Fairfax County Park Authority Performance Contract (1-3) Fairfax County Park Authority PERFORMANCE CONTRACT This agreement entered into on March 7, 2017 between the Fairfax County Park Authority and Myriad Artists, LLC C/O Trish Galfano (hereafter referred to as performer) for the Robin and Linda Williams performance. The performer hereby agrees to provide one sixty (60) minute performance for the Mt. Vernon Nights concert series at Workhouse Arts Center At Lorton. Location of Performance: Workhouse Arts Center At Lorton 9601 Ox Road, Lorton, Virginia 22079 703-780-7518 Date of Performance: 7/15/2017 During the hours: 6:00 p.m. - 7:00 p.m. Price for Performance: $3000.00 Pending $1500 from VA Commission for the Arts Check Payable to: Myriad Artists, LLC Special Provision: 100% ADVANCE of $3,000 received by 7/5/2017 Vendor uses only a P.O. box as address - no physical address 100% rain cancellation fee Cancellation: Contract cancellation by the performer must be made at least eight weeks prior to the event otherwise future participation by the performer will not be considered. Performers will not be compensated for any shows cancelled due to inclement weather unless otherwise noted herein. However, the Park Authority will do everything possible to reschedule the performance, although this is not guaranteed. Equipment and Sound Support: The Park Authority will provide a sound system and technical support with requests by the performer fulfilled wherever practical. Additional equipment or support can t be provided unless requested in advance and noted herein. Concert Site Rules: Smoking and alcoholic beverages are strictly prohibited at the concert site. The Park Authority maintains control of announcements and performance volume levels. All public announcements made at the concert site must be pre-approved by the Park Authority; any violations of these two requirements subject the performer to forfeiture of payment. Payment: Payment checks cannot be processed without a signed performance contract, W-9 form and an invoice delivered to the Park Authority, Attn: Sousan Frankeberger. Checks will be mailed 10-21 days after completion of performance. The payment check is written and mailed to the performer s contact name or incorporated group as listed on thew-9 form. Copyrights: The performer is required to, and covenants that they have, secured all required licensing rights permitting the use of copyrighted materials presented during the contracted performances. Hold Harmless: The performer covenants to save, defend, hold harmless, and indemnify the County, and all of its officers, departments, agencies, agents, and employees (collectively the "County") from and against any and all claims, losses, damages, injuries, fines, penalties, costs (including court costs and attorney's fees), charges, liability, or exposure, however caused, resulting from, arising out of, or in any way connected with the Performer's negligent performance or nonperformance of the work called for by this contract. The Performer can t cancel the performance without prior authorization from Sousan Frankeberger, or in the event of her absence from the Washington metropolitan area, a Park Authority representative, specifically authorized by Ms. Frankeberger to make this decision on her behalf. The Performance Hotline: In the event of inclement weather, rain cancellation notifications are posted one hour prior to the scheduled performance on 703-324-7469. Please include this number on your website and all other publicity materials. Method of Payment: Payment checks cannot be processed without signed performance contract, Receiving Invoice, and W9 form (not required from past performers.) Checks will be mailed 10-21 days after the performance, unless otherwise noted. PA system, Tech Support and Accommodation: Sound system and technical support will be provided unless otherwise noted herein. The performer MUST call ten (10) days prior to the scheduled performance to finalize sound requirements. These public performances are presented outdoors at local parks and town plazas with limited facilities. We ask performers to provide their own crew for set-up and if needed to provide their own specific sound equipment and backline. The Park Authority will assist as much as possible but cannot support unreasonable requests regarding the sound system or technical support. Sound check starts promptly at one hour prior to the start of the show or earlier if requested in advance.
