2 PROJECT DESCRIPTION The project proposal is to amend the Pacific Plaza East Planned Sign Program (PSP) for the purpose of installing an approximately 262 sq. ft. curved full color LED (electronic message center sign) display at the existing building located at 555 Mason Street. The proposed sign would be located in the upper (second-story) corner of the building facing the Mason Street/Davis Street intersection. The applicant is not proposing to advertise off-site businesses, only businesses located at 555 Mason Street and miscellaneous community information. PREVIOUS ACTIONS February 1989 The City s Design Review Committee approved an Environmental Assessment and Design Review for a three-building office complex referred to as Pacific Plaza. This approval was appealed to the Planning Commission by the applicant based on concerns related to the abandonment of an adjoining alley and parking. March 1989 The Planning Commission denied the appeal. June 1989 The City s Land Division Committee approved the Pacific Plaza Environmental Assessment and Tentative Parcel Map. January 1991 The Planning Commission approved a Variance to increase the percentage of compact spaces from 40 to 45 percent. September 1993 The Planning Commission approved the Pacific Plaza East Planned Sign Program (PSP). PROJECT ANALYSIS 1. General Plan The project proposal does not include any requests to alter the zoning, or the General Plan. Therefore, the proposed project would be consistent with the City s 1990 General Plan. 2. Planned Sign Program Amendment Section (Signs Definitions) of the Code defines Message Center Signs as follows: Message center sign means a sign that has a changeable message that can be changed by electronic processes or remote control. Types of messages allowed consist of the following: (a) products produced or sold and services offered on-site, (b) time and temperature information, or (c) public information announcements of a non-commercial nature. In this case, the applicant is proposing a color LED display that is operated electronically. 2

3 Section H (Signs General Provisions) of the City s Land Use and Development Code, states: A message center sign is not allowed by this chapter except as may be approved by the Planning Commission through their adoption of a Sign Plan, as a variation from the standards, and provided that no message center sign shall be installed within 1,000 feet of another message center sign on the same street frontage. In this case, the project site is located within the boundary of an existing planned sign program (PSP). The applicant is requesting to amend the PSP to allow a message center sign, in the form of a curved full color LED display. Therefore, the Planning Commission has the authority to approve or deny the request. The applicant has prepared a letter identifying the reasons for the request. This letter is attached as Exhibit C. In the letter, the applicant indicates that the proposed electronic sign will achieve a number of benefits, as summarized: (1) digital messaging will allow the applicant to retain its tenants at 555 Mason Street; (2) digital messaging is the new real estate metric; (3) digital display will showcase the building as a gateway to downtown Vacaville; (4) digital display will help level market with regard to other commercial projects such as the Nut Tree; and (5) the location of the building will allow the digital display to be visible from several blocks along Davis Street and Mason Street. As mentioned above, these items are a summary of the reasons the applicant has identified to support the request. A more detailed explanation by the applicant is attached as Exhibit C. Staff is supportive of innovative ways to enhance not only the downtown area, but all commercial areas within the City. However, staff does not believe an electronic display at the proposed location is appropriate given the nature of the businesses identified at this location. The tenants at 555 Mason Street consist of First Northern Bank, AAA, KUIC Radio, Edward Jones and Intero Real Estate. The project site is primarily an office building. Since 2001, when the electronic sign for the Auto Mall was approved, the Planning Commission and City Council have approved a number of electronic signs in the City. One of these signs is for an entertainment venue known as the DeVille Theater and is zoned Downtown Commercial (CD). The remaining ones have been for retail commercial locations, such as the Vacaville Auto Mall, Nut Tree, and Meek s. These areas are zoned General Commercial, similar to the zoning for the project site. The applicant has indicated there is a need to level the market for downtown businesses to be granted similar signs as large retail centers such as the Nut Tree. The applicant also states that Vacaville s central businesses district, including 555 Mason Street should be treated as valuable to the City of Vacaville. The City believes all businesses in the City are valuable to the City s overall economic health. The applicant has not stated or explained how Vacaville s downtown or central business district would be served by a digital display at 555 Mason Street. The applicant has not requested off-site signage, one that would presumably allow other businesses to consider electronic advertising. The proposed operations agreement to not allow off-site signage is attached as Exhibit F. Although the Code identifies an avenue for consideration of electronic signs, the City s Sign Ordinance does not allow Message center signs unless specifically approved by the Planning Commission as a variation. For this reason, any such project seeking to create or amend a PSP must provide offsetting benefits. Staff has 3

4 not identified any offsetting benefits, because it is not evident that the proposed electronic sign is necessary or appropriate for an office building. Staff has been unable to identify any benefit of such a display at the proposed location. This is because: (1) the average traveler on Davis Street or Mason Street is already able to identify the building tenants by their building signs; (2) the digital display may be visible as a light source from Interstate 80, but the sign would be approximately 1,600 feet from the freeway, making it nearly impossible for a freeway traveler to have the time or vision to read the display; (3) the unofficial gateway to the downtown has been addressed by the existing Downtown Vacaville sign that is located approximately 330 feet from the proposed sign location. Staff has not identified any reasons why an electronic sign would be a more enhanced gateway element than the existing freestanding downtown Vacaville sign; (4) Mason Street and Davis Street include a number of office uses similar to Pacific Plaza East. These sites do not have electronic signs, allowing such a sign for one site and not the others would not create a compatible and consistent commercial district; and (5) small downtown areas such as Vacaville s downtown were not designed nor do they operate in direct competition with 30-acre freeway oriented retail centers such as the Nut Tree, or the Vacaville Auto Mall. Even if there is a belief that downtown businesses must compete with big box retail and auto dealers, the proposed sign would not address or benefit such a goal, because it is an on-site sign with no off-site allowances. The applicant has maintained the existing building and site in a manner that is responsible and positive, and this should be commended. The applicant has identified several reasons for his request; however, Staff believes the applicant has not provided sufficient reasons necessary to support the request and the required findings. Staff does not support the Planned Sign Program Amendment request. Revised Planned Sign Program Language The applicant is proposing to modify Sections II and III of the Pacific Plaza East PSP as identified below (underlined). II. DEFINITIONS B. Types of Signs 4. Digital signs Pursuant to Vacaville Municipal Code Section , a digital sign is a message center sign which displays a message that can be changed by electronic process or remote control. Types of messages allowed may identify the business conducted; goods or services rendered, produced or available upon the property where the display is located; the sale, lease or exchange of real property and office space; the name of the owner or occupants of the premises or to identify the premises; time and temperature information; and non-commercial messages (including for community events). 4

5 III. GENERAL REQUIREMENTS 3. Design Review E. Digital Signs I. Pacific Plaza East 1. Subject to the foregoing, one (1) digital sign may be allowed attached to the SW corner of the building at the intersection of Davis and Mason streets, as shown on the attached Exhibit A. Illumination of the display shall comply with Vacaville Municipal Code Section A.3. The project proposal consists of the installation of curved electronic sign display at 555 Mason Street. The sign is a 7 4 x 35 4 (approx. 260 sq. ft.) full-color LED display within an aluminum cabinet frame. The sign is proposed to be located approximately 24 ft. from the ground in the upper corner of the building, facing the Davis Street and Mason Street intersection. The proposed display would be visible for travelers heading eastbound on Mason Street approximately two blocks from the intersection, in the same manner existing building signs provide identification of the building tenants. During spring and summer months, the row of trees on Mason Street would block the display further west on Mason Street. The display will be visible considerably longer for northbound travelers on Davis Street. The display is not visible to westbound Mason Street travelers until the Davis Street Mason Street intersection. As mentioned earlier, the Planning Commission has the authority to approve variations from the Sign Ordinance such as message center signs. When considering a variation, it is important to determine offsetting benefits the project would provide. The project site includes existing tenant building signs which provide proper identification for the tenants. The project proposal does not enhance the building or tenants signage in a way that is clear, and therefore does not provide offsetting benefits. In addition, the goal of allowing variations is to encourage higher quality and creativity in sign design and to address unique site and building design constraints. Staff has not identified any unique site or building design constraints to support the proposed sign. Staff does not support the Design Review request. LAND USE COMPATIBILITY The applicant is proposing to modify an existing PSP for the purpose of installing a full color electronic display. Staff does not believe an electronic display located at an office building would be compatible with adjoining land uses. The proposal does not increase the design quality or general aesthetics of the site or the neighborhood. The placement of an electronic sign without offsetting or general benefits would not be compatible with similar land uses in the vicinity of the site, which include similar office uses as the project site. In addition, as part of the noticing for the upcoming Planning Commission meeting, a local business owner who was notified has submitted an to City Staff opposing the proposed sign. This is attached as Exhibit E. 5

6 ENVIRONMENTAL REVIEW Categorical Exemption Pursuant to Section 15301, Class 1 (Existing Facilities), Section 15303, Class 3 (New Construction or Conversion of Small Structures), and Section 15311(a), Class 11, (Accessory Structures - Signs) of the California Environmental Quality Act (CEQA), this project is Categorically Exempt from the requirements of CEQA. No additional environmental review is required. FISCAL IMPACT The Community Development Department s review and processing of the Planned Sign Program Amendment and Design Review applications were funded by Planning application fees. CONCLUSION The applicant is proposing to install an electronic message center sign at an office building located at 555 Mason Street. Staff does not support the applicant s requests, because: (1) the proposal does not enhance the aesthetics of the building, the site or business area; (2) past approvals for similar signs have been granted for retail commercial and entertainment venues, not office buildings; (3) approval of the sign could create a precedent resulting in an overconcentration of such signs in the City; (4) Mason Street and Davis Street include a number of office uses similar to Pacific Plaza East. These sites do not have electronic signs, allowing such a sign for one site and not the others would not create a compatible and consistent commercial district (5) the applicant has not provided sufficient reasons why the proposal is a necessary or compatible sign for the type of businesses occupying the building; (6) the proposed sign would not be a necessary or appropriate gateway to the downtown Vacaville area, as an existing downtown Vacaville freestanding sign is located near the project site; and (7) the request is a variation only allowed by Planning Commission action, and there is no clear offsetting benefit to amending the planned sign program. RECOMMENDATION By simple motion, that the Planning Commission approve the resolution of the Planning Commission of the City of Vacaville, denying the Pacific Plaza East Planned Sign Program and Design Review. 7 RESOLUTION NO RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF VACAVILLE DENYING THE PACIFIC PLAZA EAST PLANNED SIGN PROGRAM AMENDMENT AND DESIGN REVIEW (ELECTRONIC MESSAGE CENTER SIGN) AT 555 MASON STREET WHEREAS, the Planning Commission of the City of Vacaville conducted a hearing on November 20, 2014 to consider the Pacific Plaza East Planned Sign Program Amendment and Design Review requests, relating to the following described property: 555 Mason Street APN WHEREAS, the public hearing before the Planning Commission was duly noticed in accordance with applicable state law and the Vacaville Development Code requirements; and WHEREAS, the Planning Commission received testimony from City staff, the applicant, and all interested persons regarding the proposed project; and WHEREAS, the Planning Commission has determined that the project is categorically exempt pursuant to Section 15301, Class 1 (Existing Facilities), Section 15303, Class 3 (New Construction or Conversion of Small Structures), and Section 15311(a), Class 11, (Accessory Structures - Signs) of the California Environmental Quality Act (CEQA). WHEREAS, The Planning Commission has reviewed the request for the Pacific Plaza East Planned Sign Program Amendment and Design Review and adopts the following findings of fact for Design Review permits, as required by Sections and of the City of Vacaville Land Use and Development Code: 1. That the project is consistent with the goals, objectives, and policies of the General Plan, the Zoning Ordinance, and the Development Code. One of the primary goals of the City s Sign Ordinance is to preserve and improve the aesthetic appearance of business areas by prohibiting incompatible and intrusive signs. As proposed the proposed sign is incompatible with the character of the building design and existing building signs. The Land Use and Development Code requires a Planning Commission level Planned Sign Program amendment, which the applicant is requesting. However, the proposed electronic message center is not consistent with past City approvals of such signs, because previous approvals have only been granted for retail commercial uses and not office uses. Approval of such a sign could set a precedent in which other office uses would seek similar electronic signs resulting in an overconcentration of electronic signs in the City. Mason Street and Davis Street include a number of office uses similar to Pacific Plaza East. These sites do not have electronic signs, allowing such a sign for one site and not the others would not create a compatible and consistent commercial district 7

8 2. That the proposed project is consistent with the standards and regulations of the applicable zoning district, and is consistent with any other approvals for the site. Existing signage for the project site is in compliance with the City s Sign Ordinance. However, a message center sign is not allowed unless the Planning Commission specifically approves a variation to the Code, in this case in the form of an amendment to the existing PSP. Other uses in the General Commercial zoning district have obtained electronic sign approvals, however those uses are multi-acre retail commercial developments offering a variety of retail services. The proposed project site consists primarily of office uses. The project site includes approved building signs identifying on-site tenants. Granting a message center sign for an office building would not be consistent with past City approvals of electronic message center signs. 3. That the subject site is suitable for the type and intensity of use or development proposed, and that the design, size, and other physical characteristics of the proposed use are compatible with adjacent uses, or with adjacent natural resources. The proposal is to install an electronic sign for an office building, at a location where existing building signs identify the building tenants. As previously mentioned, all previous City approvals for electronic signs in the last decade have been granted for commercial retail uses, no such approvals have been granted for office uses. An electronic message center sign is not a suitable sign for an office building with existing building signs, and one which enjoys considerable exposure to travelers given its highly visible design and location. The proposed sign does not increase the design quality or general aesthetics of the site or the neighborhood. 4. That the proposed uses will not be detrimental to the public health, safety, or welfare of the community. The proposed electronic message center sign would not be detrimental to the public health, safety, or welfare of the community. 5. That adequate public facilities and services are available to serve the site or will be made available concurrent with the proposed development; All City utilities are available to serve the site. 6. That projected traffic levels and levels of service are, or as result of conditions of approval, will be consistent with the policies of the Transportation Element of the General Plan. The proposed project will not create any impacts to traffic levels or levels of service on the City s circulation system or the Transportation Element of the General Plan. 7. That the project is consistent with any design guidelines adopted pursuant to Section (C) of Division 14.01, Administration, of this Title, for the type of use or structure proposed. While the Sign Ordinance does not include specific design criteria for electronic signs, the City s design goals are to improve the aesthetic characteristics of Vacaville through enhanced design elements including high quality building signs. The placement of an electronic sign on the façade of an office building which already includes tenant signage is not consistent with previous approvals for such signs. 8

9 8. That the project includes variations from the provisions of the Sign Ordinance (Section F) which are offset by aspects of the Planned Sign Program. The applicant is requesting a variation from the provisions of the Sign Ordinance to install an electronic message center sign. The existing Planned Sign Program allows for tenant signage on the building which is visible on Davis Street and Mason Street. There are no offsetting elements in the PSP that justify the variation. 9. That the project includes higher quality and creativity in sign design to address unique site and building design constraints (Section E). The project site or the building that would house the sign does not include any unique design constraints. NOW, BE IT RESOLVED, that the Planning Commission does hereby deny the Pacific Plaza East Planned Sign Program Amendment and Design Review. City staff should oppose the proposal as should the commission. Years have been invested into creating a down town that we can all be proud of and to allow that effort to be wasted over a self serving eye sore would be a travesty. 22 DRAFT 555 MASON St. Digital Sign Operational Agreement Between the City of Vacaville and I-80 Properties, LLC 1. The sign shall not include any prohibited advertisement as identified in Section (Prohibited Signs) of the City of Vacaville Municipal Code. 2. Only on-site events and activities advertising the business conducted, services rendered, or goods produced or sold upon the property, shall be identified/advertised on the sign. There shall be no off-site events or activities advertised, except upon advance written approval from the City. 3. As deemed necessary by the Community Development Director, the owner shall adjust components of the sign to the satisfaction of the Director. These components include illumination level (brightness), content, text transition speed, and noise. By the City s signature on this Agreement, the City agrees to the installation of the sign as submitted in application #, dated, subject to the foregoing limitations. The property owner and any successor or assigns understand, acknowledge and agree (1) to be bound by the requirements set forth herein; and (2) that the indemnity, hold harmless and defense provisions, and the cooperation in the event of a legal challenge provision set forth in Standard Conditions of Approval # XYZ, respectfully (Attachment A), apply to this agreement and other matters set forth herein, as well as the underlying Project approvals.
