Members present at roll call: Mayor Dan Toland, Todd Schultz, Scott Morrissette, Lisa Moody, Mary Van Galen, Andrew Brown, Susan Reese and Reid Wronski. Members Absent: None. Others Present: UWRF students; Doug Thompson. APPROVAL OF AGENDA/MINUTES MSC: Morrissette/Schultz to approve the October 7 th, 2014 meeting minutes as presented: Unanimous. PUBLIC MEETING 6:31 PM, Open Public Meeting regarding the Rezoning of Property and Permanent Zoning District Mike Huth presented recent development within the area of the Sterling Ponds Development and presented the proposed zoning district designations for the area. Annexation of property within the development occurred over a month ago and the City is assessing proper land use designations. There are three affected property owners; Thompson family LLC, Mark and Susan Bjerstedt and the City of River Falls. The City s goal for the area is to have consistent boundary lines and land use adjacent to one another. There is approximately 60 acres in process of rezoning, including 19 acres of conservancy which acts as buffer from residential, commercial and industrial. To raise public awareness, the City has posted signs throughout Sterling Ponds and a notice has been published in the newspaper acknowledging the recent development. Public awareness has also been addressed to property owners within 300 feet of the rezoning district. 3 CURRENT PLANNING 6:39 PM, Tony Steiner - two items of current planning for Sterling Ponds: Item 1: Vacation of Dundee Avenue and Edinburgh Drive Some of the access easements are no longer needed. The two streets are stub streets and have no relation to final plat and layout of current plan. MCS: Morrissette/Van Galen approves vacation of Edinburgh and Dundee recommendation of vacation of Edinburgh Drive and Dundee Avenue: Unanimous. Item 2: Creation of preliminary plat Sterling Ponds Corporate Park is under construction. Tony conveyed that in order to build the city must have legal lots, thus a need to create a preliminary plat for future occupants. There are 7 total lots and a number of out lots. The Engineering firm working with the City will establish final plat upon recommendation approval. The goal of the City is to acquire a recorded final plat and able to sell lots by January of Schultz asked if we are going to incorporate the Bjerstead property because the current boundaries seem to interfere with the overall plat layout. For now, Tony said it will be left out; however it will likely be absorbed into the industrial park at some point. MCS: Morrissette/Moody approve preliminary plat for Sterling Ponds Corporate Park: Unanimous. UPDATE AND INFORMATION 6:46 PM, Josh Solinger Troy Township Land Eligible for Commercial Rezoning (LECR) Zone Update Management Analyst Fellow, Josh Solinger gave a presentation regarding the recent rezoning activity involving the Town of Troy and the relevance to the City of River Falls. Josh explained the background of the rezoning and history of the Land Eligible for Commercial Rezoning (LECR) created by the township. He also provided basic recommendations for the City to move forward into the future. The Town of Troy assumed control of their own zoning authority Oct 1 st, Most changes occur along the STH 35 corridor between Hudson and River Falls. What was once traditional agriculture with associated residential housing along this corridor now can be rezoned as commercial. Josh acknowledged that the LECR zone extends into the River Falls subdivision boundary. With an implied increase in population and potential commercial structures, there will be an increase in services required from River Falls to the LECR district. There will be a greater need from River Falls in regards to services such as EMS, fire, education, etc. The LECR contains approximately 1,281 acres of commercial rezoning compared to the City s 297 acres of commercial zoning. Josh recommends cooperation of City staff with the Town of Troy to ensure that commercial development is mutually beneficial. It is also recommended to consider the City s future growth that the LECR will imply for the City of River Falls. Buddy Lucero mentioned that the LECR does not have the utilities and transportation infrastructure to support large commercial growth in the area; therefore there is no need for immediate concern. 7:06 PM, Resilience Presentation Mike Huth and Mike Noreen Plan Commission Minutes, November 4, 2014 Page 2 of 3

4 Huth and Noreen discussed the roles of climate change which need to be considered for future planning. Noreen mentioned three major variables that have been affected by climate change: 1. Temperature 2. Dewpoint 3. Moisture The comprehensive plan and municipal code already have some resiliency built into them floodplain and shoreline management, as well as building codes. Mike Huth mentioned that our goal with resiliency is the ability to rebound from severe weather events that have the capacity to disable utilities and infrastructure of River Falls. As a Plan Commission land use decisions such as designing more spaces/area for storm water to flow to ease flooding and mapping sites where people can cool off during heat waves, are just two examples discussed to help create a more resilient community. 7:23 PM, Park Master Plan Update - Buddy Lucero Buddy Lucero provided an overview of the schedule for the creation of the Park Master Plan project and the upcoming joint meeting between the Park Board and the Plan Commission on November 19, ADJOURNMENT MC Reese to adjourn at 7:27 pm. BACKGROUND: Much of the UWRF athletic facilities are located along the 1000 block area of South Main Street. Ramer Field was purchased in 1920 for athletic fields, the Hunt Arena was built in 1973 and the Knowles Center in The UWRF is in the process of building a new 162,300 sq./ft. Falcon Center for Health and Human Performance, which will combine Hunt Arena and Knowles Center as part of the Falcon Center The property is currently zoned U-University. The applicant has requested a Special Sign Permit to operate a proposed new Electronic Reader Board (ERB) sign outside the Municipal Code requirements for size, color, shorter frequency for message changes, and animation. SURROUNDING LAND USE AND ZONING: North of the property is zoned R-3 Multiple Family High Density. South of the property is zoned B-3 Highway Commercial. East of the property is zoned U- University. West of the property is zoned B-3 Highway Commercial.

6 Planning Staff Report File University of Wisconsin River Falls Date February 3, 2015 ANALYSIS: The Applicant is requesting Special Exceptions for the proposed ERB. Below is a list of the requested exceptions: 1. The ERB would be a stand-alone two sided monument sign and the size requested is 66 sq./ft. per side. 2. Use of multi-colors and graphics. 3. Duration of message display minimum 2 seconds. A special sign permit must meet the criteria listed in Municipal Code Section , (See Exhibit 2). The applicant s agent has provided written information in response to the criteria as well as associated documents (See Exhibits 3) The sign will be two sided. One side will face the R-3 zoning to the north, which is approximately 95 feet to the property line and approximately 115 feet to the building. It will be approximately 350 feet from the traffic lights to the north. It is approximately 550 feet to the Kwik Trip property line to the south. The driveway entrance to the new Falcon Center is approximately 180 feet to the south of the proposed ERB. There will be two stone walls, with a sign in each of them, on each side of the driveway entrance. The walls will be similar in style to the round-about walls on Cascade Avenue. The new sign would be used to advertise the UWRF sports activities at the Falcon Center and the lighted display will automatically dim during the evening hours. Landscaping and plantings will be provided around the new sign. Staff has reviewed the sign ordinances for three of the surrounding communities that have a university and noted the following. 7 Planning Staff Report File University of Wisconsin River Falls Date February 3, 2015 NEIGHBORHOOD/PUBLIC COMMENTS: A public hearing notice has been published in the January 22, 2015 River Falls Journal. Notices have also been mailed out to all property owners within 300-feet of 1042 S. Main Street, River Falls. INTERDEPARTMENTAL REVIEW: Staff routed this application to various departments on January 23, Utilities Inquired as to who will be running electric to the sign. Engineering The Engineering department had a concern about the sign setback. River Falls EMS No comments Fire & Police The Fire department had no issues. FINDING OF FACT AND CONCLUSIONS OF LAW: Finding of Fact: The application is complete. The property is adjacent to R-1, R-3, and B-3 zoned properties. The sign will be setback, from the property line, the measurement of its height of 8-feet. Electronic Reader Boards (ERBs) requirements, (See Exhibit #4) The Plan Commission may grant a Special Sign Permit for a sign, per Municipal Code Section The application has been reviewed in accord with the River Falls Municipal Code (RFMC) Chapter and staff finds that the proposed sign will not meet code requirements for an ERB. The proposed sign will be an independent sign and will match aesthetically with the other University monument signs located on Cascade Avenue and the proposed gateway signs to the Falcon Center. The location of the proposed sign will not cause extraordinary inconvenience to traffic and pedestrian movement. The sign is approximately 115 feet from the residential property to the north. Conclusions of Law: The ERB will not comply with the following code sections; The maximum size requirement of Municipal Code Section J.2. The color requirement of Municipal Code Section J.3. The time of message display of Municipal Code Section J.4. STAFF RECOMMENDATION: After review of other municipal and state requirements concerning colors and message display, staff recommends approval of the Special Sign Permit based upon finding of fact and conclusion of law herein described in the staff report, and contingent upon the following: The hours the sign is operational shall be between 6:00 a.m. and 12:00 a.m., per Municipal Code Section J.4. As a trial, allow the message to change a minimum of 6-10 seconds and if this causes any traffic or safety issues, the city reserves the right to modify the time. Granting this request allows for the public entity to promote multiple activities that may be going on at the same time. The animation shall not include full motion videos, scrolling or flashing 3

EXHIBIT # Special Sign Permit The plan commission may grant special sign permits in the event an applicant's proposed sign, though nonconforming in terms of the rules and regulations of this subchapter, may be aesthetically acceptable, innovative, functional and in the best interests of the city. It is recognized that this chapter, in attempting to regulate signs, may inhibit the creativity of advertisers in the interest of conforming to standards. Without destroying the purpose of these regulations, certain unconventional signs may be in order and acceptable. Such special sign permits must meet the following criteria: A. The applicant illustrates a consideration for aesthetic qualities that would be prohibited under other provisions of this chapter. B. The applicant can prove that erection of the proposed sign will cause no extraordinary inconvenience to traffic and pedestrian movement. C. The applicant has shown consideration for other property owners adjacent to or nearby the location of the sign. D. The person or group applying for a special sign permit shall file an application with the planning department and make payment of a fee. Electronic reader board and time/temperature signs shall be permitted in the B-1 (General Commercial), B-2 (Limited Business), B-3 (Highway Commercial), or U (University District). 2. An electronic reader board shall not exceed sixty (60) percent of the overall sign area. 3. Messages displayed on the electronic reader board shall be one color, either amber or red. 4. Messages displayed on the electronic reader board shall change no more than one time per hour from six a.m. to twelve a.m. 5. All electronic reader boards must be equipped with photosensitive equipment, which automatically adjusts the brightness and contrast of the sign in direct relation to the ambient outdoor illuminations. 6. Commercial messages displayed on the electronic reader board shall promote only goods or services provided by companies occupying the site on which the sign is erected. 7. 12 Signia design 01/15/2015 Mr. David Hovel Building Inspector/Code Enforcement Officer City of River Falls 222 Lewis Street River Falls, WI Dear Mr. Hovel, Serving as Representative for the University of Wisconsin River Falls, it is our pleasure to submit to the City of River Falls the enclosed materials in support of our application for a Special Sign Permit to allow the University to install a new sign on their property frontage at 1110 South Main Street, River Falls, WI Thank you again for providing us with your help and feedback while assembling this application. The University is currently in the process of updating their Falcon Center property with new amenities designed to meet the current and future needs of the student body, faculty members and the community. With these updates to the site, programmed events will continue to expand; from academic conferences to the mix of sporting events on the courts and across the fields. The unique characteristics of this property make it a preferred destination that is accessible and readily utilized throughout the year. Included with the architectural and landscaping changes taking place is the design of appropriate site identification and information signage. Recognition of the site will rely on two signs that are scheduled. The first sign is the site identification sign that will be located at the new South Main Street Boulevard entrance, configured as two flanking monument signs. Referencing the design of the brick and stone campus identification signs that are currently located on Cascade Avenue, this gateway will serve visitors by designating this point of arrival to the Falcon Center and the University of Wisconsin River Falls. The placement and specifics of the gateway s design are permissible within the City of River Fall s U, (University) Zoning District. The second sign is the information sign. Proposed as a separate yet equally important sign located to the North of the main entrance on Main Street. This double-sided monument sign is positioned perpendicular to the roadway. The intended function of this sign is to present up-to-date information regarding Falcon Center events and opportunities in a readable, attractive and contemporary manner. The sign is proposed as an Electronic Message Center, (EMC) or Electronic Reader Board sign. The City of River Falls General Provisions clearly defines what is permissible when specifying electronic reader board and time/temperature signs. With respect to the identification and information needs for this site and the City s goal to not allow distracting and disruptive signage, careful consideration was given to the graphic and sizing questions that we felt would meet everyone s goals. With this in mind, we are requesting approval of the following requests 1, 2 and 3 that would allow us specific changes from the current sign code for size, color and animation of images and text displayed for this sign application: Signia Design, Inc. 01/15 1

17 Comments on EMC Regulatory Operational Considerations Color: ISA and the industry do not recommend EMC regulations based on the color, or appearance of the display, as it may run into judicial scrutiny of content-based regulations. Any EMC should be allowed to display content identical to a permanent display on a non-emc sign. Additionally, a non- EMC manual changeable copy board can display a message using multiple colors, so an EMC should be provided the same ability to do so as well. Animation: Very beneficial for end-users in commercial areas as it allows sign owners to display products and services that cannot be displayed by static images or text. Here s an example of animation with text in front of a flag waving in the background. Examples of cities that permit animation are listed below. However, there are some types of usage such as flashing that should be prohibited, as there is no informative value. Timing: On-premise electronic signs are generally too small to display entire messages in a single frame. They need multiple frames to pass on information in a legible and timely manner. Regulations placing restrictive hold times on on-premise electronic signs force sign owners to either span messages out to impractical durations or force them to scrunch entire messages into single frames. Either option prevents passersby from being able to read complete messages. Long message duration requirements (over 10 seconds) are un-needed as studies have found message durations ranging from four to 10 seconds to be appropriate and safe. Brightness: Over 130 jurisdictions and several states have adopted the brightness standard of 0.3 footcandles above ambient light with the automatic dimmer requirement. ISA also is in support of this standard and recommends it to municipalities due to its ease of measuring, low cost meter, and consideration of ambient light. See ISA Brightness Guide for reference. Examples of this language is in the Sioux Falls and Mitchell code examples as well as in the ISA guide. Code Examples From our research, it is our understanding that the University of Wisconsin - Platteville, University of Wisconsin - Whitewater, and the University of Wisconsin - Oshkosh each have dynamic electronic message displays on campus. We re sure the University network includes many different types and sizes of EMC type message displays while certain signs may be identified that match, or serve as precedent for defining what features are well suited to the communication needs we find along the Main Street frontage to the Falcon Center. While we unfortunately do not have project specifications or photos of these installations, we have taken the liberty of reviewing certain municipal sign codes that have addressed the question of allowing dynamic signs to be installed in their cities. Beginning with the existing River Falls sign code, the following sign provisions for allowing or permitting EMC signs include the cities of Cedar Rapids, IA, Davenport, IA, Sioux Falls, SD and Mitchell, SD. Out of the following general provisions, highlighted in Yellow are key provisions we noted for comparison. Provisions outlined by the City of Mitchell appear to most directly reflect the practical display of the variety and content of the University s communication needs for this Academic and Athletic site in River Falls. 18 River Falls, WI Summary: An EMC is allowed in the University District, but must be monochrome and requires a 1 hour hold time, and may take up only 60% of the overall sign area. The size restriction for the sign itself is 72. Square feet given landscaping at the base of the sign increases the 60 sq. ft. allowance by 20%. Code: H17.84SI General provisions. J.Electronic Reader Board and Time/Temperature Signs. 1.Electronic reader board and time/temperature signs shall be permitted in the B-1 (General Commercial), B-2 (Limited Business), B-3 (Highway Commercial), or U (University District). 2.An electronic reader board shall not exceed sixty (60) percent of the overall sign area. 3.Messages displayed on the electronic reader board shall be one color, either amber or red. 4.Messages displayed on the electronic reader board shall change no more than one time per hour from six a.m. to twelve a.m. 5.All electronic reader boards must be equipped with photosensitive equipment, which automatically adjusts the brightness and contrast of the sign in direct relation to the ambient outdoor illuminations. 6.Commercial messages displayed on the electronic reader board shall promote only goods or services provided by companies occupying the site on which the sign is erected. 7.Messages displayed on an electronic reader board sign shall not scroll or flash. 8.Temporary signs as defined in Section of this chapter are prohibited on a lot where an electronic reader board sign exists District sign regulations F. University District. Signs in this district shall comply with the following regulations. A permit shall not be required. 1.The total display surface area for signs on any one structure (i.e., wall signs) shall not exceed an area of two square feet of surface area for every one lineal foot of the building facade on which the sign will be erected. 2.No monument sign shall be permitted in a location where its distance from any lot line is less than its vertical height as measured to the highest point of the sign. 3.No monument sign shall have a total sign area that exceeds sixty (60) square feet. 4.Monument signs that are landscaped (plantings and shrubbery) at the base may be permitted to exceed these area limits by no more than twenty (20) percent. 5.Lighting. a.wall signs shall be lighted from above. Monument signs may be lighted from below, above or internally where only the text on the sign is illuminated. b.lighted signs shall project light onto but not outside of the edges of the sign. c.lighting must be landscaped and shielded from view from any right-of-way unless lighted from above or internally. 6.Prohibited signs: flashing and moving. SCOPE OF REGULATIONS The requirements contained in Sec shall apply to digital signs and, together with the provisions of Sec and Sec shall regulate digital signs in all districts. B. REGULATIONS FOR DIGITAL SIGNS 1.Where Permitted a.digital signs that meet all requirements of section are permitted in all zoning districts unless expressly prohibited. 2.Display Attributes Display Attribute requirements shall apply to all digital signs. Digital signs existing on the effective date of this ordinance shall comply with the following criteria by January 1, a.no full-motion video as defined in section (amended in 02/2014, see below) b.digital signs shall not be operated in a way that flashes, blinks, flutters, mimics traffic control devices or emergency vehicles, or distracts the public without providing content to the message. 3.Digital Sign Illumination a.digital signs must be equipped with automatic dimming technology that automatically adjusts the display's brightness based upon ambient light conditions. b.before any building permit pursuant to Chapter 33 may be issued, the applicant for such building permit must supply the Building Official with sign brightness settings. 4.Miscellaneous Regulations. Notwithstanding any other provision of this Code Chapter if the Cedar Rapids Traffic Engineer determines that the operation of a digital sign constitutes a public safety or traffic threat the sign owner, after notice and an opportunity to be heard, may be ordered to either modify the operation of or remove a digital sign to eliminate such threat. Dynamic displays are allowed in all zoning districts with the exception of the HSD, historic shopping district, A-1, agricultural and all R, residential districts, provided they are oriented away from the A-1, agricultural and all R, residential districts to the extent possible. Schools and religious institutions are exempt from this restriction, provided they meet the standards contained elsewhere in this article and are turned off between the hours of nine p.m. and seven a.m. On properties, or within districts where design review by a city board, committee or commission is required for sign approval, said design review process shall remain in effect. B. Only one dynamic display is permitted per lot. The dynamic display may be two-sided. Only one, contiguous dynamic display is allowed on a sign face. C. A static dynamic display shall not change more than once every two seconds. A dynamic display that scrolls is permitted provided it does not operate as described in Section D. D. Dynamic display animation shall not be operated in a way that flashes, blinks, flutters, mimics traffic control devices or emergency vehicles, or purposely is designed to distract the public without providing content to the message. E. Where applicable, dynamic displays shall meet the requirements of Chapter 17.41, HCOD, highway corridor overlay district. F. Dynamic displays exiting on November 10, 2009 (the effective date of this section), must comply with the operational standards listed above to the extent possible. (5) All electronic message signs shall come equipped with automatic dimming controls that automatically adjust the sign's brightness in direct correlation with ambient light conditions.
