0 0 CHAIRMAN STUTO: We re going to proceed with On the Farm. I understand that one of the representatives is going out for a drawing on the elevations. Joe, if you could get us started with a presentation on that? MR. LACIVITA: Sure. The first project that we have on tonight is On the Farm, which is located at Troy-Schenectady Road. The application before us is for the review of a waiver from the front yard setback. On the Farm has been in business for probably the past years. It exists in a COR district zoning. Currently, the building sits back about 0 feet from the property line and from the street. In the COR design standards, it asks for a setback. The building, like I said, currently sits about 0 feet back. The addition is under a minor application review in our department. The addition is only,0 square feet, which is an addition to the footprint. That makes it a minor application which is under our review. So, that s only going to make the building about feet Ph --- Fax --0

0 0 closer in that setback design standard. So, we are here before the Board tonight asking for a waiver for the minimum of 0 feet from the front yard setback. That s the waiver that will be before you this evening. MR. STUTO: Okay, there is an existing building that they re building an addition to; correct? MR. LACIVITA: Correct. CHAIRMAN STUTO: There is no board up, so we don t have the benefit of that. MR. LACIVITA: Mr. Huban is here tonight to answer any questions of the Board as to what he is trying to do. I know that his son is actually heading home and looking to bring in an elevation of the project. That should hopefully be here soon. CHAIRMAN STUTO: I want to ask a question. How did the original building the one that s being built around how did that avoid the setback requirement? MR. LACIVITA: Actually, years ago the setbacks were much different from the zoning as compared to where we are today. Nick can certainly articulate any Ph --- Fax --0

0 0 changes. MR. HUBAN: When I put that building up, we were actually going to put it too close to the road and I had to get a variance for the 0 feet. This is totally the opposite. CHAIRMAN STUTO: Okay, understood. Any questions from the Board? MS. DALTON: None, thank you. CHAIRMAN STUTO: Lou? MR. MION: No. CHAIRMAN STUTO: Mike, you want to see the elevation, right? MR. SULLIVAN: I would like to see the elevation, but I also had one question. Is there another building that s being demolished to make room for the additional parking? MR. HUBAN: No, sir. MR. SULLIVAN: Do you have a storage shed or something? MR. HUBAN: That s being moved out of there. MR. SULLIVAN: Okay, that was the only other question that I had. Thank you. CHAIRMAN STUTO: I personally have no Ph --- Fax --0

0 0 problem with this. MS. DALTON: I love your ice cream. CHAIRMAN STUTO: Okay, we ll entertain a motion to approve the waiver, based on the recommendations before us. And do we have anyone from the public that has any comments? MR. KUTRYB: My name is Stanley Kutryb and I live at Grove Avenue. I got a flyer in my mailbox. Will parking be an impact also? How far will this go? CHAIRMAN STUTO: I m not sure that I understood the question. MR. HUBAN: He wants to know if the project is going to have any effect on parking. MR. KUTRYB: There is some space back there where the parking already is. Will that be extended further? MR. HUBAN: It will be extended further. It will be toward the [SIC] Simmons property. CHAIRMAN STUTO: Do you want to take a look at this map? Anyone else from the neighborhood? Ph --- Fax --0

0 0 (There was no response.) CHAIRMAN STUTO: Okay, we ll entertain a motion, if someone wants to make it. MS. VAIDA: Before you make a motion, I just think that we need to make the record clear in seeking a design waiver and that s under 0-0 of our Land Use Law. It talks about the setback requirements actually being mandatory. However, it does say that the Planning Board may waive these standards to the extent that it is necessary in order to secure reasonable development of the site. In such case the applicant must establish that there are no practical alternatives to the proposed waiver that would conform to the standard and the Planning Board shall issue a written finding. I just think that we should have Mr. Huban speak a little bit about why the waiver is necessary, unless the Board is satisfied with the written material that was presented on that issue. MR. HUBAN: The question was? MS. VAIDA: If you could just explain simply why the waiver is necessary the Ph --- Fax --0

0 0 setback waiver? MR. HUBAN: Because they want to be close to the road, from what I understand. MS. VAIDA: Did everyone read their packets on the explanation? MR. HUBAN: We re also moving the building eight feet backwards, but we redesigned it to move it over to be in compliance as best as possible. MS. VAIDA: I think that it s clearly laid out in the materials. I just wanted to make sure that it s clear. MR. LACIVITA: One of the key things to know is that you ll never probably meet the intent of the setback because there is a sanitary sewer easement that runs right through the front of the property down Troy-Schenectady Road. Any building, based on sanitary or Pure Waters recommendations would probably be behind that sanitary easement anyway. We have been working with Mr. Huban as far as design standards, fencing, landscaping and things like that. I know that we were talking about the elevations and hopefully Ph --- Fax --0

0 0 your son will be here in a few minutes to show them, if needed. But we have been working with them to really try to adhere to the design standards that are coming up. CHAIRMAN STUTO: I m personally satisfied that there is no practical alternative to what s here. The building is already sitting there and it s grandfathered in. MS. VAIDA: He looks like he s making substantial improvements to the site. CHAIRMAN STUTO: Okay, that said, I ll entertain a motion. MS. DALTON: I ll make a motion. MR. MION: I ll second that.
