19 GROUP BOOKS & NON-PRINT LIBRARY REVISED AWARD PAGE 19 NOTE TO AUTHORIZED USERS: (Cont d) Authorized users have the responsibility to document purchases, particularly when using OGS multiple award contracts for the same or similar product(s)/service(s), which should include: a statement of need and associated requirements, a summary of the contract alternatives considered for the purchase, the reason(s) supporting the resulting purchase (e.g., show the basis for the selection among multiple contracts at the time of purchase was the most practical and economical alternative and was in the best interests of the State). PRICE: Price is net, F.O.B. destination, any point in New York State and includes inside delivery inside doors of agency s receiving platform. No shipping charges will be allowed EXCEPT shipping charges may be allowed on foreign publications shipped directly to the customer from an address outside the continent of North America. Foreign shipping costs shall be prepaid by the contractor and all such order shall be shipped on an F.O.B. destination basis. There shall be no increase in contract prices for freight, shipping (foreign shipments excepted), fuel surcharges, FPT (Freight Pass Through), etc. See Delivery clause for rush order charges. Upon mutual agreement, delivery locations may be expanded per the Extension of Use clause. Discount percentages and/or monetary (dollar) amounts to be deducted or charged to each ordering agency are listed by contractor. These discounts and monetary amounts shall be applied to publishers list prices. The discount may increase at any time, but the publishers list prices shall be the current prices as published and distributed to the trade by the publishers. Discount shall not decrease during the term of the contract. Monetary amounts may decrease at any time during the contract period and may increase annually (from contract begin date) at an amount not to exceed 5% or may increase in accordance with the current Consumer s Price Index, for services, whichever is lower. For the purpose of this contract, monetary is defined as charges included under Item IV, NET HANDLING CHARGES, and Section G, SERVICES. The State of New York is not subject to any fair trade agreements. The contractor guarantees that the terms quoted are the lowest offered to any governmental or commercial consumer on similar items, quantities, terms and conditions. Should a contractor offer any consumer higher discounts during the contract period, such higher discounts shall apply on all unshipped orders to all customers for all similar terms and conditions from the date of such offering for the balance of the contract period, or until a further price reduction is made. The contractor shall immediately notify the Office of General Services, Procurement Services Group, in writing of any such new pricing. This does not apply when the price is offered under OGS or Less (see Important Notice to Bidders/Resultant Contractors and State Agencies - OGS or Less Guidelines Apply to this Contract clause).
