From: Caroline Reiter, P.P., AICP Date: August 21, 2008 Regarding: Proposed Pennsauken Junction Station Block 1005, Lot 1 Pennsauken Township, Camden County, New Jersey Following is a land use analysis of the proposed Pennsauken Transfer Station in Pennsauken, NJ. Our review consisted of a review of the Township of Pennsauken development ordinances. Our findings, as detailed below, are that the proposed Pennsauken Junction Station is consistent with the Township ordinances. The Township s master planning efforts are out of date and not in conformance with the Municipal Land Use Law requirements for periodic review and reexamination. Township Development Ordinances The Pennsauken Code dated November 15, 2007 was obtained from the Pennsauken Township website. The Township Development Ordinances are contained in Chapter 141 of the Code. Based on our review of the Township of Pennsauken Zoning Map (obtained from the Township website), it appears that the subject property is in the R-3 Residential Zone district. Pursuant to Section 141-78 of the Township Code, permitted principal uses in the R-3 zone include single-family detached dwellings on 5,000 SF lots, agricultural uses, signs and home occupations. Permitted conditional uses in the R-3 zone include places of worship, clubs or lodes, and passenger stations for public transportation, telephone central offices and other public utility uses. A passenger rail station is a permitted conditional use in the R-3 zone. The Pennsauken Code does not appear to have specific required conditions associated with this use. Section 141-26 of the Code provides the requirements for evaluating conditional use applications. Section 141-26A(3) states that, the conditional use... is deemed a use by right unless the particular location is deemed by the Board to be contrary to the purpose and intent of this chapter. Therefore, it appears that the proposed use is a permitted conditional use within the R-3 zone district.

Finally, the Pennsauken website lists seven areas that have been designated for redevelopment. We have not been able to confirm the specific locations of the redevelopment areas. However, Michael Viscardi of NJ Transit indicated that it appears that the subject property is not in located within any of the redevelopment areas Township Master Plan It appears that Pennsauken s master planning efforts are not in compliance with the New Jersey Municipal Land Use (MLUL). The MLUL requires that a municipal master plan be reexamined via a reexamination report every six years. The Pennsauken Reexamination Report from 1998 and the Township is not in the process of preparing a new one. We have been advised by Pennsauken officials that the original Master Plan was prepared sometime in the 1960 s. We are in the process of obtaining the 1998 Pennsauken Reexamination Report for review relative to the proposed Pennsauken Junction Station.

Based on the statements made at that meeting, Pennsauken Township concurs that the project will not increase local flooding. NJT has submitted a draft Environmental Assessment to the FTA, and has received comments from them. One of FTA's comments requests that NJT provide documentation that Pennsauken Township concurs that the project will not increase local flooding. If you recall, the project will not only accommodate for its increase in impervious surface, but will also provide catch basins along the project's frontage on Derousse Avenue where none exist. Can you please send us an email or fax a letter to us if you agree that the project will not increase local flooding.
