1 MIDDLE SMITHFIELD TOWNSHIP BOARD OF SUPERVISORS MINUTES AUGUST 23, 2018 The regular meeting of the Middle Smithfield Township Board of Supervisors was held on Thursday, August 23, 2018 at 7pm at the Schoonover Municipal Building with Annette Atkinson presiding. Supervisors present: Annette Atkinson, Michael J. Dwyer and Mark Oney. Also present, Township Solicitor Michael Gaul, Esq., Secretary Michele L. Clewell, Stenographer Donna Kenderdine and one township resident. Pledge of Allegiance Approval of Minutes Annette Atkinson made a motion to approve the August 9, 2018 minutes. Mark Oney seconded the motion. Motion passed 3-0. Report of Executive Session(s) Attorney Gaul stated that an executive session was held prior to this meeting to go over pending legal matters with the Township Solicitor. Announcements The Pocono Record newspaper began a series of articles highlighting citizens and community involvement. The first article in the series highlighted W. Leroy Lewis for his unwavering dedication as the caretaker of the W. Leroy Lewis Dog Park. Memory Makers was held on August 18 th and was attended by over 170 residents and guests. Velma Knight and Wesley Rusk donated old photography slides of Middle Smithfield Elementary School students. The slides were used to make pictures and posters of the students. Attendees at the event enjoyed identifying the students in the pictures and posters. The Monroe Young Democrats of Pennsylvania are cleaning up litter along Coolbaugh Road this weekend. Quiet Valley Historical Farms is having the State Craft Festival this weekend and the township s Community Day is scheduled for September 8 th at Middle Smithfield Elementary School from noon-6pm. On September 16 th Camp Papillion is having a fund raiser at the Echo Lake Park. Pick up the Poconos is being held on September 29 th, the same day at MST 1,000 Feet of Street. The Monroe County Commissioners are to dedicate September 29 th as Pick Up the Poconos Day.
2 Public Hearing An Ordinance of the Township of Middle Smithfield, Monroe County, Pennsylvania, Amending the Code of Ordinances of the Township of Middle Smithfield, Chapter 150, Entitled Short Term Rentals, Regarding Occupancy Limitations, Including Persons and Vehicles, and Other Miscellaneous Items, Relating to Short-Term Rental of Residential Dwelling Units Annette Atkinson thanked fellow supervisor Mark Oney, the zoning hearing board and zoning administrator Judy Acosta for all the work that went into the proposed amended Short Term Rental ordinance. She also announced that PSATS is having a fall forum on Short Term Rentals and Ms. Acosta will be a speaker at the event, because of her expertise. Attorney Gaul stated that the Lehigh Valley is also using our STR ordinance as a model ordinance. Annette Atkinson made a motion to open the public hearing at 7:20pm. Mark Oney seconded the motion. Motion passed3-0. Donna Kenderdine took a stenographic record of the public hearing. Attorney Gaul presented the township exhibits into the record. Annette Atkinson stated that a lot of public input has been received since the last STR Ordinance was passed and the supervisors listened. Mark Oney stated that the public spoke and we have incorporated what they asked and what the township wants into the proposed amended ordinance. Mike Dwyer thanked all the public that is in attendance. Mark Oney reviewed the changes for the record. Annette Atkinson made a motion to close the public hearing at 7:33pm. Mark Oney seconded the motion. Motion passed 3-0. Action on Proposed Ordinance Mark Oney made a motion to enact Ordinance 221 titled Short Term Rentals, Regarding Occupancy Limitations, Including Persons and Vehicles, and Other Miscellaneous Items, Relating to Short-Term Rental of Residential Dwelling Units. Annette Atkinson seconded the motion. Motion passed 3-0. Correspondence A thank you note from RSVP was received, thanking the supervisors and staff for a wonderful time at the Memory maker s event. 3 Mike Dwyer made a motion to approve the general fund payables in the amount of $108, Mark Oney seconded the motion. Motion passed 3-0. Mike Dwyer made a motion to approve the sewer fund payables in the amount of $58, Annette Atkinson seconded the motion. Motion passed 3-0. Mike Dwyer made a motion to approve the golf course fund payables in the amount of $17, Mark Oney seconded the motion. Motion passed 3-0. Mike Dwyer made a motion to approve the liquid fuels fund payables in the amount of $43, Annette Atkinson seconded the motion. Motion passed 3-0. Solicitors Report None Engineers Report None Old Business None New Business Proclamation Celebrating East Stroudsburg University 125 th Anniversary; Annette Atkinson made a motion to approve the East Stroudsburg University 125 th Anniversary Proclamation. Mark Oney seconded the motion. Motion passed 3-0. Authorize the Distribution of Proposed Township Local Economic Revitalization Tax Assistance ( LERTA ) Ordinance; Mike Dwyer made a motion to authorize the distribution of the proposed LERTA Ordinance to the Local Taxing Authorities in regards to the property commonly known as 119 Tom X Road (PIN ). Annette Atkinson seconded. Motion passed 3-0. Authorize and Direct the Preparation and Advertising of Bid Specifications for the Pump Station Modifications; Annette Atkinson made a motion authorizing and directing the township engineer to prepare, and the Township to advertise, bids specifications for pump station modification, with the bid opening on September 13, 2018 at 7pm. Mike Dwyer seconded the motion. Motion passed 3-0. Authorize and Direct the Preparation and Advertising of Bid Specifications for Installation of Water and Sewer Lines under State Route 209; Annette Atkinson made a motion authorizing and directing the township engineer to prepare, and the Township to advertise, bids specifications for the installation of water and sewer lines under State Route 209, with the bid opening on September 13, 2018 at 7pm. Mike Dwyer seconded the motion. Motion passed 3-0.
4 Camp Papillion Request to Waive the Echo Lake Park Rental Fees for September 16, 2018; Mike Dwyer made a motion authorizing the fee to be waived for the use of the Echo Lake Park for Camp Papillion on September 16, Mark Oney seconded the motion. Motion passed 3-0. Resolution ; Menachem M. Lipkind Joinder Deed; Mike Dwyer made a motion authorizing Resolution Mark Oney seconded the motion. Motion passed 3-0. Resolution ; Resolution opposing Pennsylvania General Assembly HB2564, Entitled the Small Wireless Facilities Deployment Bill, which Strips Municipalities of Their Zoning Rights over Wireless Facilities; Mike Dwyer made a motion to adopt Resolution Mark Oney seconded the motion. Mr. Lipkind asked for an explanation. Mr. Dwyer stated that the state is trying to take away the municipalities rights to regulate repeaters and poles. Motion passed 3-0. Authorize and Direct the Township Solicitor to Prepare an Ordinance Requiring the Installation and Maintenance of AED s; Mark Oney made a motion to authorize and direct the township solicitor to prepare an ordinance requiring the installation and maintenance of AED s in any new commercial buildings or tenant fit out with an occupancy load of more than 50. Mike Dwyer seconded the motion. Mr. Lipkind asked if there will be any exemptions. Annette Atkinson replied no. Motion passed 3-0. Public Comment Mr. Lipkind stated that he went to West End Fair and stopped by a booth that was staffed by the Monroe County Municipal Waste Authority. He told them that he was disappointed that the recycling bins were moved. They told him it was the township s fault as the township would not provide fencings and staff the site. Mike Dwyer said that was misleading. The reason for the removal of the recycling bins was due to MCMWA s inflexibility and unreasonable expectations. Statements by Jim Lambert and other MCMWA representatives to the contrary are nonsense. Mike stated that the Authority was invited to the next HOA meeting in September and someone will be there, but not Jim Lambert.
