FIRST APPLICATION FOR POSTHUMOUS REGISTRATION GUIDE TO COMPLETING THE FORM (please detach before posting) Before completing the form, please read the Information Leaflet UK and Irish Assignment and Posthumous Registration (available from the office on request or via our website www.bl.uk/plr). It is important that you provide correct information regarding your eligibility and the eligibility of the books you are applying for. You must sign the Declaration to confirm that information you are providing is correct. Failure to provide correct information may result in you receiving earnings which you are not entitled to and you could be liable for a fine (see What are my responsibilities to PLR? under section under section 7 of the Information Leaflet - UK and Irish Assignment and Posthumous Registration). Posthumous applications to register new titles can only be accepted if the book was published within one year before or up to ten years after the date of the original owner s death. New editions of existing registered books can be added at any time during the life of PLR (seventy years after the date of the original owner s death). THE ANNUAL CLOSING DATE FOR RECEIPT OF APPLICATIONS FOR UK AND IRISH PLR IS 30 JUNE. Applications received after this date will be processed for the following PLR year. UK & Irish PLR Scheme Synchronisation You may use this form to register for both the UK and Irish PLR schemes. Books may only be registered posthumously for the scheme(s) which the original owner had registered with during their lifetime. If the original owner had opted to synchronise their details during their lifetime we will continue this arrangement so that personal and book details will be updated for each scheme. NB: Non-print material does not qualify for registration with the Irish scheme and will not be listed on confirmation prints and statements. If the original owner had not synchronised their details but was registered for both the UK and Irish PLR schemes, it will be necessary to provide PLR numbers for each scheme you are applying for. It is not possible for new owners/assignees to synchronise details for both schemes if the original owner did not synchronise during their lifetime. If you are unsure if the original owner was synchronised or registered for both schemes, please contact us for clarification. Residence Requirement To qualify for posthumous registration under the UK PLR scheme, the original owner must have resided within the EEA at the time of death (ie EU Member States plus Iceland, Norway and Liechtenstein). For posthumous registration with the Irish PLR scheme, EEA residency rules do not apply. Personal Representative Declaration The Personal Representative section should be completed by the personal representative named in the Will or Grant of Probate (Letter of Administration in Ireland or Confirmation Document in Scotland). If the personal representative and the new owner are the same person, both sections need to be signed. Subsequent applications may be made by the new owner (assignee). Please contact the PLR office if you have difficulty completing this section. Printed Books Prior to applying, the new owner should ensure that the correct % share is being applied for. Each eligible contributor named on the title page of the book must be accounted for and shares should be agreed (verbally or in writing) to reflect contribution (with the exception of translators, who receive a fixed share of 30%). If you are unable to contact the other contributors you may register a share which you feel reflects the posthumous contribution to the book. If other contributors subsequently apply, it may be necessary to renegotiate shares. Refer to section 3 of the PLR Information Leaflet UK and Irish Assignment and Posthumous Registration for full details of eligible contributors and shares. Non-Print Material NB: Non-print material does not qualify for registration with the Irish PLR scheme and may therefore be registered for the UK scheme only. Audio-books PLR shares in audio-books are fixed by the scheme as follows: Writers 60% (if there are no abridgers or translators involved), narrators 20% and producers 20%. Abridgers may register 12% (20% of the writer s share) and translators 18% (30% of the writer s share). If more than one contribution has been made, eg writer and narrator, you may apply for more than one share. If there is more than one writer, narrator etc, you should divide the fixed share equally. For audio downloads (e-audio) editions, please refer to the information below regarding remote lending. Ebooks and E-audio-books From 1 July 2018 the UK PLR scheme has been extended to include public library loans of remote ebooks and e-audio-books. The first payments for these will be made in February 2020. Previously only audio-books ( talking books ) and ebooks downloaded to library premises, ( on-site ebook loans) were included. Ebooks - Shares are calculated in the same way as printed books (see above). Refer to section 3 of the PLR Information Leaflet UK and Irish Assignment and Posthumous Registration for full details of eligible contributors and shares. E-audio-books - Shares are calculated in the same way as audio books (see above). Refer to section 3 of the PLR Information Leaflet UK and Irish Assignment and Posthumous Registration for full details of eligible contributors and shares. Further information can be found under Registration of non-print material. Please refer to the checklist (at the end of the form) and return the completed form to the address overleaf. If the form is not completed correctly your application may be returned.
