1 CITY OF KAMLOOPS BYLAW NO A BYLAW TO EXEMPT PLACES OF WORSHIP IN THE CITY OF KAMLOOPS FROM TAXATION FOR THE YEARS WHEREAS it is provided by Section 220(1)(h) of the Community Charter that a building set apart for public worship, and the land on which the building stands, if title to the land is registered in the name of: i) The religious organization using the building; ii) iii) Trustees for the use of that organization; or A religious organization granting a lease of the building and land to be used solely for public worship; is exempt from taxation; AND WHEREAS it is provided by Section 224(2)(f) of the Community Charter that on or before the 31st day of October in the preceding year, a Council may, by bylaw, exempt from taxation: i) An area of land surrounding the exempt building; ii) iii) A hall that the Council considers is necessary to the exempt building and the land on which the hall stands; and An area of land surrounding a hall that is exempt under subparagraph (ii); AND WHEREAS it is provided by Section 224(2)(g) of the Community Charter that land or improvements used or occupied by a religious organization, as tenant or licensee, for the purpose of public worship or for the purposes of a hall that the council considers is necessary to land or improvements so used or occupied may be exempt from taxation. NOW THEREFORE the Municipal Council of the City of Kamloops hereby enacts as follows: 1. The land or improvements, or portions thereof, used in conjunction with places of worship as outlined in Schedule "A" attached to and forming part of this bylaw, shall be exempt from taxation for the years 2017 to 2021, inclusive. 2. Where: a) A transfer, sale, or lease is made of property exempt from taxation under this bylaw to some other person not entitled to such exemption; or b) Property used for some purpose which would entitle it to exemption under this bylaw ceases to be so used; or

2 BYLAW NO PAGE 2 c) Property exempt from taxation under this bylaw ceases to meet the conditions necessary to qualify for the exemption including, but not limited to, compliance with the City's policies and bylaws, the property shall be liable to taxation from the date of the transfer, sale, lease, or change of use or conditions, as the case may be (the "Taxation Date"). 3. Where the assessment roll is completed before the transfer, sale, lease or change of use or conditions described in Section 2 of this bylaw comes to the attention of the collector: a) The collector will provide written notice to the transferee, purchaser, lessee, or other person who, but for the exemption, would have been liable to taxation; and b) The person described in a) shall pay to the City an amount equal to the total taxes that, but for the exemption, would have been payable on property from the Taxation Date, together with interest compounded annually at the rate described in Section 246 of the Community Charter. 4. This bylaw may be cited as "Places of Worship Exempt from Taxation for the Years Bylaw No , 2016."
