In specific cases where the literal and strict enforcement of the applicable provisions of these Zoning and Land Development Regulations or other regulations or provisions of this code, would result in undue or unnecessary hardship, the Planning and Development Board may grant a petition for variance from said regulations as will provide substantial justice and not be contrary to the public interest reflected in said regulations, provided the Board makes the following findings: (a c) a. The variance is not contrary to the public interest; The request for the variance is predicated on the request to use the area of the square footage allowed based on the store s street frontage for the south facing wall sign on Johnson Street for the Wings retail store to be divided into two separate, smaller signs still under the total area allowed by code. b. The variance is required due to special conditions. The newly constructed building steps back from the property line and the massing of the building. The massing creates a façade face at the jog of the building exposing a portion of the façade to the east. The intent of the sign at the east facing cantilever is to further function as a catalyst to activate the pedestrian experience of the newly renovated Johnson Street. c. A literal enforcement of the provisions of Article 8, may result in an unnecessary hardship.
