1 Report to Mono Council To: From: Mayor Ryan and Members of Council Credit Valley Conservation Authority, 1255 Old Derry Road, Mississauga, ON L5N 6R4 Meeting Date: March 13, 2018 Subject: Exemption from Noise By-Law Number Events Location: Island Lake Conservation Area, Hurontario Street South, Orangeville, ON L9W 2Y9 Exemption Sought for: Credit Valley Conservation Authority is seeking exemptions from Type of Act class 2 and of Schedule B to Bylaw Number Type of Act 2 The operation of any electronic device or a group of connected electronic devices incorporating one or more loudspeakers or other electro- mechanical transducers, intended for the production, reproduction or amplification of sound other than a security alarm. Prohibited Time Period Point of Reception In Residential Area C,D There are three (3) Prohibited Period of Time of concern: 1. The Prohibited Time Period C is defined as being between the hours of the 1700 hrs (5pm) one day to 0700 hrs (7am) next day 0900 hrs (9am) Sundays. 2. The Prohibited Time Period A is from 23:00 one day to 07:00 next day (09:00 Sundays). 3. In addition, CVCA is seeking exemption to Prohibited Time Period D which relates to All day Sundays and Statutory Holidays since Canada Day is an official Statutory Holiday.
2 Date and Period of Time: CVCA is planning the following events in 2018: Note: On a go forward basis Credit Valley Conservation will submit an annual list of known events at Island Lake Conservation Area to the Town of Mono and their Noise by-law officer by March 1 st. 3 Rational for Granting Exemptions Why the exemption should be granted for these Events: Credit Valley Conservation will submit annually to the Town of Mono a list of annual or known events for the upcoming season for consideration according to the Town of Mono s present Noise by-law exemption requirements. Most of the events will contain the sound within the boundaries of the Conservation Area or to the nearest point of reception. Credit Valley Conservation will work with its neighbours and surrounding communities to mitigate any concerns. This can be achieved by working in collaboration with the Town of Mono s by-law officer and measure the noise levels with an approved sound measuring device at location s identified in Appendix 1 (POR 1 &2) during the listed events. At least three other various locations will be chosen in close proximity to the two locations identified on the map in Appendix 1(POR 1&2). These measurements will be recorded and the information will be submitted to the Town of Mono and their noise by-law officer within seven days after the event. Most of these events are fundraising events that benefit the surrounding communities and draw visitors to the area contributing to tourism dollars. Steps to bring about compliance to this by-law: In June 2014, the Town of Mono granted a similar one time exemption for Theatre Orangeville, in partnership with Credit Valley Conservation and The Rotary Club of Orangeville Highlands, for the purpose of being able to measure the noise levels created by events of this nature. Novus Environmental was hired as an approved noise consultant by the Town of Mono to measure these noise levels. Sound levels can be seen in the attached report. (BLAST Music Event Noise Monitoring, pg.7) Credit Valley Conservation has also implemented internal guidelines that are reviewed annually to minimize any impact to existing terrestrial species. See attached. (Credit Valley Conservation Memorandum, Amphitheatre Use) If noise complaints are encountered during any event, the sound levels will be adjusted accordingly. Credit Valley Conservation will provide the Town of Mono s noise by-law officer with contact numbers for the onsite Superintendent in charge of the event to make any recommended adjustments to the sound levels immediately. As per the requirements of the noise by-law, the events will be published in a local newspaper for general circulation within the municipality. Credit Valley Conservation will post the upcoming events at all sanctioned access points to the conservation area within 30 days of the event.

Monitoring and reviewing the guidelines will continue on an annual basis. Below are the updated guidelines that will be followed: Frequency of use (approx times per year with no more than 3 consecutive days at once) Timing and type of use: - May, Victoria Day until Mid- June (low noise level events such as theatrical performances, weddings, presentations, ceremonies etc.) - Mid-June to Thanksgiving weekend (noise levels within the municipal bylaw will be permitted such as amplified music, concerts, performances etc.) Hours of use (in accordance to the Town of Mono s noise by-law or apply for an exemption of the noise by-law through the Town of Mono if required, generally within the CA operating hours with possible extended hours)
