In order to recognize the redevelopment as proposed, we will require two (2) Variances as follows: 1. Critical Area ( (bV1): Buffer Modification Area: a. The Variance is a request to allow New Lot Coverage to be located closer to the shoreline than the closest fa?ade of the existing principal structure. b. The project is demolition of an existing deck and reconstruction of new interior living space. As noted on the Site Plan, the new enclosure is behind the projection of the existing house. 2. Critical Area ( ): Buffers. Expanded Buffers and Buffer Modification: The Variance Request is to allow disturbance to the 100 ft. Buffer. Because the house and majority of the Site are located within the 100 ft. Buffer disturbance must occur in order to remove the deck and replace with the new interior living space. The area is currently stabilized with grass as shown by the photographs. The Site meets the Variance standards as found in Article : b. Requirements for Critical Area Variances (1. ) 'The shoreline requires that the 100 ft. Buffer extend into the Site and encompasses the Improvements. The location of the house requires any Improvements to obtain Variances to Allow Redevelopment in the Buffer, thus denial of the Variance would constitute an Unwarranted Hardship. (2i. ) Because the expansion is redevelopment of existing deck area denial of the Variance would deprive the Applicant of Enjoyment Similar to other Properties. The area currently is utilized as a deck and therefore, to redevelop the same as new interior living space allows the Owner to further utilize the property. 106 Old Solomon's Island Rd. terrain@comcast. net. 3 Page Two 740 Holly Drive November 15, 2017 (3. ) Because the Site is Buffer Modified, the State defers to County Approval Regulations. The County's Buffer Modified Provisions allow for redevelopment through the Variance Process. Thus, no Special Privilege is being conferred as the area being redeveloped has been previously disturbed. (4. ) The Variance Request is based on redevelopment of a deck area to provide new living space and is not the result of any action by the Applicant. (5. ) Because the area was previously developed, additional adverse impact to Water Quality, Fish Impact, Plant Habitat or Wildlife will not occur. Mitigation will be required at 2:1 for the new Lot Coverage. The current Vegetative Buffer will not be decreased in size or shape. (6. ) The Site is not located in a Bog Protection Area. (7. ) The assumption that the Site could be redeveloped without a Variance has been proven to be invalid because the area considered for redevelopment is located within the 100 ft. Buffer and is currently a deckdisturbed area. Therefore, any reconstruction requires the Variance. (8. ) The Applicant has reviewed other alternatives; the current house configuration thus is the most logical area for expansion. We believe the Variance Request as submitted should be acceptable for Review and favorable Recommendation.
