3 Overview Policy Statement This section provides the administrative procedures and requirements under the Destination Maternity Testing Program. Destination Maternity is committed to delivering quality merchandise to the DM customer. These guidelines are based on the mandate that all Apparel merchandise purchased by DM must be tested to meet all applicable laws and regulatory requirements, in addition to ensuring compliance with DM customer satisfaction and acceptability. Performance Standards Destination Maternity performance standards are used as a guideline for the evaluation of DM Apparel product acceptability. Most test methods and test procedures are originated from: ASTM (American Society of Testing and Materials) AATCC (American Association of Textile Chemists and Colorists) ISO (International Organization for Standardization) CPSC (Consumer Product Safety Commission) FTC (Federal Trade Commission) California Proposition 65 US State Regulations Testing Requirements All apparel produced for Destination Maternity is required to be tested under the DM Testing program guidelines to ensure DM quality and performance expectations are fully met in time for production. Vendors should be aware of the quality expectation levels prior to negotiating prices, pricing commitments and order agreements. Over testing is highly discouraged as it increases the garment cost brought back to DM. Every effort should be made to ensure that the DM testing guidelines are well understood and adhered to so that proper consolidation and cost of testing per style or program of styles is determined properly prior to purchase order confirmation. Failure to properly consolidate testing will result in the testing overcharge assessed and DM garment cost adjusted on purchase order. Any overcharge assessed after shipping will be incurred by the vendor via an off- set expense for the overcharged amount.. Page 1

4 Regulatory Requirements and Consumer Product Safety FTC Labeling Requirements Destination Maternity vendors are responsible for ensuring that products produced for DM comply with applicable laws and regulations governing packaging and product labeling. Applicable laws and regulations include but are not limited to the following: Country of Origin Labeling Textile Fibers Products Identification Act Wool Products Labeling Act Fair Packaging and Labeling Act Uniform Packaging and Labeling Regulation Uniform Packaging and Labeling Regulation and Uniform Label Laws. In addition to the above, all labeling must also comply with current U.S. Federal Trade Commission (FTC) requirements and with all U.S. Customs Service regulations. It is the responsibility of the vendor to understand and apply all labeling rules and requirements. 5 Certified Testing Lab Certified Testing Lab To streamline the communication and clarity of the Destination Maternity Testing Program as well as ensure the best technical and customer service to DM and its Vendors, the following Testing Lab is the only Certified Testing under the Destination Maternity Apparel Testing program: Unless otherwise specified ALL testing for DM is to be performed at Intertek Testing Lab as per the DM Testing Program Guidance. The DM Testing program is managed between the US and HK Intertek offices in conjunction with the Destination Maternity Testing Team located at the DM corporate office. Intertek Program Managers will ensure DM Vendors and all global lab locations are working in unison within the testing program guidance for all testing submitted on DM s behalf. *Failure to use the DM Certified testing lab will result in the total cost of testing to be deducted from the Garment Cost confirmed on the DM Purchase order. Contact Information Intertek Contact information is provided in the Forms Download Link on the Vendor Manual Dashboard, Vendors should review: Intertek Global Lab Locations Destination Maternity Test Request form (TRF) *this is the only testing form that may be submitted to the lab for testing on behalf of Destination Maternity. *Submission using any other form is not permitted and will result in testing hold/delays and Vendor is responsible to rectify immediately. Sample Collection Center Vendors manufacturing DM styles in the USA must use Intertek Korea Lab in lieu of testing at the Intertek Lab located in USA (Illinois) as cost of testing in the USA would be price prohibitive. The ITS Sample Collection Center in Los Angeles, CA will accommodate all DM Vendors and they will expedite fabric/garments to the Korea Lab on behalf of DM Vendors: Vendors in the LA area call ITS directly for a sample Pick-Up. Vendors outside the LA area can mail samples directly to the ITS Sample Collection Center in Los Angeles, CA. *Sending Details are outlined in the Global Testing Program 2017 Document accessible in the Forms Download Link and *Vendors must download all additional testing forms from the Forms Download Link, on the Vendor Manual Dashboard, SECTION 7 FORMS. 6 Testing Program The Destination Maternity Testing Program updates for 2017 encompass a more streamlined version of the current testing program. Testing s is Mandatory for ALL Brands except for Pea Collection. Methods are the same (AATCC/ASTM), however test menus are consolidated down to 4 core test menus that are now referred to as Test Protocols. In addition, updated fiber content method, expanded sample plans, price lists, additional testing guidance, Coded Care System and Testing Consolidation Planning is included for best understanding of program requirements. Highlights Destination Maternity styles must test under the Global Testing Program This core Testing Program guidance includes all tests, test methods, testing requirements, discounted pricing, required sampling plan and testing turn time in a consolidated document: One Global Testing Program with consolidated Test Protocols. One Lab/ One Test Request Form (TRF) AZO Dye Testing Required on Darkest Color Only Coded Care System Fiber Content Test Method changed from AATCC 20A to ISO 1833 Within the updated Testing Program are the following Test Protocols: KNIT WOVEN NURSING BRA SWIM Testing is performed on Bulk Quality Fabric (Fabric Test & Additional Color Test) and Production Quality Garments (Garment test). Exceptions that require testing in Garment Form Only are: Sweaters Denim Garment / Pigment Dye styles/special Wet Processing Knit Burn Out Styles *In addition to the above there is still a ZIPPER Test Protocol available, for Vendors who cannot secure a DM preferred Vendor Zipper (YKK, Talon or Ideal) for production. **This should be the exception not the rule. Test Protocols include the following: Test Name, Method & Requirement for Fabric, Additional Color & Garment Testing Additional Notes/Guidance Sample Plan Price List Consolidation Plan (details how to consolidate testing properly) Sample Collection Center address in Los Angeles for Vendors manufacturing in the USA. 7 Testing Program Guidance Testing Procedures: The Destination Maternity Global Testing Program requires the following procedures to be adhered to always. Failure to follow the Testing Program Guidance outlined below is not acceptable and will result in delays to the testing cycle and will be considered non-compliance. Destination Maternity Vendors are NOT permitted to customize or change any of the DM Test Protocols. However, Vendors are permitted to run individual testing, as needed, to confirm or deny specific test results as directed by Destination Maternity or to re-test specific test failures during preliminary and production testing processes. NOTE: Any deviation to the above testing requirements requires the permission of the Destination Maternity Testing Team in advance of testing. Contact: Claims Any claims made on a product i.e. Branded Fiber, Fabric Properties (weight, stitch count etc.) Special finishes (Crinkle, Resin Treatments, Water resistance etc.) Appropriate tests will automatically be applied for substantiation purposes and these tests will also be billed outside the DM package Price. New Styles / Program of Styles New styles or programs (multiple styles in the same fabrication) must be fully tested under the appropriated Destination Maternity Test Package(s) and include all compulsory testing i.e.: Fabric, Add Color, and Garment testing per style. For Program testing that encompasses multiple styles- Jackets and pants are always tested. For a program of like items, test the most constructed style (one or two) in the program (lined, embellished, trimmed etc.) that best represent all like styles construction as representative of all. Re-Orders & On-Going Programs Re-orders shipping more than 1 year past a previous PO/Shipment must be tested as a NEW program under the appropriate Destination Maternity Test package(s). This means new Fabric test, add color test and garment testing as well as an updated CLL (Care Label Layout) is required. Re-orders shipping less than 6 months from a previous PO/Shipment must be tested as a NEW program if any element of the order has changed, this includes: new factory, supplier, spinning, dyeing, weaving, knitting, finishing, garment construction or the addition of any embellishment/trim/heat seal/screen print/decoration. This means new fabric, additional Colorway(s) and Garment tests as well as updated CLL (Care Label Layout) are required Additional Colors Additional Colors on order per style or program of styles must be tested for Colorfastness and PH Value. When testing additional colorways, testing must be submitted at the same time as the Fabric Testing so that the care label approval can be confirmed for ALL colors on order - NO exceptions. Page 5

8 Testing Program Guidance Styles / Programs with more than 3 colors on order do not require all colors to be tested as this is cost prohibitive - vendors must choose the best Light, Medium and Dark color way to test as representative of all additional colorways. Vendors will be held responsible to ensure that colorfastness achieved for the colors tested, is achieved on all colors in production. When choosing the Light color to be tested DO NOT choose white whites DO NOT require Additional Color Testing. Vendors must reference the Additional Color Test Protocol. New Colors All new colors adopted must be tested for Colorfastness & PH Value. Vendors are responsible to expedite this testing automatically upon lab dip approval and in time for delivery of the new colorway. Vendors must reference the appropriate Additional Color Test Protocol. Swimwear New Colors All new swimwear colors adopted must be dunk tested by the vendor at bulk fabric/color approval stage, after fabric quality is approved by DM and when bulk yardage is secured for testing and sampling. 1/2 yard of each color on order (per style) should be dunk tested. Yardage for dunk testing should be tested by factory and internal results and digital photos should be recorded on the attached DM spread sheet. Internal dunk test spreadsheet results should be provided to Testing Team with Testing Package at Care Label review/approval stage. Care labels will not be approved without internal dunk test results. Greige Fabric Commitments Greige fabric commitments are subject to completion of lab testing. All new fabric adoptions should be preliminarily tested in fabric form on available colors (Bright or dark colors unless only light colors will be used in bulk) to establish acceptable DM performance on the fabric prior to fabric adoption. This preliminary testing may not be used in place of the required pre-production testing submitted for care label approval and should not be submitted as such. Re-Tests Fabric, or garments tested that have critical failures to DM performance standards and CANNOT be corrected in time for production require review and disposition from DM testing and sourcing teams. 9 Testing Program Guidance Fabrics that CAN be corrected in time for production require the vendor to expedite corrective action automatically and to provide a Re-Test for passing results prior to Pre-Pro Submittal to DM. The Cost of Re-Tests are the sole responsibility of the vendor and may not be built into the garment cost brought to DM. Wet Processing (Garment Dye, Pigment Dye, Overdyed, Tie Dye, Dip Dye, Etc.): Specialty dye styles such as Garment Dye, Pigment Dye, Overdyed, Dip Dye, Tie Dye etc. require testing to be performed in GARMENT form only. Garments must be production quality/color/finish/construction exactly as bulk production. No Exceptions. Colorfastness to laundering and crocking standards published for wet processed styles must be adhered to for production. Styles that do not meet these standards are subject to review and or cancellation. Appearance to Laundering is required on all colorways, in production quality garment form no exceptions. NOTE: Care Labels must not be inserted into garments that will be washed or garment dyed until after the processing has been completed. The main brand /coo labels may be inserted into the garments prior to processing only if the process WILL NOT discolor or otherwise damage the appearance of the label. If the main label will be affected by the treatment, it must be applied again after the final processing. Denim & Sweater Styles Denim and Sweater styles require testing to be performed in GARMENT form only. Garments must be production quality/color/finish/construction exactly as bulk production. No Exceptions. Ongoing Denim styles must be tested internally by factory quarterly to ensure on-going purchase orders colorfastness (CF to wash & crocking) is matching the annual ITS test report. Deviations in production are not permitted and all internal factory data must be available to DM upon request. Styles with Belts/Trim/Embellishment Styles with Belts (Metal/Plastic/Faux Leather), Trim/Decoration/Embellishment etc. will be automatically be evaluated for mandatory state regulations including but not limited to California Prop 65, CPSC, and Illinois Lead Prevention Act. Styles with Heat Seals Styles with heat seals must have the heat seal applied to a fabric panel in lei of a sample (bulk production quality fabric panel and heat seal application) and tested at Fabric Testing Stage to ensure there is ample time to correct heat seal applications that do not pass appearance to laundering and dry clean. Fabric panel minimum size is 12x12 For color, specific heat seals (contrasting color heat seals per colorway) fabric panels submitted must be representative of each bulk production color combination to ensure passing results for appearance to laundering and dry clean. 10 Testing Program Guidance Styles with Screen Prints Styles with screen printing, the inks are required to be lead and cadmium free. Vendors are responsible to provide proof of Lead / Cadmium free inks. Acceptable forms of proof are a COC (Certificate of Conformity) from ink supplier and/or third-party testing from a certified independent lab. All proof documents must be dated the current year expired documentation will not be accepted. If vendor cannot provide this proof, Lead and Cadmium testing will be run at the vendor s expense and may not be built into the cost of garments. Styles with screen prints must have the screen print applied to a fabric panel in lieu of a sample (bulk production quality fabric panel and screen print application) and tested at Fabric Testing Stage to ensure there is ample time to correct screen print applications that do not pass appearance to laundering and dry clean. Fabric panel minimum size is 12x12 dependent on-screen print size. For programs with different screen prints per colorway, fabric panels submitted may be consolidated to be representative of each bulk production color combination to ensure passing results for appearance to laundering and dry clean for each colorway. Vendors should carefully choose the screen prints that represent all. For Team Screen Prints (MLB, NFL) if 3 rd party COC/Test report is not available, screen prints should be consolidated to reduce the cost of testing. Vendor is responsible to choose the appropriate number of team screen prints that represents all colors for all screen prints for each of the teams. Only these specific screen prints will be tested for Lead, Cadmium and appearance to laundering. Vendors should prepare fabric panels to represent the team screen prints that match the consolidation plan. Styles with Secret Fit Belly Styles with a secret fit belly DO NOT require separate testing for the SFB tubes. DM manages the SFB testing annually with the SFB supplier. Upon placing orders with SFB Supplier, Vendors should request Fiber Content Information from the supplier to accurately capture for Care Labeling purposes. Vendors many also request the SFB Test Report. DM will have annual SFB testing on file - Vendors DO NOT need to submit our SFB Test Report back to us during testing approval. The SFB provides a maternity function and the SFB fiber content will need to be disclosed on the care label. Styles with Cotton/Spandex Maternity Mid-Belly/Under-Belly/Fold-Over Belly Styles with a cotton / spandex jersey or interlock belly (Under, Mid Belly) DOES require a separate fabric test for the belly fabric as it provides a maternity function and the Belly s Fiber Content will need to be disclosed on the care label. Belly fabric yardage should be provided at the same time as Self Fabric and Additional Colors Fabric at Fabric Testing Stage. Page 8

11 Testing Program Guidance Styles with Combo Fabrics (Including Linings) Styles with a combo fabric or linings that cover 15% or more of the total body of the style requires separate fabric testing on the combo or lining fabric. Combo or Lining fabric should be provided at the same time as Self Fabric and Additional Colors Fabric at Fabric Testing Stage. Styles with multiple combo fabrics stitched together that make up the self-fabrication the style must be tested in GARMENT form only no exceptions. Bra Styles Engineered Bras must have all shell, wing, lining fabrics fully tested This means the outer bra shell fabric, Cup lining fabric, Nursling Sling Lining and Wing fabrics will each require a full fabric test per style or program of styles. Molded cups do not require any separate testing however production cups must be exhibited in bra samples at garment testing stage no exceptions Lace trimmings, and combo fabrics not used for functionality do not require separate full fabric testing or Fiber Content testing. They will be disclosed as Exclusive of Trim or Decoration. Nursing Styles Nursing styles require CF to saliva testing. Color Fastness to Saliva will automatically be tested on all nursing products to ensure there is no color transfer of dyestuffs from the apparel to baby when nursing. Failing CF to saliva results are not acceptable and waivers will not be issued no exceptions. Fully Lined and Active Styles Fully lined and active styles require Colorfastness to Perspiration testing. Color Fastness to Perspiration will automatically be tested to ensure there is no color transfer from the apparel onto skin. Failing CF to Perspiration results are not acceptable and waivers will not be issued no exception. 2pc/3pc Sets A set is defined as 2 or 3 distinct pieces sold together as one item with one style number and one price. Each fabric and garment that make up the set must be fully tested unless all pieces of the set are using the same base fabric /fiber content. No matter if the set pieces are connected by a loop and snap, are permanently stitched at join point OR the pieces are fully detachable (attached by swiftack) each piece of the set requires its own care label. For sets that encompass distinctly different fabrication/fiber content per piece each piece of the set requires its own unique fiber content and Coded Care Instructions determined by testing. In cases where the pieces are all the same fabric/fiber content then all pieces can share the same fiber content and Coded Care Instructions if no piece in the set requires additional care or data based on embellishment or trim. Sets that are fully detachable may not share Fiber/Coded Care instructions unless they are made of identical fabric, fiber content & construction. Page 9

12 Testing Program Guidance Flammability Requirements Destination Maternity does NOT permit the use of Class 2 or Class 3 flammability for its apparel fabrics. Only Class 1 fabrics will be permitted for DM Production. Vendors must ensure that fabric used meets the flammability requirements and cooperate with any product recalls or withdrawals from the marketplace due to non-compliant goods Flame retardant finishes are not permitted. All fabrics tested for DM will be evaluated for Flammability, however only suspect fabrics will be tested for flammability. An exemption notice will be issued within all DM Test reports for fabrics that are exempt from flammability testing. A flammability COC (certificate of Compliance) will automatically be included in every Destination Maternity test report that is run at DM certified lab. Fabrics that FAIL Class 1 flammability are subject to immediate cancelation no exceptions. AZO DYE Requirements AZO Dye testing or proof of AZO Free Dyes is required on all DM apparel products - no exceptions. Destination Maternity does not permit Care Label Approval on fabrics that fail outside the DM requirement for AZO Dye Colorants: none detected up to 20 ppm. AZO Dye testing is performed on the darkest color on order. If the darkest color passes, this testing will be representative of all colorways and no further AZO dye testing will be required on additional colorways. If AZO testing fails on darkest color on order, fabric must be corrected & retested in time for production. In addition, all colorways on order will be subject to AZO Dye testing. The cost of the additional AZO dye testing that resulted from initial failing test results will be at the vendor s expense and may not be built into the testing cost built into the garment cost. All colors except White require testing for AZO Dye Colorants. Formaldehyde Requirements Formaldehyde may cause an allergic reaction. Formaldehyde content for Maternity Apparel must be less than 75ppm. Destination Maternity does not permit Care Label Approval on fabrics that fail outside the DM requirement for Formaldehyde: none detected up to 75 ppm. Formaldehyde that exceeds the standard above is considered carcinogenic and failing Formaldehyde test results are not acceptable and waivers will not be issued No exceptions. Nickel Requirements Nickel may cause an allergic reaction when in direct contact with skin. Nickel requirement for Maternity Apparel must be Nickel Free (Max 0.5 ug. /cm sq.) Metal trim, components on Destination Maternity Apparel must pass DM standard above. Nickel Leaching that exceeds the DM standard are not acceptable and waivers will not be issued NO exceptions. 13 Testing Program Guidance Phthalates Requirements Certain phthalates (Chemicals commonly used to make vinyl plastic known as polyvinyl chloride or PVC) are hazardous to reproduction and development and may cause negative health effects. All Maternity Apparel will be automatically evaluated for Phthalates testing requirements. If the end use of the product requires Phthalates testing, this testing will be applied automatically and billed outside the test package price. Page 11

14 Labeling and Care Instructions Destination Maternity Vendors are responsible for compliant and legal labeling and packaging for the apparel products they produce for DM. The regulations and guidelines for labeling are very detailed, therefore it is important for vendors to be highly proficient regarding the FTC labeling guidelines. Textile labeling information can be found at the FTC (Federal Trade Commission Textile and Wool act) website: Please Click the Link to access the FTC website at: Labeling Regulations The country of origin (COO) must be displayed on a permanent label in the CB neck or CB waistband of the garment. If product has a non-fabric belt (Faux Leather, Metal Chain type or Non-Fabric Material) COO marking must be permanently stamped or attached (bondable label or sewn hangtag) Fiber content must be displayed by generic name (i.e..: cotton, nylon, rayon, etc.) Each fiber present in the amount of five (5) percent or more of the garment must be declared as a percentage of the total fiber weight of the product. Fiber Percentages must be listed in descending order. Sectional Fiber Disclosure is required for the following: Items having combo fabrics differing in fiber content i.e..: Sleeve fabric is different than body fabric each sections fiber content must be declared on the label. Styles with filling (example; down or poly filled outerwear). Filling must be tested, and material content must be declared on the label. Style with Secret Fit Belly (SFB): The SFB is maternity specific function and fiber must be declared on the care label. All labels must display the correct RN identification number: RN# for all DM product. All Labels must display the correct CA identification number: CA# for all DM Product. Garment care labels must be permanently attached and can withstand 10 launderings or the useful life of the product, whichever is less. The label, the care and any additional written information must remain legible for this length of time. Care label must be sewn in permanently and must comply with regulations. For packaged product, if care label is not visible through packaging, the care instructions must be repeated on the packaging. Care symbols are required on all care labels. Because Destination Maternity sells product internationally, 5 care symbols are required on all care labels: Washing, Bleaching, Drying, Ironing and Dry Cleaning - NO EXCEPTIONS. All belts require Country of Origin (Tri-Lingual) marking permanently stamped (non-fabric belts) or attached (bondable label or sewn hangtag). *No Exceptions Page 12

15 Labeling and Care Instructions Brand / Country of Origin / Size Label Requirements Destination Maternity Brand /Country of Origin (COO)/SIZE labels are woven and color matched. The COO/SIZE label must be permanently attached to the bottom of all DM Brand Labels. COO & SIZE information must be exhibited in Tri-Lingual Language: English/French (CAN)/Spanish (MEX) no exceptions All garments shipping to Destination Maternity must have the appropriate Woven Brand & COO/SIZE Label or Heat Seal equivalent exhibited in the center back neck or waistband of the garment. For 2, 3 or 4pc Sets EACH PIECE of the set also requires full labeling: DM Brand & COO/SIZE label or Heat Seal equivalent (CB Neck or CB Waist mandatory). Care Label inside side seam (placement standard unless otherwise directed by Tech). *The care label requires the words 2pc set OR 3pc set on front care label. Label Placements will be advised by Technical Designer per style within all DM Tech Packs. *NOTE: Dependent on Brand Label Design COO and Size can be exhibited vertically or horizontally, and DM approved artwork should always be followed. 16 Labeling and Care Instructions Standard Care Label Requirements Destination Maternity Care labels are made of a DM approved quality white recycled double-sided poly satin slit edge printable material. Care instructions are printed on BOTH sides of care label and the required dimension are: 38mm Wide x 95mm Long (95mm includes 10mm sew space). Please note the following: DM Recycled satin quality is widely available globally and Vendors are required to locally source and print our care labels. To ensure care labels are as identical as possible New Vendors will be provided with DM Care Label Quality Sample and will be required to source an appropriate quality match for submission to the DM Testing Team for a One-Time Approval before producing any care labels for production. All Care Label data (front & back) must be exhibited in full Tri Lingual Language: English/French (CAN)/Spanish (MEX) No Exceptions. For International orders shipping to Israel care labels are Hebrew Language Only. Protective wording is the only wording listed out in English, French and Spanish. Heat seals are branded with DM Brand and include COO, Size, & Color # they are essentially an all in one label covering the Brand, Country of Origin, Size and Care Instructions requirements. DM Heat Seal Artwork must be followed always. DM Artwork is located within the Vendor BOM in DeSL tech pack. *If artwork is missing contact the appropriate Product Manager. Vendors must locally source and produce heat seals based on the DM artwork provided. Vendors must first approve their artwork draft with their supplier to ensure it matches the DM artwork exactly. Vendors must NOT submit artwork draft to Testing Team for care approval. The artwork must be fully approved between the Vendor and their local supplier before submitting Testing Package with heat seal care label layout to testing team for care approval. 21 Labeling and Care Instructions Care Instructions To streamline care approvals and improve care accuracy, Destination Maternity has a Coded Care System. The appropriate DM care code to be used for Testing will be exhibited within the DeSL system, initially in the Vendor BOM tab within the Tech Pack per style. *The appropriate coded care is assigned by DM based on the Vendors FDS submitted. * See below how Coded Care Looks in DeSL: Vendors may not deviate from the DM care code provided to them. To help ensure accuracy at the lab, vendors are required to indicate the DM care code from DeSL and choose the same code on the DM Test Request Form (TRF) submitted to the lab. Vendors must accurately cross reference care code and choose the correct one. Incorrect care codes will be subject to automatic revision by DM Testing Lab. In cases where fabric or color way fails a coded care instruction, DM lab test report will confirm the recommended DM coded care instruction based on the fabric and color way test reporting. DM Recommended Care Instructions List is included in the Global Testing Program Document accessible in the Forms Download Link, on the Vendor Manual Dashboard, SECTION 7 FORMS. Page 19

22 Laboratory Testing Laboratory testing is a key milestone at pre-production stage. Vendors are required to make their fabric mills aware of Destination Maternity fabric standards and fabric mills are to ensure that the fabric meets the standards and the bulk reference approved before producing bulk quality fabric for testing or production. The mill cannot ship substandard fabric to the Factory without the express approval of DM testing and sourcing teams. For testing that fails the DM Coded Care Proposed, an appropriate DM Coded Care will be advised, OR a dialog will be initiated regarding a corrective action required dependent on testing failures. Vendor is required to resolve any quality issues before Fit Approval Stage is completed. Re-testing may be required to confirm corrective action achieves DM standard required. In cases where the same fabrication is used for multiple styles with different delivery dates, the styles with the first deliveries will be submitted for full fabric and garment testing on the most constructed style. Styles with subsequent deliveries will be tested to additional color test packages only. Vendors may only submit testing to DM Certified Testing Lab (Intertek) on DM Testing Forms. Vendors must adhere to sample plans to prevent testing delays. DM Coded Care Label approval is based on bulk Fabric, Additional Color and Trim Testing. Timing requirements are listed below. Timing Requirements Preliminary Testing (Dev. Stage): Preliminary testing may be required dependent on fabric / construction concerns and this testing must be performed between 1 st & 2 nd fit stage when Vendors have bulk production quality fabric available for fit/photo samples and testing (either in fabric or garment form dependent on concern). The Testing Team or Product Development Team will trigger the need for preliminary testing. Pre-Production Testing stage: At the same time the last Fit Sample is submitted to the Technical Designer for approval, Fabric Test(s), Additional Color Test(s) and Trim Test(s) (If applicable) should be submitted to the lab for full testing to confirm DM Coded Care Assigned is acceptable. Production Testing stage: At the same time the PP Sample is sent to the Technical Design Team for approval, 5 production quality PP Samples should be sent to the lab for Garment Testing to confirm finished garments conform to the Approved DM Coded Care Label. *Vendors must build their testing Time and Action appropriately to support the above Testing Submittal Timing. 23 Testing Submission and Care Label Approval Testing Submission to DM Testing Team: Pre-Production Stage Complete below within 5 BUSINESS DAYS after Fit Approval Date: 1. Vendor Submits DM Testing Package to Testing Team: Fabric Test/Add Color Tests/Trim Tests (if applicable) and Coded Care Label Layout Form (CLL) via to Testing Associate. 2. DM reviews/approves DM Coded Care Instructions for printing. Regular Turn Time: a) 3-4 working days. b) Dec-Jan (prior to Chinese New Year) 4-5 working days dependent on volume. 3. Testing comments and disposition are shared with Vendors in the DeSL system; Testing Details Tab of the appropriate Tech Pack. Please note the following: 4. TESTING REJECTED: *Critical failures at Pre-Production stage requires review and disposition by DM Testing and Sourcing Teams & Vendors will be required to perform corrective action and re-test to passing or style may be subject to cancellation. 5. TESTING APPROVED: Vendors print care labels. *Vendors who fail to print Care Label after approval/in time for production do so at their own risk and are solely responsible to make up lost production time to maintain agreed upon delivery. Testing Submission to DM Testing Team: Production Stage Complete below within 5 BUSSINESS DAYS after Pre-Pro Approval Date/or 60 days prior to FF date whichever occurs first: 1. Vendor Submits Garment Test Report via to Testing Associate 2. DM Testing Team will confirm the Garment Test conforms to DM Coded Care Label approved at Pre-Production Stage. Confirmation will be shared in the DeSL System; Testing Details Tab of the appropriate Tech Pack. *Critical Failures at Production Stage Garment Testing should be the exception not the rule. Garment tests that fail and require Coded Care Label changes, the Vendor is responsible to re-print care labels in time for production without disruption to delivery date. NOTE: Vendors cannot complete the Garment Classification Process (WAG) and Automated Commercial Invoice (ACI) in the DM system without completed testing process. WAG requires Vendors to input their test reports for fabric properties, end use and fiber content by style and color-way. For the ACI Process the DM system requires inputting of all test report information per style, fabrication and color. *Vendors should refer to (WAG) Garment Classification (WAG) / ACI Automated Commercial Invoice Web Procedures Training Guide Document located in the Forms download Link, on the Vendor Manual Dashboard, SECTION 9 FORMS. *Vendors who are not required to submit an ACI (DDP shipments) are NOT EXEMPT from the above requirements and must follow the above testing submission guidelines and timing as Vendors importing and submitting ACI. 24 Warning Hang Tag Warning / Specialty Dye Hang Tag Requirements The following product or wet processing requires a specialty warning hang tag to warn against color fading, color transfer or how to best maintain color: Dark Denim: Indigo dye, Black Over dye Tie Dye, Dip Dye, Hand Ikat, Pigment, Pigment prints, Circular Screen Prints or Neon Pigment Dye The need for the Warning Hang Tag will be communicated to Vendors, by the Testing Team, in the DeSL Tech Pack (Testing Details Tab & Testing Comments). The Warning Hangtag should be locally sourced and produced by Vendor Suppliers exactly following DM artwork provided in the Vendor Bill of Materials (BOM) tab of the DeSL Tech Pack. 25 Price Tickets / Stickers Price Ticket Requirements Vendors must order price tickets from DM Nominated supplier unless otherwise instructed by DM. Tickets are a 12pt. white matte cardstock with black text data and has perforation below the barcode. Please note the following requirements: Size: 1 ½ W X 2 5/8 L. Font is called Bold for Paxar printers ONLY, if another type of printer is being used to print the tickets, the most similar font to bold must be used DM Price Ticket component number, artwork image is included in the DeSL System, Vendor Bill of Materials (BOM). The Price ticket contains a barcode. The bar code data is transmitted to vendors electronically 60 days prior to Delivery Date. Vendors will receive a delimited tab file. *See details on following page. For all 2 or 3 Piece Sets, the PRIMARY item must include the main price ticket. The second and/or third piece of the set requires an additional price ticket the following: Identical PO/Style/Color/Size/Collection data as primary price ticket 2 pc Set or 3 pc set [whichever is applicable to style] NO PRICE / NO BARCODE *See examples on following page In no instance, should any other ticket attach to the DM product. This includes Vendor price/sku tickets before shipment Vendors must always follow ticket placement advised in DeSL Tech Packs. Price Sticker Requirements Vendors may locally source DM Price stickers unless otherwise instructed by DM. Price Stickers are used for Accessory product and are white gum sticker with black text data. Please note the following requirements: Size: 1 ½ W X 1 ½ L. Stickers are used for accessory product Font is identical to Price Tickets Price Sticker is attached to the product in the location designated by the Packaging approved for the product. If unsure of placement on product you must contact the Merchant responsible. Vendors are responsible for verifying ticket / sticker information and ensuring damage free placement. NOTE: The proper price ticket or sticker must be on the proper product. Altering a price ticket or sticker is not acceptable since the information will not match the barcode. This is a delimited file. Each delimited field position represents a specific piece of information used in the file. If a field is empty, then there is no data for that field for the style specific price ticket. The file will usually contain more than 1-line item. Each line item represents ticket data for a specific inventory item. Vendors are responsible to adhere and comply with the guidance in each tech pack: The following is exhibited on all price ticket placement sketches: Placement alone or with other marketing hang tags (when applicable) Placement for 2 and 3-piece sets (when applicable) Swift tack requirements for length & color Special Length of swift tack (when applicable) Extra Button/trim/yarn bag or button placement (when applicable) Special Considerations Always use the smallest needle possible in barb gun to minimize chance of damaging the fabric. Decorative safety pin attachment is NOT PERMITTED in lieu of swift tack. Price Tickets should always be Face Up and easily seen / located in final poly bag received at DM Distribution Center. Vendors are permitted to source the below standard type Hygienic Protection Sticker from a reliable Vendor supplier. Vendors are responsible to ensure DM production complies and that the hygienic panty liner adhesive strength is checked to ensure appropriate bonding and removal for swim apparel fabrics. 33 Market Vendor-Bought Off-Line Requirements Destination Maternity styles sourced and purchased directly by the DM Merchant team instead of the Sourcing team are considered Market Vendor-Bought Off-Line Styles. These styles are predominantly A Pea in the Pod styles, however they may be purchased for any DM Brand [Motherhood, MIMI or JS]. Market Vendor-Bought Off-Line Styles are defined as having exclusively only Vendors Branding, marketing, labeling and sizing. In some cases, dependent on the brands fit/sizing the Merchant may designate that DM will be adjusting the fit or specs to be closer to the DM standard sizing. A Market Vendor -Bought Off Line style should never exhibit any Destination Maternity Branding no matter what DM Brand style is assigned to. Testing Market Vendor-Bought Off-Line Styles DO NOT require testing under the DM Global Testing program however Vendors are expected to have robust testing and quality control systems in place throughout their own supply chains and to ensure that proof of care labeling, quality, regulatory tests, fiber content and country of origin diligence is available to DM upon request. Examples of acceptable documentation are 3 rd. party test reports from an accredited lab, Certificates of Conformity and BOL. DM reserves the right to request testing and COO documents at any time as deemed necessary. *NOTE EXCEPTION: Vendors shipping FOB/FCA will be required to provide their test reports for uploading into DM web portal system at time of WAG [Garment Classification process with DM Customs Compliance Team]. *Vendors cannot ship without test report proof. Branding, Marketing & Labeling DM understands that Market Vendor-Bought Off-Line Styles have their own standards for product branding, labeling, ticketing and packaging that is unique to the Vendor/Brand we are purchasing from. All Vendor branding/marketing/labeling must be agreed upon by DM Merchant. No matter what the styles branding, marketing and labeling all must be compliant to FTC labeling guidelines and be compliant to be sold in the US / Canada and cannot ship into DM without the following: 1. Brand/COO/Size Label: Placement at CB neck or CB Waist *In cases where a Vendors Branding DOES NOT include a permanently attached woven and color matched Country of Origin label and the Country of Origin only resides on the Vendors care label the care label placement must be shifted to the CB neck or CB waist OR a separate Country of Origin label must be created and sewn into the CB neck or CB waist for DM styles. 2. Care Label: Permanently attached in a conspicuous location inside garment. Must include: English and French Language, Fiber Content, COO, Care Instructions, RN#, CA#: a. If vendors DO NOT have an RN # they may print Destination Maternity RN#79913 OR print their Company Name & Address on the care label. -If vendors DO NOT have a CA# they may print Destination Maternity CA# b. If vendors DO NOT have a CA# they may print Destination Maternity CA# Marketing Hangtags or other: Permitted with review / approval from Merchant 4. Price Ticket: Vendors must confirm with Buyer if DM price ticket is required or if Vendor Price Ticket. Page 31

34 Market Vendor-Bought Off-Line Requirements *For Styles that are not compliant for selling in CANADA, Vendor must alert Merchant to ensure Purchase Order is for USA only. *In these cases, an English only product will be accepted for sale in US. Flat Pack in Polybag Market Vendor-Bought Off-Line Styles must be shipped as all other DM apparel styles; folded and flat packed in a clear poly bag with a tri-lingual suffocation warning that follows the guidance in SECTION 10 CARTON & PACKING REQUIREMENTS. DM will allow Vendors own standard flat folding methods if it does not distort or damage the product in transit or at point of sale and if the flat packed product in polybag meets the DM min/max dimensions that fit our sorting equipment. Vendors must adhere to SECTION 10 CARTON & PACKING REQUIREMENTS and reach out to Merchant with any concerns prior to shipping into DM DC. *NOTE: Market Vendor-Bought Off-Line Styles that are Bras Vendor must ship bra on a clear hanger flat packed in Poly bag. DM will not provide a nominated hanger supplier for these styles and the Vendor must review their standard hanger quality with DM Merchant for approval prior to shipping. As with all DM flat packed merchandise the product inside the polybag must fit the size of the polybag without excess space around the perimeter of the product bras are no exception and must fit properly and meet he min/max requirements listed in SECTION 10 CARTON & PACKING REQUIREMENTS. Cartons/Carton Labeling Vendors must not assume their standard packing of product in carton, carton dimensions, specs and quality as well as outer carton labeling will work well or align with DM Distribution Center Automation or receiving requirements - Vendors must follow SECTION 10 CARTON & PACKING REQUIREMENTS and work directly with the Merchant to confirm and approve all the following: 1. Carton Packing can meet DM Requirement 2. Carton dimensions, quality, wall strength, weight, burst etc. can meet DM Requirements 3. Carton labeling can meet DM requirements *In cases where a vendor is shipping an odd sized product or has an issue they must undergo a pack ship review with Merchant and DM Distribution Center Supervisor before anything can be shipped into DM DC. In addition to all of the above Vendors must ultimately follow all applicable requirements listed in the Vendor Manual to prevent Non-Compliance Charges. While we understand we are purchasing a Vendor Branded product that has its own unique Branding, Marketing and Labeling it is very important that Vendors work directly with Merchant and DM DC [when necessary] to ensure compliance to packing/shipping/ticketing/quality etc. adheres to DM requirements. All concerns or questions must be reviewed with DM Merchant at the outset of the order to prevent non-compliance charges. In addition to this the following sections are especially critical to comply to: SECTION 1 VENDOR ONBOARDING & CERTIFICATION SECTION 6 TECHNICAL DESIGN SAMPLE AND FIT REQUIREMENTS SECTION 7 TESTING-LABELING-PRODUCT SECTION 8 QUALITY ASSURANCE REQUIREMENTS SECTION 9 LOGISTICS SECTION 10 CARTON & PACKING REQUIREMENTS Page 32

35 Requirements Applicable to All International Product Brand/Country of Origin/Size Labeling All product with International purchase orders, no matter country destination, will have the same Destination Maternity Brand and Country of Origin/Size labeling as the USA master purchase orders. Garments will exhibit either the DM Main Woven Label or matching Woven COO (Country of Origin / Size Label OR a DM Brand/COO/Size Heat Seal exhibited in the CB neck, CB waist of all garments (Bras will be exhibited in the wing). All Product will have the approved DM Tri Lingual Coded Care Label. Page 33

36 Requirements Applicable to All International Product Testing Requirements There are no additional testing requirements for Destination Maternity International Partners. International & Canada Purchase orders will reference the USA Purchase Order Style s full testing package per style. Full Test packages for USA/CAN styles that have International Purchase Orders should include the standard DM testing, run under the Destination Maternity Testing Program as follows: Fabric Test: darkest color on order. Garment Test: darkest color on order Additional Color Test: each additional color on order (Med & Lightest colors to represent all) Required Regulatory Testing: California Prop 65, Toxics in Packaging, State Regulations (Lead, Cadmium, Nickel, Phthalates etc.) *testing dependent on product construction (trims/embellishment/fabrication etc.) DM Coded Care Label (Tri-Lingual) approved by the Testing Tam In addition to the above styles with International Purchase Orders for Israel Vendors are NOT required to create or submit Israel Care Labels to DM testing Team for approval. DM Testing Team will automatically generate the appropriate Israel Coded Care Label, in the DeSL system at time of Tri-Lingual Coded Care approval. Price Tickets: The DM price ticket quality for all international partners is the same as the DM price tickets for USA master purchase orders: White 12pt. cardstock *The Destination Maternity Global Testing Program Document and all testing forms and guidelines are accessible from the Forms Download Link, on the Vendor Manual Dashboard, SECTION 7 FORMS. 37 Mexico Requirements General Product Labeling Mexico general product labeling requirements are regulated by several different agencies under numerous regulations and norm, or Normas Oficiales Mexicanas (NOM), INCLUDING The Federal Law on Measurement and Normalisation; the Law on External Trade; Secretaria de Comercio y Fomento Industrial (SECOFI) NOM 050/94; the agreement establishing the verification procedures for imported products complying with NOM s 050 and 051; the agreement on the tariff items for which compliance with NOMs if verified at the border; and articles of Customs Laws. All imported non-apparel or textile products must be labeled with the following information: Name and description of product Quantity (in compliance with NOM 030 SCFI) Name of Manufacturer Country of Origin Any relevant hazard or risk announcements Name of importer and registered federal tax id number Labeling requirements for apparel and textiles were updated in 2006 by the Ministry of Economy and the State office of Standards via NOM-004-SCFI-2006: for more information on Mexico labeling requirements please visit: ( Under the regulation, apparel and textile products must have a permanent label with the following information: Commercial Brand Name (Destination Maternity Brand Name) Fiber content by weight (in compliance with NMX-A-099-INNTEX) Care Instructions (In accordance with NMX-A-240-INNTEX) Size (for apparel products) Country of Origin (Conspicuous location CB Neck, Wing(Bra), CB Waist) Name and address of Importer (Destination Maternity Mexico partner s Importer of Record information) *The DM Tri Lingual Coded Care Instructions are fully compliant for Mexico. Vendors many not deviate from these standard cares unless otherwise directed by the Testing Team. CARE LABELING Mexico requires the Spanish translation for fiber content only to be exhibited in all lowercase letters including the first letter of the word. In order to PREVENT separate care label approvals - ALL Destination Maternity care labels (except International styles for ISRAEL) require Spanish translation of fiber content only to be all lowercase letters. 38 Mexico Requirements The following requirements are applicable to International Purchase Orders for Liverpool, shipping to Mexico. Mexico recognizes US (ASTM) Care symbols and these care symbols will suffice as compliant care instructions in lieu of the Spanish care instructions as long as any additional care instructions or protective wording, not covered by a US (ASTM) care symbol, are translated in to Spanish. 50 Saudi Arabia Requirements Certificate of Conformity for Exports to Saudi Arabia For all exports to the Kingdom of Saudi Arabia a Conformity Assessment Programme has been implemented. All products require a Certificate of Conformity also referred to as a SASO CoC to enable them to be cleared through Saudi Customs. The Saudi Arabia Conformity Assessment Programme, which covers all goods, has a number of key objectives: Protection of public health Consumer safety National security Protection of religious and public morals Protection of environment Prevention of deceptive practices Every consignment of imported goods must be accompanied by a Certificate of Conformity from an authorized inspection agency. DM Certified Testing Lab: Intertek is authorized to issue the Certificates of Conformity (CoC). SASO inspections for DM International Purchase Orders for Saudi Arabia will be handled by Intertek and Destination Maternity and will take place at our Shanghai 3PL and New Jersey Distribution Center on a monthly basis to ensure customs clearance of shipments and confirm that the products comply with the relevant Saudi technical regulations and national, regional or international standards. All imported consignments must bear a non-removable indication of origin. Those that do not will be held by Saudi Customs and the Importer will be asked to take corrective action or provide an undertaking that the offence will not be repeated. Failure to do so could result in a fine or goods being returned to their country of origin.
