pay the User s GET liability on the User s behalf. Local users should have/obtain a GET license prior to their event. B. INSURANCE: (REQUIRED) All Licensed Users of the facilities of the Hawaii Theatre are required to provide a certificate of Insurance, at their own cost, and name the Hawaii Theatre as "Additional Insured" on said certificate. In the event that the Licensed User fails to provide said insurance certificate, the Hawaii THEATRE will assess a fee of $750.00 per day, or any portion thereof, of residence. 4 Load-in Days scheduled on the first day of residency are per day or any portion thereof. 5 Week is defined as Monday through Sunday. 6 M=Mon., T=Tues., W=Wed., H=Thurs., F=Friday, ST=Sat., SN=Sun. 7 Rehearsal Days are defined as being nine (9) hours or less, beginning of first rehearsal call to end of last rehearsal call, with a mandatory one-half hour break after four (4) hours. If your rehearsal day is longer than 9 hours, additional charges will be assessed per the current rate schedule.

LOCAL PERMITS, LICENSES: (REQUIRED) All permits, licenses, fines, fees or other requirements of the City and County of Honolulu, the State of Hawai'i, and/or the United States of America are the sole responsibility of the Licensed User or COMPANY. If Licensed User/ COMPANY requests, in writing, the Hawaii Theatre Director of Programming to assist in facilitating such permits, and provides necessary information in a timely manner, the THEATRE will facilitate said permits, without guarantee of success, at cost plus twenty-five (25%). THEATRE reserves the right to refuse such permit facilitation requests without explanation. D. SPECIAL DUTY SECURITY: (REQUIRED) A minimum of one (1) uniformed Special Duty Honolulu Police officer is required for every performance. The THEATRE schedules the special duty officer(s), the cost to be paid by COMPANY at settlement. The Hawaii Theatre reserves the right to determine appropriate level of security for all events with all costs charged to the COMPANY. Rates are charged to COMPANY per current HPD rate schedule, with no mark-up by THEATRE. E. LOSS OF INCOME: (REQUIRED) In the event that a Licensed User requests that the THEATRE not operate alcohol/concessions during a particular event, the THEATRE reserves the right to charge the Licensed User additional license fee to compensate for lost revenues. Rate charged by THEATRE equivalent to $0.50 per ticket issued for each particular event/performance. This Loss of Income fee also applies to any performance without an intermission, unless agreed to by THEATRE in the License for Use Agreement. F. RECORDING/BROADCAST OF LICENSED USES AT THE HAWAII THEATRE: (THEATRE PERMISSION REQUIRED, FEE FOR COMMERCIAL RECORDING) The Hawaii Theatre exclusively retains all recording/broadcast rights for any event held on the Hawaii Theatre premises and requires all Licensed Users to obtain permission from the Hawaii Theatre Manager for any/all recording done in the THEATRE. Licensed User is totally responsible for securing BMI/ASCAP, and any and all other rights and royalties. G. BOX OFFICE: (REQUIRED) All public performance events at the Hawaii Theatre require a ticket generated by the Hawaii Theatre Box Office. Complete box office services are supplied each COMPANY at a flat $1 per ticket issued fee. Tickets for shows go on sale as determined after a Hawaii Theatre Licensed Use Agreement has been executed and the COMPANY representative has met with the THEATRE Box Office Manager. Regular hours of operation and ticket sales are Tuesday through Saturday, 9 AM - 5 PM and two hours prior to show time for sales for any particular performance. If additional hours are requested, rates may be negotiated with the General Manager, and will be charged to Licensed User. Applicable customer service charges apply to these services. VISA, Discover, MasterCard, JCB and American Express fees charged to Licensed User at 3.5%. H. HAWAII THEATRE RESTORATION FEE (PAID BY TICKET BUYER/PATRON) A three dollar ($3.00) THEATRE Restoration Fee is charged to all ticket-buyers/patrons to performance events held at the Hawaii Theatre. It is a covenant between the Hawaii Theatre and its community. This restoration fee is collected from the THEATRE patron at the time of purchase. Licensed User is not responsible for the collection or payment of this fee, with the exception of complimentary tickets. Please refer to the Hawaii Theatre Usage Policy.

12-13 LICENSED USE RATE CARD 3-27-12 Page 5 of 6 I. GROUP SALES (OPTIONAL) The Hawaii Theatre offers group sales services to participating Licensed Users. COMPANY defines group sale: discount per ticket and group size (minimum 10). THEATRE will promote sales to groups that participate in THEATRE group sales program. A 10% service fee is assessed on total credit card sales, defined as all THEATRE group buyer type(s) which include all hawaiitheatre.com group buyer type(s). J. HAWAII THEATRE EVENT MAILING DATA LISTS: (OPTIONAL) The THEATRE has compiled an extensive patron database. Current privacy regulations prohibit the THEATRE from providing information collected through credit card transactions to third parties. COMPANY may request, in writing, an Excel data list from COMPANY event(s) held at the Hawaii Theatre free within one year after the event; and afterwards for a fee of $0.10/name plus a Fifty Dollar ($50.00) list generation fee. No event data lists are provided more than three (3) years after a requested event. Lists include, as available: names addresses, and email addresses. THEATRE offers a mailing service where COMPANY may request a number of addresses; defined by event(s), zip codes, telephone exchanges, or random selection; for a fee of $0.10/name plus a Fifty Dollar ($50.00) list generation fee. THEATRE provides data directly to a local mailing service that has a completed confidentiality agreement on file with the THEATRE COMPANY will not be provided the mailing list data. COMPANY is responsible for the creation, contracted mailing service delivery, and postage of the mailing piece at COMPANY expense. All mailing pieces require approval of the Hawaii Theatre prior to distribution and an exact copy of the piece is to provided to the Hawaii Theatre box office. K. FRONT OF HOUSE: (REQUIRED) Front of House services are required for any public event. Complete front of house services which include ushers, ticket takers and an on duty house manager are provided for a flat Five Hundred Dollar ($500.00) per performance fee. Performances over three and onehalf hours will be considered multiple performances, and Licensed User will be charged additional fees accordingly. L. MERCHANDISING: (REQUIRED) The Hawaii Theatre reserves the sole right to operate all concessions on the premises unless otherwise arranged, in advance and in writing, with the Hawaii Theatre General Manager. Merchandise Sales by Licensed User/ COMPANY (USELL): (Required) The sale; by the Licensed User/COMPANY or its agents; of souvenir programs, books, recordings, clothing, and other merchandise; prior to, during, or after the event/performance; shall be permissible provided that approval is first granted by the Hawaii Theatre General Manager. The Licensed User and/or the COMPANY and its agents agree that a sum equal to fifteen (15%) per cent of gross sales is payable to the THEATRE prior to the Licensed User and/or COMPANY relinquishing the THEATRE premises. Merchandise Sales by Theatre Sales Staff (WESELL): (Optional) The THEATRE may be contracted to supply sellers for Licensed User and/or COMPANY merchandise, for an additional fee of ten (10%) per cent of gross sales, making the cumulative fee payable to the THEATRE twenty-five (25%) percent of the THEATRE supplies the sellers. Notice of the request for the Hawaii Theatre to sell Licensed User/COMPANY merchandise must be given, in writing, to the Hawaii Theatre House Manager no later than 72 hours prior to the event. All fees including, but not limited to, the State of Hawai'i General Excise Tax and credit card sales (rates as noted in this section) are the sole responsibility of the Licensed User/ COMPANY. No free samples of food, beverage, or any other product may be given away or dispensed by the License User or COMPANY without prior written approval of Hawaii Theatre General Manager. M. THEATRE PROGRAM INFORMATION (REQUIRED) The Hawaii Theatre requires all Licensed Users to provide the audience printed programs for events/performances, unless approve by THEATRE. The Hawaii Theatre requires that all printed programs include the Hawaii Theatre For Your Information copy as provided by the Hawaii Theatre House Manager. The information is available in a variety of formats from the Hawaii Theatre House Manager. 12-13 LICENSED USE RATE CARD 3-27-12 Page 6 of 6 N. STAGE EQUIPMENT INVENTORY: (REQUIRED) Licensed User is responsible for all charges resulting from stage equipment rental. No labor required for use of THEATRE rental equipment is included. Please refer to the current Hawaii Theatre "Stage Equipment Rental Rates/Policies." Please note the "Notes" and "Attention!" sections of the Stage Equipment Rental Rate sheet. The THEATRE will provide an equipment rental estimate upon receipt of an equipment manifest request from the Licensed User or its agents. Package rates are available for multiple performance users. Please consult with the Hawaii Theatre Production Manager for additional information. STAGE LABOR: (THEATRE DOES NOT PROVIDE) The Hawaii Theatre provides no stage labor for your rehearsals or performances. The Licensed User/COMPANY is responsible for payment of all labor charges for all production work including but not limited to cost of labor to operate the rigging, lighting and sound systems, hanging or flying lights, scenery, banners, and other such production elements. The Licensed User/COMPANY is required to register all labor with THEATRE Production Manager prior to access. To ascertain the amount of time and manpower required for the production work desired and to schedule specific times for load-in, setup, rehearsals and load- out, COMPANY should contact the THEATRE Production Manager. The THEATRE reserves the rights to deny authorization to any stage crew members who, in the opinion of the Hawaii Theatre General Manager, do not meet the Hawaii Theatre Qualification Guidelines. WEYAND ROOM RECEPTION/BANQUET FACILITY The Hawaii Theatre s Weyand Room is available for stand-alone functions, meetings, and pre- and post-show receptions; and may be licensed for use, as the THEATRE schedule permits, for independent and/or event related activities. The Weyand Room is required to be used as open ancillary lobby space no less than one (1) hour prior to curtain through the final intermission of the performance. Capacity: 26 for Conference Table Set-Up (6 tables [2], 8 table [1], 60 round tables [2], 26 chairs) 64 for Formal Dining (60 round tables [8], 64 chairs) 100 for Theatre Style Seating (6 tables [2], or 8 table [1], 100 chairs) 125 for Cocktail Reception (6 tables [2], 8 table [1], 60 round tables [2], 26 chairs) License fees are dependent on the event type, set-up/tear down requirements, catering, and deliveries.
