5 TALENT RELEASE This Talent Release (the Release ) is entered into as of, 20 by [insert name of the talent s parent/legal guardian], the [mother][father][legal guardian] (the Guardian ) of [insert name of talent] (the Minor ), in favor of Donovan Fulkerson with a principal place of business at 1207 Karabella Way, Roswell, NM (the Filmmaker ). 1. PERMISSION TO MAKE AND USE RECORDINGS. For good and valuable consideration, receipt of which is hereby acknowledged and received, the Guardian grants the Filmmaker and its employees, agents, independent contractors, licensees, successors, and assigns (the Filmmaker s Agents ) permission and the full and irrevocable right to record the Minor s likeness, image, voice, appearance, and performance on film, videotape, audiotape, computer files, or other media (the Recordings ) and to use, reuse, edit, exhibit, license, distribute, and/or otherwise exploit the Recordings, in whole or in part and biographical material, for any lawful purpose whatsoever and in all forms of media now known or unknown, including, but not limited to, radio, motion pictures, Internet, etc. (the Recordings Use ). 2. RIGHTS AND OBLIGATIONS. The Guardian grants and assigns to the Filmmaker and the Filmmaker s Agents all right, title, and interest in and to the Recordings, including, but not limited to, copyright. The Guardian understands and agrees that the Recordings shall be the sole property of the Filmmaker and that neither the Guardian nor the Minor shall have any right to: (i) inspect or approve the Recordings; (ii) inspect or approve any other recordings, text, graphics, images, or other content created in connection with or combined with the Recordings; or (iii) receive any royalties or other compensation arising from or related to the Recordings Use. 3. RELEASE. The Guardian agrees to release, discharge, and hold harmless the Filmmaker and the Filmmaker s Agents from any and all damages, liabilities, costs, expenses, claims, and/or judgments of any kind or nature whatsoever arising from the Recordings Use, including, but not limited to, those based on copyright infringement, invasion of privacy, right of publicity, libel, defamation, or false light.
