1 1 Step Out Fearless Homosexuality is no crime. From fearing state and society, gays now have law on their side Editorial Supreme Court has consigned over 150 years of discrimination against the LGBT community, wrought by enactment of the Indian Penal Code in 1860, to the annals of history. Section 377 IPC, that denied India s homosexual citizens the right to pursue their sexual orientation, applies no more to consensual sexual behaviour. In restoring their rights to equality before law, personal liberty, privacy and life with dignity all fundamental rights guaranteed to an Indian citizen which should have been theirs from birth a grave constitutional wrong that questioned the Republic s commitment to minority rights stands corrected. The next logical step would be to recognise gay marriage. Supreme Court (SC) has also ejected from its precedents the problematic verdict of December 2013 that recriminalised homosexuality and its observations about so-called rights of LGBTs who constituted a miniscule fraction of the country s population. This had stoked much unease over law giving precedence to social mores over constitutional morality. But subsequent judgments including the historic Right to Privacy verdict and the present one have conclusively rejected the state s right to police bedrooms or deny constitutional rights to a minority. From Justice Chandrachud beginning his judgment by noting The lethargy of the law is manifest yet again to Justice Nariman concluding that it is clear that Articles 14, 15, 19 and 21 have all been transgressed without any legitimate state rationale to uphold such provision, SC s focus on individual rights promises to bridge the gap between constitutional aspirations and ground realities. After all, current Indian politics is predisposed towards religion and caste or more broadly towards large collectives having strength of numbers. This is where a judiciary committed to democracy and constitutional values is the last resort for harried citizens. Recall how in reuniting Hadiya with her husband or quashing bans against Padmaavat, SC faced down majoritarian impulses. For similar reasons, successive governments shrunk away from amending 377. Before SC recognised privacy as a fundamental right, government stood in opposition, regarding it as an abstract concept. After helping demolish 377 and more cases like Aadhaar and adultery awaiting their turn, the privacy judgment may just have begun impacting our lives in concrete ways. What Supreme Court does in the realm of safeguarding individual liberties must shine like a beacon for lower courts to replicate. The defence of a person s rights even when you disagree with that person keeps democracy, dissent and diversity alive.

The Constitution Bench of the Supreme Court of India has undone an enormous injustice to members of the lesbian, gay, bisexual and transgender (LGBT) community in its judgment delivered in Navtej Johar vs Union of India. It has undone not just Section 377 of the Indian Penal Code insofar as it decriminalised homosexual acts between consenting adults, but also its own judgment in Suresh Kumar Koushal vs Naz Foundation. It is an important judgment not just for the expansion for civil liberties and gay rights in India, but also for the court to recognise that, as an institution, it failed terribly in delivering the kind of judgment that it did in Suresh Koushal. The court s institutional faults were many first and foremost in being unconcerned with issues of standing when it permitted total third parties to approach it challenging the Delhi high court s judgment in Naz Foundation vs NCT of Delhi which had read down Section 377. It is one thing for the court to permit third parties to act in public interest without standing in rare case it is another to not even attempt to address what was the important question of public interest that would permit the parties to use the courts to try and overturn progressive and historic judgments. A second fault was in the fact that the court did not think the issues were worthy of serious constitutional debate. An issue of such far reaching impli-cations was dealt with by a bench of only two judges who failed to see the full implications and impact of the case, whether or not they agreed with the petitioner. Even at the first instance, the Supreme Court should have ensured that the matter was heard by a constitution bench of no fewer than five judges (as the Constitution demands) and its failure to do so is an indictment of the legitimacy of Koushal. The final fault was in the judgment itself. The words minuscule fraction and so-called rights stung. It may have been aimed purely at members of the LGBT community, but it spoke of a court that was distinctly and deeply out of touch with the larger changes in society and greater tolerance for diversity. These were words that tomorrow could be turned on any minority for any reason if the circumstances permitted. They go to the heart of what the court is supposed to do protect exactly such minorities from the whims of the majority. In saying what it did, the Supreme Court told us (and not just the LGBT community) that it didn t care enough to do its job. Thankfully, the Supreme Court has done exactly what was expected of it in Navtej Johar. While ostensibly concerned only with the reading down of Section 377, it has gone further than expected in handling the matter with the utmost sensitivity and care that it deserved. Whether in the atmosphere at the hearings or in the nuanced reading of gay rights that we get in the judgments, Navtej Johar is a universe away from the narrow minded and straitened judgment in Koushal. As historic and necessary as this judgment is, we must not lose sight of the fact that all it does is restore

3 3 gay rights in India only to the situation it was in 2013 beforee Koushal was delivered. There is still a much greater task before the court, not just in the context of gay rights but in the largerr context of building an inclusive and diverse nation that fulfils the vision of the framers of the Constitution. For, in as much as the Johar judgment is about gay rights, it has the potential of fundamentally re-shaping the jurisprudence around equality in India. As important as it is to affirm autonomy and push back against arbitrary laws, the Supreme Court s judgment could potentially give new meaning to the notion of equal protection of laws, protecting not just the LGBT community but potentially every minority in a country of minorities. The coming years could herald the dawn of a bold era for constitutional courts in India giving greater and richer meaning to equality under the Constitution. India is the third country, after Japan and Australia, to have such a ministerial engagement with the US. This upgrade in US ties, however, is not at the expense of India s independent foreign policy and strategic engagement with the world. This is evident from the US acceptance of India s defence ties with Russia and trade engagements with Iran. India-US bilateral ties have been on the ascendant for more than a decade now, beginning with the efforts made by the Vajpayee government and the Indo-US nuclear deal of Nonetheless, the 2+2 Ministerial Dialogue marks an important milestone. It provides a platform for both countries to discuss issues of strategic importance and allows for synergy in their diplomatic and security efforts. Strengthening of defence ties is among the pillars of this strategic engagement India s designation as a Major Defence Partner creates the opportunity for better defence and security coordination and cooperation. It allows for an expansion in the two-way trade in defencee items and defence manufacturing supply linkages. The signing of a Communications Compatibility and Security Agreement (Comcasa) enhances the interoperability between the militaries and military systems of the two countries. Expansion of counterterrorism cooperation and the naming of Pakistan-based terror outfits are welcome.such expanded cooperation with the US and interoperability with their weapons systems makes it mandatory for India to step up its R& &D efforts in defence technologies.to be a passive recipient of oodles of one variety of defence tech is to lose the capacity to handle other kinds, making for dependence.

4 4 Good Riddance To Colonial Rubbish ET Editorials We welcome the unanimous verdict of a five-member Constitution bench of the Supreme Court, articulated through four separate judgments, however, that homosexuality is not a crime but a natural state that society must respect as part of the right to liberty and to live with dignity guaranteed by the Constitution. This removes the legal hurdle to large numbers of Indians who belong to the Lesbian, Gay, Bisexual, Transgender and Queer (LGBTQ) community to seeking a life of equality with other members of society. However, social mores do not change, merely because the law has expunged an aberrant portion from its body. For that, the state must be prepared to fully enforce the judgment, as conservative elements oppose change to social norms relating to sexuality. We would have appreciated a categorical statement of position by the government, setting out its views on the validity of Section 377, says Justice Chandrachud in his judgment. That would have been ideal. But the government did the next best thing, leave it to the court to decide, without opposing decriminalisation of consensual sex between adults, whatever its nature. Its pragmatism is explained by the observation of the ruling party s ideological parent, the RSS, following the verdict, that homosexuality is not natural. Nor have political parties come forward to welcome the judgment, except for Congress and the Left. The reluctance of the political class to confront social conservatism in defence of liberty and equality points to the tough battle ahead for the LGBTQ community to translate their release from criminality into celebration of life on par with heterosexual men and women. In fact, there is reason to celebrate the judgment as one more step forward in the national project of shedding the Victorian shroud of prudery that colonialism had forced on a culture that had produced the Kamasutra and the commingling of stone and sensuality at Khajuraho. 10 10 Date: River And Stick Draft bill that recommends punitive measures to clean Ganga is a climbdown from the Namami Gange project Editorial In May, Union Water Resources Minister Nitin Gadkari announced that the government will try to ensure a per cent improvement in the Ganga s water quality by March The water resourcess ministry, it seems, is now taking desperate, rather than sensible, measures to meet that deadline. If it has its way, a host of activities that impact the Ganga will be deemed illegal. These include constructionn activities that obstruct the river, withdrawal of groundwater for commercial or industrial purposes, commercial fishing and discharging of sewage into the the river. The ministry has drafted a bill whichh prescribes a slew of penal provisions including fines and imprisonment to curb these activities. The draft also envisages a Ganga Protection Corps to arrest those who pollute the river. Such reliance on punitive measures is a disturbing climbdown from the government s Namami Gange project in more ways than one. Namami Gange recognisess that the key to reviving the river lies in a robust sewage infrastructure. The programme that took off two years ago ticked several boxes about the river s ecology. It had projects to develop interceptor drains, plant trees and improve the river s species composition. More importantly, the project accepted that its success hinged on the support of the people, whose activities impact the Ganga. In May, the Water Resources Minister talked of the government s resolve to attain synergyy between ecology and development. He also talked of plans to link the livelihood needs of local communities with efforts to clean the Ganga. This dovetailedd with the Ministry s project to create a cadre of village and town-level volunteers who would help panchayat, municipal and other local bodies to monitor the quality of the Ganga s water. There has been very little, however, by way of givingg effect to these plans to ensure people s participation. The Namami Gange website talks of awarenesss campaigns to curb pollution of the river. But it has nothing on the successes or failures of these projects. Namami Gange, in fact, has been dogged by the failing of other Ganga clean-up projects the gap between intention and implementation. Till March, the water resources ministry had spent barely a fifth of the Rs 20,000 crore allocated for the project. In July, the National Green Tribunal pulled up the government for tardy progress on the Clean Gangaa Mission. Even then, the government would do well to remember that it does have a lot of the basics in place. There is no reason for a law heavy on punitive measures to clean the Ganga.
