Osmond Brothers Contract Rider 2015 1. The Buyer understands that the items requested below are necessary in order that THE OSMOND BROTHERS can provide the best possible show for the Buyer. If Buyer has any questions, or cannot for some reason provide any of the following, he/she should contact the exclusive representatives for THE OSMOND BROTHERS as follows: Jimmy Osmond (417)593-9990 or jimmyosmond@mac.com Terri Shoemaker (734)558-8431 or terrishoe@gmail.com Edie Walworth - (417)334-2166 or ewalworth@aol.com The Buyer understands that the THE OSMOND BROTHERS cannot perform without all of the following items, and that the failure to provide any of these is a breach of the Contract by Buyer. 2. The Buyer agrees to furnish the following at no cost to THE OSMOND BROTHERS: a) A raised performance area (stage), which is a minimum of twenty-eight feet (28 ) deep and forty-eight feet (48 ) wide. In any room where there is no stage, a platform that is at least four feet (4 ) high and of the dimensions given above shall be provided. Two stair units with lights needed stage left and stage right. b) THE OSMOND BROTHERS production staff will need the assistance of a total of six (6) stage workers and four (4) stagehands. Also, one (1) stagehand must be a qualified electrician. c) Buyer agrees that the performance area (i.e., auditorium, hall, theatre, showroom, band shell, club) in which show is held shall not be open to the public prior to one (1) hour before show time. Further, performance area shall be available to THE OSMOND BROTHERS production staff for technical set-up at least eight (8) hours prior to show time. d) Insurance Permits (public, personal, worker s compensation) The Buyer agrees to provide public liability insurance coverage to protect against injuries to persons or property and which name THE OSMOND BROTHERS as additional insured. In addition, it is agreed that the Buyer shall maintain in effect a policy of worker s compensation insurance covering all Buyer s employees who are involved with the engagement herein. Buyer must cover THE OSMOND BROTHERS and their subcontractors against fire, theft, riot and any other type of act which would cause harm or damage to personnel and equipment. Buyer shall supply THE OSMOND BROTHERS with a certificate of insurance showing coverage of the above; however, if this certificate is not received prior to the show, the Buyer is solely responsible for complete coverage. The insurance policy should be a full blanket policy with a minimum of one million dollars coverage of the engagement. e) Buyer to provide at Buyer s sole cost and expense, all licenses, permits, authorizations and certificates required from any governmental authority, board, agency, guild or association. Any taxes, workers compensation, liens, or any other related fees imposed by any governmental authority relating to the venue or the ticket sales are the sole responsibility of (and shall be paid by) the Buyer. f) Buyer shall indemnify and hold harmless, THE OSMOND BROTHERS and their employees, agents, representatives, etc., from any and all liability, loss, damage, expense, cause of action, claims or judgments, including attorneys fee, arising from injury to person or property resulting from or based on occurrences at the performance area prior to, during, and subsequent to the engagement contemplated by this contract, and shall, at Buyer s sole consent and expense, defend any and all suits which may be brought against THE OSMOND BROTHERS and their employees, either alone or in conjunction with others upon any such liability or claims and shall satisfy, and pay and discharge any and all judgments and/or fines that may be recovered against THE OSMOND BROTHERS and their employees in any such action or actions, provided however, that THE OSMOND BROTHERS shall give Buyer written notice of any such claims for demands. g) Buyer indemnifies the OSMOND BROTHERS and holds the OSMOND BROTHERS and their employees, agents, representatives and any others harmless from and against any and all claims, demands, actions, damages, liability, costs and expenses (including attorneys and other professional fees) arising out of or in Osmond Brothers Contract Rider 2015 1
connection with any bodily injury, death, or loss of or damage to property which occurs in connection with any performance. h) The Buyer agrees to secure and furnish all permits, equipment bonding of THE OSMOND BROTHERS equipment and licenses necessary to allow THE OSMOND BROTHERS to properly produce their show. i) Prior to any performance, Buyer must inform the OSMOND BROTHERS in writing of any mandatory union breaks, curfews, fire regulations, minimum and maximum light level requirements, maximum sound level limits, requirements relating to the presence of any uniformed police within the venue, and any other unique regulations or peculiarities. j) Electrical Power Requirements Sound: A power drop or distribution panel, separate from the lighting power for the sound system and band gear, capable of delivering a total of 100 AMPS per leg, 120/208V, 3-phase, with neutral and an earth ground. Lights: Will need two (2) 30 AMP, 110V circuits for spotlights and a 120/208 /V 3-Phase, 400 AMPS per leg for stage lighting. All power should be within fifty feet (50 ) of stage. 3. LIGHTS Buyer to Furnish: a) Buyer will provide a professionally complete lighting system at Buyer s cost. b) Three (3) follow spotlights and three (3) experienced operators. Three (3) spotlights, either Super Trooper or Trooper (Xenon or Carbon Arcs only). 1000-Watt Spotlights and incandescent spotlights not acceptable! A five (5) or six (6) color boom shall be fitted to the spotlight for color changes. c) During any performance, house lights shall not be turned up unless and until cued by the OSMOND BROTHERS production manager. Any encores shall be determined by the OSMOND BROTHERS in their sole discretion. No announcements of any kind can be made from the stage or through the venue s P.A. system without the OSMOND BROTHERS consent. 4. SOUND Buyer to Furnish: (also see attached Osmond Brothers Technical Requirements) a) Buyer shall provide a professionally complete sound system at Buyer s cost. b) THE OSMOND BROTHERS production staff shall have exclusive control over the production, presentation and performance of the entertainment unit in connection with the engagement. 5. VIDEO Buyer to Furnish: a) Buyer shall provide a professionally complete video DVD playback system (DVD), with at least one (1) screen no smaller than 9 ft x 12 ft at Buyer s cost. 6. POWER/ELECTRICIAN a) Buyer shall provide a power distribution system isolated from lighting power and shall distribute power to all parts of the sound system including the house mix position. No buzzes, hums, pops, sizzles, or cracks will be acceptable due to dirty power caused by non-zeroed ground or cut neutrals. The power requirements for the show are as follows: Service 1: Lighting 120/208 volts 4 wire 3 phase 400 amps per leg and one (1) power distro consisting of sixteen (16) 20 amp 208 circuits with twist lock termination. Source shall be no further than one hundred (100) feet from the stage. Also one hundred (100) feet of electrical pigtails with cam locks on one end will be required. Service 2: Sound 120/208 volts 3 wire single-phase 100 amps per leg. b) Building electrician is required at load in until end of performance; THE OSMOND BROTHERS Stage & Production Manager must approve any absence from performance area. 7. OSMOND BROTHERS to receive 100% Star Billing in all advertising and publicity, as approved in writing by the OSMOND BROTHERS. Osmond Brothers Contract Rider 2015 2
8. OSMOND BROTHERS to have ten (10) of the top priced tickets available to them at no charge. 9. OSMOND BROTHERS have the right of approval of all opening acts. 10. MERCHANDISING: a) THE OSMOND BROTHERS shall have the sole and exclusive right, but no obligation to sell souvenir items, photographs, and any other related merchandise, in connection with, and the performance(s) hereunder and the receipts thereof shall belong exclusively to THE OSMOND BROTHERS. Buyer will not sell booth space, license or otherwise approve or encourage any parties, other than THE OSMOND BROTHERS to sell or merchandise any product that carries THE OSMOND BROTHERS likenesses, names, logo, or facsimile thereof. b) Buyer shall provide a workable table space or counter top in high traffic area, and provide staff to sell Osmond Brothers merchandise if Osmond Brothers staff is unavailable to sell. Percentage taken by Buyer, if any, should be approved in advance in writing by the OSMOND BROTHERS. c) There shall be no product endorsements or associations using the name and likeness of the OSMOND BROTHERS without the prior written consent of the OSMOND BROTHERS. 11. The marquee and performance advertising must present THE OSMOND BROTHERS as a show, not as a dance group. THE OSMOND BROTHERS band will not back any other acts. 12. SECURITY to be provided at no cost to THE OSMOND BROTHERS. Adequate security personnel should be available to secure stage and backstage area during performance. 13. A secured area will be provided backstage including, but not limited to, the staging area to the dressing rooms. All accessible entrances to the backstage and dressing room areas MUST BE secured by security personnel and dressing room keys provided when possible. 14. Backstage passes will be provided by THE OSMOND BROTHERS representative. No other passes will be valid during load-in, sound-check, show time and load-out. Head of security will contact THE OSMOND BROTHERS representative at sound check for necessary passes for production staff. Backstage passes must be strictly enforced. 15. A security officer will be required to escort THE OSMOND BROTHERS to and from the stage and back to the vehicles until they are loaded and ready to leave concert location. 16. In addition, a security officer will also be required at the vehicle(s) during the performance and to remain at the vehicle(s) until loaded and ready to leave concert location. 17. In the event this show is not presented because of inclement weather or any situation beyond the control of the Parties, THE OSMOND BROTHERS must still be paid in full, provided THE OSMOND BROTHERS are present and ready to perform at the designated time as specified in this contract. 18. This contract is void and Buyer is in breach of the Contract if it is not signed by the Buyer and given to the OSMOND BROTHERS fifteen (15) days prior to the first scheduled performance. 19. Recording, taping, broadcasting or filming of THE OSMOND BROTHERS performance will NOT be permitted without an expressly written agreement with THE OSMOND BROTHERS and their agency/representative. 20. If there is to be a co-promoting radio station for OSMOND BROTHERS appearances, that information must be given to OSMOND BROTHERS Administrative Assistant (Terri Shoemaker) no less than ten (10) days ahead of the appearance. In addition, any advertising fliers are not acceptable during THE OSMOND BROTHERS performance. Any appearances must be pre-approved in writing by the OSMOND BROTHERS. 21. Dressing Room and Food Requirements a) Dressing room should be large enough to accommodate twelve (12) people. It must be freshly cleaned, airconditioned and have two (2) AC outlets and restroom facilities. Additional dressing room and restroom, with twelve (12) towels, to accommodate twelve (12) people. Bottled spring water, fruit juices should be in dressing room upon THE OSMOND BROTHERS arrival prior to sound check. Also included should be assorted fresh fruit, cheese and crackers to be in dressing rooms by sound check time (approximately four hours before show time). 22. LODGING: b) Food requirements All items to be provided at buyer s expense Load in Provide sandwiches, bottled spring water, soft drinks (diet Dr. Pepper, fruit juices), coffee, etc., for sound and light crew. (Proper condiments and utensils plates, napkins, silverware, salt, pepper, mayonnaise, fresh bread, etc., should be included). Service for twelve (12) people. A supply of drinks should be kept throughout the load-in (bottled spring water, soft drinks/caffeine free soft drinks, coffee, etc.). Meals A sit down meal is to be provided for twenty people. This is for the performers and crew and should be served prior to the performance. Food is to be of high quality and approved by THE OSMOND BROTHERS representative. Proper condiments utensils (plates, napkins, table cloths, silverware, salt, pepper, mustard, mayonnaise, fresh bread, etc.) should be included for meal. a) Buyer to provide hotel rooms for THE OSMOND BROTHERS, backup musicians, and crew as follows: four (4) rooms with king size beds, and six (6) rooms with two (2) double beds each for two nights. b) Buyer to arrange a late check-out of no less than 2:00 PM with provided hotel. 23. GROUND/AIR TRANSPORTATION: a) Buyer agrees to supply ground transportation as needed of one (1) chauffeured limousine for THE OSMOND BROTHERS, one (1) fifteen (15) passenger van, to pick up THE OSMOND BROTHERS tour entourage, equipment and luggage at the airport, transport to hotel, all rehearsals, performances and back to airport. THE OSMOND BROTHERS representative will contact Buyer with pick up times. b) (Fly Dates Only) Buyer agrees to supply airplane tickets for THE OSMOND BROTHERS, backup musicians, and crew as follows: four (4) first class tickets for THE OSMOND BROTHERS (jet service only) and seven (7) coach tickets. c) (Bus Dates) Buyer agrees to supply cost of travel including vehicle rental and fuel. 24. OSMOND BROTHERS can cancel for any reason 45 days prior to any performance. 25. PUBLICITY (all of the following must be pre-approved in writing by the OSMOND BROTHERS): a) THE OSMOND BROTHERS P.R. representative will place specific information about the performance on THE OSMOND BROTHERS website. Information should include the name of the performance area, performance date and time, ticket information, and a link to the performance area s website (if applicable). Buyer will reciprocate by placing same information on their website, with a link to www.osmondbros.com. b) THE OSMOND BROTHERS will participate in media interviews as their schedules permit, and will be coordinated with Jimmy Osmond or Terri Shoemaker. c) The Buyer will publicize performance, at Buyer s expense, throughout appropriate forms of media in a timely fashion (i.e., radio, television, newspaper, local entertainment publications, posters). For all publicity, promotion and public relations, and requests for THE OSMOND BROTHERS for interviews, special promotions, press conferences and other publicity activities for this date, both in advance and day of show, must first be cleared by Jimmy Osmond of the OSMOND BROTHERS. OSMOND BROTHERS TECHNICAL REQUIREMENTS Sound Purchaser shall provide at his/her sole cost, a high quality, current, state of the art sound system. The company providing the sound system must also provide one house technician and one monitor technician familiar with all aspects of the system. House Mix Position In a coliseum or gymnasium, the house mix position must be on the floor of the main listening area approximately 75 to 100 from the stage in the center of the room. House mix equipment must be set in an area no less than 12 x 8 on a 12 high riser. In an auditorium of fixed seating performance, three (3) rows of ten (10) seats must be reserved for the house mix position in the center of the auditorium at about the same distance from the stage. Speaker system must be flown or placed on risers at least 6 off the floor. MONITOR SYSTEM Digital Console Preferred - ANALOG Monitor System 1-40 input monitor console with 12 discreet mixes and 4 band parametric EQ on each input. (Soundcraft Series 5, Soundcraft SM-20, Yamaha PM-4000M, Midas XL-31, Ramsa 840 etc.) 8-1/3 Octave EQ s to be patched at mix inset points (Klark, Technik, BSS, Ashley) 1 - Digital reverb unit (TC electronics, Yamaha SPX 900, SPX 990, REV-500, or similar) Monitor Speakers 10-2-way, bi-amped stage monitors with 2 x 12 L.F. and 1 x 2 H.F. or 1 x 15 L.F. and 1 x 2 H.F. (EAW SM-500i, EA W SM-222, EA W SM-400, Clair 12AM etc. 2-3-way side fill monitor cabinets (EA W KF-850 or similar) The OSMOND Brothers travel with a qualified Audio Engineer. However a qualified Monitor and FOH tech are still required during Sound check, rehearsals and Performance for assistance. *Clear-Com communication system between house and monitor positions, and lights and video are MANDATORY *Reverb in the monitor rig is a MUST. In cases where there is no Reverb unit in the Monitor rig, a return send from F.O.H. is required. *All mics, mic stands, cable, snakes to complete system (refer to stage plot and input list) Analog Consoles are acceptable and permitted but create the need for additional Level Checks/Rehearsals thus creating the need for more, lengthy sound checks/rehearsals prior to Performance.
